AN ORDINANCE ZONING PRgPERTY LOCATED AT 2785 SUN~iURST DRIVE
AS LEGALLY DESCRIBED IN THE ATTACHED LEGAL DESCRTl~TiOIV FROM
LOW DENSITY MUi.TIPLE FAMILY TO SINGLE FAMILY RESIDENT"IAL AND
AMENDING THE OFFICIAL 7.ONING MAP IN RELATION THERETO.
WHEREAS, the property to be rezoned contains a single family dwelling unit;
and
WHEREAS, the property to be rezoned was originally developed as a segment of
tF~e Vail Golf Course ~fownhames project but is significantly different from said
multi-family project; and
WHEREAS, the Planning and Environmental Commission has considered thFa
al~propriate zoning for the parcel and has unanimously recommended that tiie Town
Council zone the parcel Single Family Residential; and
WfIEREAS, the Town Council considers it is in the public interest to zone said
property Single Family Residential.
NOW, THEREE'ORE, BE I7 ORDAINED BY THE TOWN COUNCIL OF THE `i•OWN OF VAIL,
CULORAUO, THAT:
Section 1.
The Town Council finds that the procedures for a zoning amendment have iaeen
properly fo~l'iowed, and the Town Council has received the report of the Planning and
Ervironmental Commission recommending this rezoning to Single Family Residential.
Section 2.
Pursuant to Section 18.68.870 of the Vail Municipal Code, a parcel of property
described as attached on Exi~ibit A 'is rezoned to Single Family Residential.
Section 3.
As provided in the ordinances of the Tawn of Vaii, the Zoning Admir3istrator is
hereby directed to modify and amend the official zoning map t:o include i;he zoning
specified in Section 2 {{~~) above.
Section 4.
If any part, section, subsection, sentence, clause or phrase of this ordinance is
far any reason held to be invalid, such decision shall not affect the validity of
the remaining portions of this ordinance; and the Town Council hereby declares it
would have passed this ordinance, and each part, section, subsection, sentence,
clause or phrase thereof, regardless of the fact that any one or more parts,
sections, subsections, sentences, clauses or phrases be declared invalid.

5ectian 5.
The repeal or the repeal and reenactment of any provisions of tf~e Vail f~7unicipal
Code as provided in tfais ordinance shall not affect any right which has accrued,
any duty 'Ii91p05ed, any vio'latian that occurred prior to the effective date hereof,
any prosecution commenced, nor an,y other action or proceeding as commenced under or
by virtue of the provision repealed or repealed and reenacted. The repeal of any
provision hereby shall not revive any provision or any ordinance previously
repealed or superseded unless expressly stated herein.
INTRODUCED, READ AND PASSE=D ON FIRST READING TiilS 1st day of December
1987, and a public hearing steall be held on this ordinance on the l.st day of
December, 1,987 at 7:30 p.m, in the Council Chambers of the Vail f~lunicipal
Building, Vail, Colorado.
