ORDINANCE NO. 36 Series of 1991 AN ORDINANCE PROVlDl~1~ FOR THE ESTABLISHMENT OF SPECIAL DEVELOPMENT DISTRICT NO. 27, FOREST GLEN (A.K.A. TIMBER FALLS); ADOPTING A DEVELOPMENT PLAN FOR SPECIAL DEVELOPMENT DISTRICT NO. 27 IN ACCORDANCE WITH CHAPTER 18.40 OF THE VAIL MUNICIPAL CODE AND SETTING FORTH DETAILS IN REGARD THERETO. WHEREAS, Chapter 18.40 of the Vail Municipal Cade authorizes Special Development Districts within the Tawn in order to encourage flexibility in the development of land; and WHEREAS, application has been made for Special Development District approval for a certain parcel of property within the Town, generally described as an unplatted parce} located East of Nugget Lane and south of Gore Creek and legally described in the attached Exhibit A; WHEREAS, in accordance with Section 18.66.140, the Planning and Environmental Commission held a public hearing on the proposed SDD, and has submitted a recammer-dation for approval to the Town Council; and WHEREAS, all notices as required by Section 18.66.080 have been sent to the appropriate parties; and WHEREAS, the Town Council has held a public hearing as required by Chapter 18.66 of the Vail Municipal Code. NOW, THEREFORE, BE }T ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO THAT: Section 1 The Town Council finds that all the procedures for Special Development Districts in Chapter 18.40 of the Municipal Code of the Town of Vail have been fully satisfied. Section 2 A Special Development District is established to assure comprehensive development and use of an area in a manner that would be harmonious with the general character of the Town, provide adoquate open space and promote the objectives of the Zoning Ordinance of the Town. Section 3 The Tawn Council finds #hat the development plan for Special Development District No. 27 meets each of the standards set forth in Section 18.40.080 of the Municipal Code of the Town of Vail or demonstrates that either one or .more of them is not applicable, or that a practical 1 ~~ solution consistent with the public interest has been achieved. In accordance with Section 18.40.040, the development plan for Special Development District No. 27 is approved. The development plan is comprised of those plans submitted by Inter-Mountain Engineering, Ltd., and consists of the following documents: 1. Topographical Survey; dated 416182, sheet 1 of 1, revised 1014184 and 1129185. 2. Scope Analysis; dated 914191, sheet 1 of 1. 3. Tree Locations; dated 611019# , sheet 1 of 1, revised 6/23191. The development plan is also comprised of those plans submitted by Dennis Anderson Associates, Inc., and consists of the following: 1. Illustrative Site Plan; dated 9!9191. 2. Preliminary Site Pian; dated 6110191, sheet 1 of 1, revised 6123191. The development plan also requires the approval of the Final Plat far the major subdivision, as approved by the Town's Planning and Environmental Commission. Section 4 Development standards for Special Development District No. 27 are approved by the Town Council as a part of the approved development plan as follows: A. SETBACKS: Setbacks shall be 20 feet front, 20 feet roar, i 5 feet sides and as further restricted on the development plans set forth in Section 3 of this Ordinance. B. HEIGHT: Building height, for a sloping roof, shall not exceed 33 feet from existing or finished grade, whichever is more restrictive. C. DENSITY: Development in SDD No. 27 shall be limited to 1 single family dwelling for Lots 10 and 11; and to 1 single family dwelling, with an optional caretaker unit, far Lots 1-9 and 12-14. Gross Residential Floor Area (GRI=Aj sha11 be as described in Section 18.04 of the Town of Vail Municipal Code. It should also be Hated that the provision for an additional 425 sq. ft. of GRFA, which is applicable to certain zone districts, does not apply to this Special Development District. The maximum allowable GRFA an these lots for the above ground space is the total GRFA listed above minus 1,000 sq. ft. It is not a requirement that any dwelling unit have 1,000 sq. ft. of basement space, but if a lot owner wishes to utilize all the allowable GRFA for a given lot, then a minimum of 1,000 sq. ft. shall be required to be utilized as basement space. "" On Lots 12-14, 500 sq. ft. of the maximum allowable GRFA shall be utilized only as basement space, as described above. 1. All caretaker units shall be restricted to a maximum GRFA of 900 square feet. 2. No caretaker unit shall be soil, transfered, conveyed ar subdivided separately from the main, or primary unit. 3. No caretaker unit shall be leased or rented for any period less than 30 consecutive days. 3 . ~, ~ ~ D. SITE COVERAGE: The maximum apowable site coverage for each individual lot shad not exceed the maximum GRFA for each lot. E. t_ANDSCAPING: At least forty percent (44%) of each lot shall be landscaped. The minimum width of any area qualifying as landscaping shall be fifteen feet, with a minimum area not less than three hundred square feet. F. PARKING: Parking far SDD No. 27 shall be met in accordance with the off-street parking requirements as specified in Section 18.2 of the Municipal Code of the Town of Vail Section 5 Amendments to the approved development plan may be granted pursuant to Section 18.40 of the Municipal code of the Town of Vaii. Section 6 Approval of Special Development District No. 27 shad be contingent upon the approval of the Plnal Plat, for a major subdivision, for the property legally described in the atkached Exhibit A. Section 7 If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shad not effect the validity of the remaining portions of this nrdinance; and the Town Council hereby declares~it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 8 The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of lfail and the inhabitants thereof. 4 ~ ~ ~~ Section 9 The repeal or the repeal and reenactment of any provision of the Vaii Municipa! Code as provided in this ordinance shalt not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action ar proceeding as commenced under of by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance prevlousiy repealed or superseded unless expressly stated herein. Section 19 All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or part thereof, theretofore repealed.
