HomeMy WebLinkAbout1985-22 FAILED Amending Section 16.20 of the Vail Municipal Code by the Addition of a New Section 16.20.145 Entitled "Special Boards" ORDINANCE NO. 22 Series of 1985 AN ORDINANCE AMENDING SECTION 16.20 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL BY THE ADDITION OF A NEW SECTION 16.20.145 ENTITLED "SPECIAL BOARDS." ~. ~~~ ~~ ~~~~V"" ~ WHEREAS, the Restaurant Association of Vail has requested the addition of this new category; and W~iEREAS, existing regulations in the Town of Vaii sign code do not currently a11ow the display of these special boards; anti WHEREAS, the Town Council considers that it is reasonable, appropriate and benficia7 to the Town and its citizens, inhabitants and visitors to amend said Section 16.20. NOW, THEREFORE,: BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO THAT: ~` -_ Section 1 Section 16.20 of the Municipal Code of the Town of Vail is hereby amended by the addition of a new section 16.20.145 entitled "Special Boards" to read as follows: 16.20.145 Special Boards A. Purpose, to announce daily food and drink specials, promotional events, and entertainment events. B.~ Size, no greater than 2' x 3' (6~square feet). C. Location, on leased or owned property, within a reasonable proximity to menu box, subject to approval by the Community Development Depart~~ent. D. Number shall be as follows: 1. Permuted, one special board. 2. Permitted, if a business has two consumer entrances on separate pedestrian ways, and has been approved for two menu boxes, two special boards shall be allowed. i=. Design, an erasable-type board. F. Lighting, no additional lighting specifically for special boards. '.' +" ~ Sert7on 2. ~~ If any part, section, subsection, sentence, clause or phrase of this ordina~::;e is for any reason held to be invalid, such decision shall not affect the validi~y of the remaining portions of this Ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, senten-~ clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be c~ecl,~~~ ~.~- ";~. Section 3. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the hearth, safety and welfare of the Town of Vail ar~d the inhabitants thereof. Section ~• The repeal or the repeal and reenactment of any provisions of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violat~ian that occurred prior to the effective date hereof, any prosecution commenced,-nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previo~isly repealed or superseded unless expressly stat`~d herein.
