AN ORDINANCE FINDING THAT THE PROVISION OF FIRE PROTECTION
SERVICE TO THE AREA KNOWN RS WEST VAIL SUBSEQUENT TO THE
INVALIDATION OE THE WEST VAIL ANNEXATION PROCEEDINGS WOULD
BE OF BENEFIT TO THE TOWN OF VAIL; AND SETTING FORTH THE
RATES PURSUANT TO WHICH SUCH EIRE PROTECTION SERVICES WILL
BE PROVIDED.

Ca roselli vs. Town of Vail, et a1. the area known as "West Vail" will no longer be a
part of the Town of Vail as of 12:00 noon September 11; and the area known as "West
Vail" has no way to provide its own fire protection services at the present time, and
WHEREAS, the Town Council finds and determines that it would be of benefit to the
Town of Vail as well as to the area known as West Vail to continue providing fire pro
tection services to the area known as West Vail under the conditions set forth in this
Ordinance in that provision of such services. would protect property located within the
West Vail area and would also help prevent the spread of any fire from the West Vail
area into the Town of Vail itself.
NOW, THEREFORE, be it ordained by the Town Council of the Town of Vail as follows:
Section 1. The Town of Vail Eire Department sha11 respond to requests for f-ir~e

protection services out of the Town limits area and~sha11 charge the following fees
based on a one {1} hour minimum charge per call.
Medical call
Fire call/first pumper
Fire call/second pumper
Ladder truck
Each man hour
$100/hour
- $150/hour
$250/hour
$400/hour
$15
False alarm $100/hour
Section 2. As an option to the fee per request schedule set forth in paragraph
1 of this Ordinance, the Town of Vail may enter into contracts for the provision of -~.~,~„
protection services for the protection of commercial dwellings on the fallowing basis:
R1 - $.10/square foot Natel and Apartments (three or more units)
R3 - $.08/square foot Dwellings and Lodgings (less than three units}
61 ~ $.20/square foot Gasoline Service Stations
I32 - $.15/square foot Drinking and Dining/Wholesale - Retail

Section 4. If any fee due hereunder is not paid within the thirty (30} day

Section 5. Due to the invalidation of the annexation of the area known as
West Vail and the necessity of providing said area with adequate fire protection ser-
vices this Ordinance shall be passed as an Emergency Ordinance necessary for the pre s--
ervation of the public property, health, welfare, peace, or safety and shall take eff~~t
immediately upon final passage.
Section 6. If any part, section, subsection, sentence, clause, or phrase of
this Ordinance is for any reason held to be invalid, such c;::~~=.:ion stall ~~~~ off^~' the
validity of the remaining portions of this Ordinance; and the Town Council hereby declares
it would have passed this Ordinance, and each part, section, subsection, sentence, clause

or phrase thereof, regardless of the fact that any one or more parts, sections, sub-
sections, sentences, clauses or phrases be declared invalid.
Section 7. The Town Council hereby finds, determines and declares that this
Ordinance is necessary and proper for the health, safety and welfare of the Town of
Vail and the inhabitants thereof.
Section 8. The repeal or the repeal and reenactment of any provision of the
Vail Municipal Code as provided in this-Ordinance shall not affect any right which has
accrued, any duty imposed, any violation that occurred prior to the effective date
hereof, any prosecution commenced, nor any other ;action or proceedings as commenced
under or by virtue of the provision repealed or repealed and reenacted. The repeal of
any provision hereby shall not revive any provision or any ordinance previously
repealed ar superseded unless expressly stated herein.
INTRODUCED, READ AND APPROVED AS AN EMERGENCY ORDINANCE THIS 17th day of
September 19$5, in the Council Chambers of the flail Municipal Building,
Vail, Colorado.
