ORDINANCE NO. 41 SERIES OF 1990 AN ORDINANCE ENACTING SECTION 18.04.365, DEFINITION OF SITE COVERAGE IN I°iILLSIDE RESIDENTIAL, SINGLE FAMILY, TWO-FAMILY, AND PRIMARY SECONDARY 20NE DISTRICTS, AND REPEALING AND REENACTING SECTION 18.09.090 SITE COVERAGE-HILLSIDE RESIDENTIAL DISTRICT, SECTION 18.10.110 SITE COVERAGE-SINGLE FAMILY DISTRICT, SECTION 18.12,110 SITE COVERAGE-TWO FAMILY DISTRICT, SECTION 18.1.3.090 SITE COVERAGE --PRIMARY/SECONDARY DISTRICT AND SETTING FORTH THE DETAILS TN REGARD THERETO WHEREAS, site coverage is an important tool far controlling the level of development in the town; and WHEREAS, modifications to site coverage as defined in the Vail Municipal Code for the hillside residential, single family, two-family and primary/secondary zone districts are necessary to ensure its effectiveness; and WHEREAS, in accordance with Section 18.66.140, the Planning and Environmental Commission held a public hearing on the the proposed amendments and has submitted its recommendation to the Town Council; and WHEREAS, The Town Council has held a public hearing as required by Chapter 18.66 of the Vail Municipal Code. NOW, THEREFORE, BE TT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VATL, COLORADO, THAT: Section 1. 18.04.365, the definition of Site Coverage - Hillside Residential, Single Family, Two-Family and Primary/Secondary is hereby enacted to read as follows: 18.04.365 Site Coverage - Hillside Residential, Single family. Two-family and Primary/Secondary zone districts "Site coverage" means the ratio of the total building area on a site to the total area of a site, expressed as a percentage. For the purpose of calculating site coverage, "building area" shall mean the total horizontal area of any building as measured from the exterior face of perimeter building walls or supporting columns above grade or at ground level, whichever is the greater area. Building area shall include all buildings, carports, Porte cocheres, arcades, and covered or roofed walkways. In addition to the above, building area shall also include any portion of roof overhang, eave, ar covered stair, covered deck, covered porch, covered terrace or covered patio that extends more than four feet from the exterior face of perimeter building walls ar supporting columns. 1 r • Section 2 Section 38.09.090, Site Coverage in the Hillside Residential District is hereby repealed and reenacted to read as follows: 1.8.09.090 Site Caveraae Site Coverage shall not exceed 150 of the total site area. Section 3 Sectian 18.10.1.10, Site Coverage in the Single-family Residential District is hereby repealed and reenacted to read as follows; 18.10.110 Site Coverage Site Coverage shall not exceed 20% of the total site area. Sectian 4 Section 18.12.110, Site Coverage in the Twa-family Residential District is hereby repealed and reenacted to read as follows: 18,__12.1,10 Site Coverage Site Coverage shall not exceed 20% of the total site area. Section 5 Section 18.13.090, Site Coverage in the Primary/Secondary Residential District is hereby repealed and reenacted to read as follows: 18.13.090 Site Coverage Site Coverage shall not exceed 200 of the total site area. Section 6 The provisions of this ordinance sha11 not be affective for any application for development which has been submitted to the Department of Community Development, and accepted by the same, on or before January 1, 1991. Section 7 Tf any part, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance; and the Town Council hereby declares it would have passed this Ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 8 The Town Council hereby finds, determines and declares that this Drdinance is necessary and proper far the health, safety and welfare of the Town of Vail and inhabitants thereof. 2 .f ~ . • 1~ Section 9 The repeal ar the repeal and reenactment of any provisions of the Vail Municipal Cade as provided in this Ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action nr proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any prov~.sion or any ordinance previously repealed or superseded unless expressly stated herein. 5ectian 10 All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are hereby repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or part thereof, heretofore repealed.
