AN ORf~INANCE APPROVING A SPECIAL. DEVELOPMEN~i" DISTRICT'
(KNOWN AS SDD N0. 19, GARDEN OF THE GODS CLUB)
AND ~~iIC DEVELOPMENT PLAN IN ACCORDANCE WITH CHAPTER
18.40 OF THE MUNICIPAL CODE AND SETTING FORTH
DETAILS IN REGARD THERETO.
WI-IERfAS, Chapter 13.40 of the Vail Municipal Code authorizes special
development districts within the Town; and
WHEREAS, the owner of the Garden of the Gods Club, Mr. A.G. Hill, has
submitted an application for special development district approval for certain
parcels of property within the Town known as Lot IC, Black 5A, Vai"f Village 5th
Filing and a portion of Lot P-~, Block 3, Vail Village 5th f=iling; and
WHEREAS, the establishment of the requested SDD 19 will ensure unified and
coordinated development within the Town of Vail in a manner suitable for the area
in which it is situated; and
WIfERERS, the Planning and Environmental Commission has recommended approval of
the proposed SDD; and
WHEREAS, the Town Council considers that it is reasonable, appropriate, and
beneficial to the -town and its citizens, inhabitants and visitors tp establish said
Special Development District Na. 19.
NOW, THEREFORlw, BE IT ORDAINED BY THE TOWN COUNCIL OF T"HE TOWN OF VAIL,
COLORADO, THAT:
Section 1. Amendment procedures Fulfilled, Planning Commission Report
The approve] procedures prescribed in Chapter 18.40 of the Vail Municipal Code have
been fulfilled, and the Town Council has received the report of the Planning and
Environmental Commission recommending approval of the proposed development plan for
SDD No. 19.
Section ~. Special Development District No. 19
Special Development District No. 19 (SDD No. 19) and the development plan
therefore, are hereby approved for the development of the parcel noted above within
the Town of Vail.
Section 3. Purpose
Special Development District No. 19 is established to ensure comprehensive
develapment and use of an area that wil~f be harmonious with the general character

of the Town of Vail and to promote the upgrading and redevelopment of a key
property in the Tawn. The develnpment is regarded as complementary to the Town by
the T~awn Council and meets all the design standards as set Earth in Section 18.40
of the Municipal Code. There are significant aspects of Special Development
District No. 19 which cannot be satisfied through the imposition of standards in a
Public Accommodation zone district. SDD No. 19 is compatible with the upgrading
and redevelopment of the community while mairrtaining its unique character.
Section 4. Development Plan
A. T'he development plan for SDD No. 19 is approved and shall constitute the plan
for development within the Special Development District. The development plan
is corrrprised of the fallowing plans by Snowdon and Hopkins Architects and
consists of the following documents:
Sheet 1. Site and Landscape Plan - Final Revision: November 9, 1987.
Sheet 2. First Floor Plan - November 5, 1987.
Sheet 3. Second Floor Plan - October 30, 1987.
Sheet 4. Third Floor Plan - October 30, 1987.
Sheet 5. Fourth Floor Plan - September 23, 19F~7.
Sheet 6. South Elevation - September 23, 1987.
Sheet 7. East Elevation - October 6, 1981'.
Sheet 8. West Elevation - September 23, 1.987.
Street 9. North Elevation - September 23, .1987
B. The development plan shall adhere to the following:
Setbacks
Setbacks shall be as noted on the site plan listed above.
Height
Heights of structures shall be as indicated an the elevations listed above,
but in no case shall the height exceed ~48 feet for a sloping roof or 4~5 feet
for a flat or mansard roof.
Coverage
Site coverage shall be as indicated on the site plan listed above.
Landscaping
The area of the site to be landscaped shall be as indicated on the final
landscape plan approved by the Design Review Board and on file in the
Community Development Department.

Parking
Parking shall be provided on Lot K, Block 5A, Vail Village 5th Filing and a
portion of Lot P-Z, Qlock 3, Vail Village 5th Filing as indicated on the site
plan, but in no case shall the sites have the ability to park less than 27
automobiles.
Section '.i. Der~sit.v
SDD No. 19 shall not contain more than 16 accommodation units, representing 4,596
square feet of Gross Residential Floor Area (GRFA) and 8 dwelling units
representing 17_,141 square feet of GRFA. The site shall have a maximum density of
13 dwelling units representing a total GRFA of 16,737 square -Feet. 5DD No. 19
shall also contain 2 employee dwelling units: one employee dwelling unit shall have
a mir7imum GRFA of 215 square feet and the second employee dwelling unit sh-cll have
a rninirnunr of 515 square feet GRFA. The two restricted employee dwelling units
shall be governed by an agreement between the Tawn of Vail and the property owner
dal.ed November 25, 1987. The two restricted employee dwelling units shat] be
restricted until December ~l, 2007.
Sectinn 6. ~SeS
Permitted, conditional, and accessory uses shall be as set forth in the Public
Accommodation ,Zone District while recognizing the property wil] no longer meei: the
defirrition of a lodge as found in Section 18.04.210.
Section 7. Else Restrictions
Owners' use restrictions per Section 17.26.075 of the Town of Vail Subdivision
Regulations shall apply to the 16 accommodation units and the middle dwelling unit
on the second floor as indicated on the Second and Third Floor Plans drawn by
Snowdon and Hopkins and dated October 30, ].987. The restricted units represent a
total GRFA of 5,730 square feet.
Section $. Amendments
Amendments to the approved development plan which do not change its substance may
be approved by the Planning and Environmental Commission at a regularly scheduled
public hearing in accordance with the provisions of Section 18.66.060. Amendments
which do change the substance of the development plan shall be required to be
approved by Town Council after the above procedure has been followed. The
Conrrrrur~ity Development Department shall determine what constitutes a change in the
substance of the development plan.

Section 9.
If any part, SeC~loll, SUSsection, sentence, clause or phrase of this o~•dinance is
for any reason held to be invalid, such decision shall not affect the validity of
the remaining portions of this ordinance; and the Town Counci] hereby declares it
would have passed this ordinance, and each part, Section, subsection, sentence,
clause or' phrase thereof, regardless of the fact that any one or mare parts,
sections, subsections, sentences, clauses or phrases be declared invalid.
Section 10,
The repeal or the repeal and reenactment of any provisions of the Vail Municipal
Cade as provided in this ordinance shall not affect any right which has accrued,
any duty imposed, any violation that occurred prior to the effective date hereof,
any prosecution commenced, nor any other action or proceeding as commenced under or
by virtue ofi the provision repealed or repealed and reenacted. The repeal of any
provision hereby sha]1 not revive an,y provision or any ordinance previously
repealed or superseded unless expressly stated herein.
INTRODUCED, ROAD AND PASSED ON FIRS C' READING THIS 17th day of November ,
7.987, and a public hearing shall be held on this ordinance on the 17th day of
November 1987 at 7:30 p.m. in the Council Chambers of the Vail Municipal
Building, Vaii, Colorado.
