AN ORDINANCE AMENDING SECTION 3.40.120 STATUTORY EXEMPTIONS
OF THE Ml1NICIPAL CODE OF THE TOWN OF VAIJ_ BY THE DELETION FROM
THE SALES TAX ORDINANCE OF THE EXEMPTION FOR FOOD SALES.
WHEREAS, in accordance with C.R.S. 29-2-105, the exemption for food sales is
stated in 39-26-114 (1} (a} (xx}, C.R.S. was made applicable in the Town of Vail
from and after January 1, 1980 by the Town Council, and
WHEREAS, due to increased obligations and costs the Town of Vail is in need of
additional revenues, and
WHEREAS, the Town Council of the Town of Vail believes that the removal of the
sales tax exemption for food sales within the Town of Vail is an equitable means of
obtaining additional revenues.
NOW, THEREFORE, be it ordained by the Town Council of the Town of Vail,
Coloradn, that:
Section 1.
Section 3.40.120 Statutory Exemptions of the Municipal Code of the Tawn of Vail
is hereby repealed and reenacted with amendments to read as #`ollows:
3.40.120 Statutory Exemptions
For the purpose of collection, administration and enforcement of this
Chapter by the Director of Revenue, the provisions of C.R.S., 1973, 39--26-114, as
amended, providing for exemptions and disputes shall be deemed applicable and
incorporated into this ordinance except for the exemption for food sales as set
forth in 39-26-114 (1) (a} (xx), C.R.S., as amended.
Section 2.
If any part, section, subsection, sentence, clause, or phrase of this ordinance
is for any reason held to be invalid, such decision shall not: affect the validity of
the remaining portions of this ordinance; and the Town Council hereby declares it
would have passed this ordinance, and each part, section, subsection, sentence,
clause or phrase thereof, regardless of the fact that any one ar more parts,
sections, subsections, sentences, clauses or phrases be declared invalid.

The Tawn Cnuncil hereby finds, determines and declares that this Ordinance is
necessary and proper for the health, safety and welfare of the Town of Vail and the
inhabitants thereof.
Section 4.
The repeal or the repeal and reenactment of any provision of the Vaii Municipal
Code as provided in this ordinance shall not affect any right which has accrued, any
duty imposed, any violation that occurred prior to the effective date hereof, any
prosecution commenced, nor any other action or proceedings as commenced under or by
virtue of the provision repealed or repealed and reenacted. The repeal of any
provision hereby shall not revive any provision or any ordinance previously repealed
or superseded unless expressly stated herein.
INTRODUCED, READ AND APPROVED ON FIRST READING THIS I9th day of November ,
1985, and a public hearing shall be held on this ordinance on the 19th day of
November 1985, at 7:30 p.m. in the Council Chambers of the Vail Municipal
