AN ORDINANCE AMENDING SECTION 18.32.030 OF THE
MUNICIPAL CODE OF THE TOWN OF VAIL 6Y ADDING
"WELL WATER TREATMENT FACILITY" AS A CONDITIONAL USE
tN THE AGRICULTURAL AND OPEN SPACE ZONE DiSTRIGT.

WHEREAS, tl~e Town Council is of the belief that well water treatment facilities are an
acceptable use, sub]ect to the issuance of a conditional use permit, in the Agricultural and Open
Space Zone District; and
WHEREAS, the Town of Vail Planning and Environmental Commission has recommended
that wail water treatment facilities be permitted as a conditional use in the Agricultural and Open
Space Zone District.
NOW, THEREFORE, BE IT ORDAINED BY TIRE TOWN COUNCIL OF THE TOWN OF
VAIN, COLORADO THAT:
Section 1
Section 18.32.fl3fl is hereby amended by the addition of Paragraph I to read as follows:
"Well water treatment facility."
Section 2
If any part, section, subsection, sentence, clause or phrase of this ordinance Is for any
reason i~eld to be invalid, such decision shaft not effect the validity of the remaining portions of
this ordinance; and tl~e Town Gouncil hereby declares it would have passed this ordinance, and
each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any
one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid.
Section 3
The Town Council hereby finds, determines and declares that this ordinance is necessary
and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
Section ~
The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as
provided In this ordinance shall not affect any right which has accrued, any duty imposed, any
violation that occurred prior to the effective date hereof, any prosecution commenced, nor any
other action or proceeding as commenced under of by virtue of the provision repealed or repealed
and reenacted. The repeal of any provision hereby shall not revive any provision or any
ordinance previously repealed or superseded unless expressly stated herein.

Section ~
A!I bylaws, orders, resolutions and ordinances, ar parts thereof, inconsistent herewith are
repealed to the extent only of such inconsistency. This repealer shall not be construed to revise
any bylaw, order, resoiutlon ar ordinance, or part thereof, theretofore repealed.
INTRODUCED, READ ON FIRST READING, APPROVED AND ORDERED PUBLISHED
ONCE IN FULL., this 15th day of October , 1991. A public hearing shall be held hereon
on the 5t;h clay of IVoveniber , 1991, at the regular meeting of the Town Council of the
Town of Vail, Colorado, in the Municipal Building of t-he Town.
