AN ORDYNANCE AMENDING VARIOUS SECTIONS OF CHAPTER 18 OF
THE VAIL MUNTCZPAL CODE AND REPEALING AND RE-ENAC`T'ING
SECTION 18.58,310, SHORT TERM REN`rAL ACCOMMODATION UNIT
OF THE MUNICIPAL CODE TO PROVIDE FOR BEU AND BREAKFAST
OPERATIONS UNDER CERTA:CN PROVISIONS AND CIRCUMSTANCES
AND TO DEFINE BED AND BREAKFAST AND SETTING FORTH

., ~ TnIHEREAS , -the Town CoLinc~.l wishes .to al law bed and breakfast
operations under certain conditions and in certain locations withini
the Town of Vail; and
WHEREAS, the Town Council finds that bed and breakfast
operations operated under certain conditions p~•ovide high quality acid
desirable lodging appropriate far a resort community; and
WHEREAS, policies within the Town of Vail Land Use Plan suppo~~t
the provision of high quality lodging utilizing existing facilities;
and
WHEREA5, the Planning and Environmental. Commission has
unanimously zecommended appx•aval of the zoning code ckxanges contained
herein.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF `.~'I3E TOWN OF
VAIL, COLORADO, AS FOLLOWS:

Sec~i.on 18.58.310 BED AND BREAKFAST OPERATIONS
A. DEFINITION
BED AND BREAKFAST MEANS A BUSINESS WHICH ACCOMMODATES
GUESTS TN A DWELLING UNIT IN WHICH TIIE BED AND BREAKFAST
PROPRIETOR LIVES ON THE PREMISES AND TS IN RESIDENCE DURING
Tf-iE BED AND BREAKFAST USE. A BED AND BREAKFAS'T' OPERATION
MAY SHORT TERM RENT' SEPARATELY UP TO 3 BEDROOMS OR A
MAXIMUM SQUARE FOOTAGE OF 900 SQUARE FEET OF THE DWELLING
UNIT. BED AND BREAKFAST OPERATIONS SHALL ONLY BE PERMITTED
'I'O ACCOMMODATE A FAMILY AS DEFINED IN SECTION 1$.04,7.10.
I3. LOCATION AND CRITERIA
BED AND BREAKFAST OPERA'1'ION5 MAY BE ALLOWED AS A
CONDITIONAL USE IN THOSE ZONE DISTRICTS AS SPECIFIED IN
TITLE 18 OF THE VAIL MUNICIPAL CODE. IF PERMITTED AS A
CONDITIONAL USE PURSUANT TO GIIAPTER 18.60 OF THIS CODE, f3ED
AND BREAKFAST OPERATIONS SIiALL BF. SUBJECT TO 'T'I-iE FOLLOWING
REQUIREMENTS:
1. OFF STREET PARKING SHALL BE PROVIDED IN ACCOTtDANCE
WITH CHAPTER 18.52.
2. ENCLOSED TRASH FACILITIES AND REGULAR GARBAGI; REMOVAL
SERVICE SHALL BE PROVIDED.
3. REMDVAL OF LANDSCAPING FOR THE FROVT~~TON OF ADDI'PTONIIL
PARKING IS STRONGLY DISCOURAGED.
4. SIGNS SHALL BE PROHIBITED.
5. IF A BED AND BREAKFAST OPERATION :~IiALL USE PROPERTY OR
FACILITIES OWNED TN COIwiMON OR JOINTLY WITII OTHER
PROPERTY OWNERS SUCH AS PARKING SPACES OR A DRIVEWAY
IN DUPLEX SUBDIVISIONS, BY WAX OF EXAMPLE AND NOT
LIMITATION, TfiE WRITTEN APPROVAL OF TfiE OTHER PROPERTY
OWNER OR OWNERS SHALL BE REQUIRED TO BE SUBMITTED WITH
THE APPLICATION FOR A CONDITIONAL USE PERMIT.

C. VIOLATION
IF THE DIRECTOR OF COMMUNITY DEVELOPMENT DETERMINES THAT
THE PROVISIONS DF TkIIS SECTION 1.8.58.320 OR ANY CONDITION
OF THE CONDITIONAL USE PERMIT ARE BEING VICUL~ATED, HE SkiALL
GIVE NOTICE OF REVOCATION TO THE BED AND BREAKFAST PERMITEE
IN WRITING DESCRIBING IN REASONABLE DETAIL TkiE VIOLA`T'ION
ALLEGED "T'D HAVE BEEN COMMITTED OR TO E:{IST AND SHALL SERV1
THE NOTICE ON THE PERMITTEE IN PERSON OR BY FIRST CLASS
MAIL AT THE ADDRESS LISTED IN TIIE APPLICATION FOR TIIE
CONDITIONAL USE PERMIT.
IF THE PERMITTEE DISAGREE5 WITH THE DETERMINATION OF TIIE
DIRECTOR OF COMMUNITY DEVELOPMENT THAT A VIOLATION EXIS`T'S,

CONSIDERED A FINAL ORDER OF TIIE PLANNING COMMISS_~ON
REVOKING THE CONDITIONAL USE PERMIT.
Section 18.
It shall be unlawful for a bed and breakfast operation to da busa,ness
without a conditional use permit from the Planning and En~rironmental
Commission or in violation of az}y of the pxavisions of tixe Vail
Municipal Cade.

Section 19. Discontinuance
Any bed and breakfast operation wYiich is discontinued for a period of
twelve months, regardless of any intent to resume operation of use,
shall not be resumed thereafter, and any future use of the site or
structurPS thereon shall conform with the provisions of this title.
Section 20.
The Town Council may call up for review any decision made by the
Planning and Environmental Commission regarding a Conditional Use
Permit for a Bed and Breakfast as per Section 1s.6o.o70.
Section 21.
~f any part, section, subsectinn, sentence, clause ar phrase of this
ordinance is far any reason held to be invalid, such decision shall
not affect the validity of the remaining portions of this ordinance;
and the Town Council hereby declares it would have passed this
ordinance, and each part, section, subsection, sentence,
clause ar phrase tYiereof, regardless of the fact that any ca~ie or more
parts, sections, subsections, sentences, clauses ar phrase: be
declared invalid.
Section 22.
The Town Council hereby finds, determines and declares that this
ordinance is necessary and proper for the health, safety and welfare
of the Town of Vail and the inhabitants thereof.
Section 23.
The repeal nr the repeal and re-enactmeizfi: of any provisions of the
Vail Municipal Code as provided in this ordinance shall not affect
any right which has accrued, any duty imposed, any violation that
occurred prior to the effective date hereof, any prosecution
commenced, nor any other action or proceeding as commenced under az
by virtue of the provision repealed or repealed and reenacted. The
repeal of any provision hereby shall not revive any provision or any
nrdinance previously repealed or superseded unless expressly sL-ated
herein.
