HomeMy WebLinkAbout1991-38 Authorizing the Sale of Certain Property Known as the Berry Creek 5th Filing Parcel to the Eagle County Recreation Authorityt ~ • •, ORDINANCE NO. 38, Series of 1991 AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN PROPERTY KN011VN AS THE BERRY CREEK 5TH PEEING PARCEL TO THE EAGLE COUNTY RECREATION AUTHORITY WHEREAS, the Tawn of Vail is the owner of certain property commonly known as the Berry Creek 5#h Filing and more particularly described irr Exhibit A attached hereto and made a part hereof; and, WHEREAS, the Town Council and other government entities within the County of Eagle have farmed the Eagle Coun#y Recreation Authority for the principle purpose of purchasing the Berry Greek 5th Filing parcel so that it can be kept in the public domain and used as open space, recreation purposes, and other purposes which will benefit the health, safety, and welfare of the citizens of the Town of Vaii and the citizens of Eagle County; and, WHEREAS, the Town Council now wishes to convey the Berry Creek 5th Filing parcel to the Eagle County Recrea#ion Authority. NOW THEREFORE BE kT ORDAINED BY THE TOWN COUNCIL Oi= THE TOWN OF VAIL, COLORADO: 1. The Tawn Council hereby approves the sale of the Berry Creek 5th Fiiit~g parcei to tine Eagle County Recreation Authority in accordance with the terms and conditions of the I~urchase and Sale Contract attached hereto as Exhibit A arrd made a part hereof. 2. The Town Manager is hereby authorized to execute said Purchase and Sais Contract. 3. If any part, section, subsection, sentence, clause ar phrase of this ordinance is for any reason held to be invalid, such decision shall not a#fect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one ar more parts, sections, subsections, sentences, clauses or phrases be declared invalid. ~4. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants tl~erQr~f. 5. The repeal ar the repeal and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution 1 .~ ,, w ~ s commenced, nor any other action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shelf not revive any provision ar any ordinance previously repealed or superseded unless expressly stated herein. 6. Afl bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extend only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, or ordinance, or part thereof, theretofore repealed.
