ORDINANCE NO. 47 Series of 1991 AN ORDINANCE AMENDING SECTION 18.52.170 -LEASING OF PARKING SPACES, OF THE VAIL MUNICIPAL CODE, AND SETTING FORTH DETAILS IN REGARD THERETO. WHEREAS, the Town of Vail currently allows private parties to lease parking spaces on prof+erty "~~cated in CCI, CC11, HDMF, PA and SD zone districts; and 4'JHEREAS, it is the belief of the Town Council that the CCI11 zone district is not unlike other corj~merclal zone districts in which such leasing is allowed; and WHEREAS, it is the belief of the Town Council that private parties should be able to lease pari-ing spaces In the CClII zone district; and WHEREAS, the Town Council wishes to extend the period of terms #ar which such parking spaces r-nay be leased #rom 10 to 12 months and allow far extensions of such lease; and WHEREAS, the Town Council wishes to permit rental car companies to lease such spaces in tl ~e Commercial Core 111 zone district; and WHEREA`,, the Planning and Environmental Commission has recommended that, in certain cases, additional landscaping may be an appropriate requirement for same lease proposals; and WHEREAS, the Planning and Environmental Commission reviewed the proposed municipal code change on November 11, 1991, and recommended approval of the amendment by a 6-0 vote. NOW, THEREFORE, HE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO THAT: Section ~ Section 1 B.52.17p(B~ -Leasing of Parking Spaces, fs hereby amended to read as follows: 18.52.17D B. A parking space, spaces or areas may be leased by the owner, occupant or building manager thereof in accordance with the following: 1. Any owner, occupant or building manager who owns, occupies or manages 10 or more private parking spaces located in Commercial Core I, Commercial Core II, Coti7mdreial Coro ,'ill, High Density Multiple-family, Public Accommodations or Special Development zone districts and provides sufficient parking for use by employees may apply to the zoning administrator of the Tawn for a permit to lease parking spaces. 1 ~ ~ ,~ ~ ~ 1 2. Application shat{ be made on a form provided by the zoning administrator and upon approval of the application by the zoning administrator a leasing permit shall be issued with or without condition as determined by the zoning administrator. The zoning administrator may request that an applicant conduct a parking utilization study to determine the difference between the average capacity of the lot and the peak day utilization, and such other information as may be necessary for the proper consideration of the application. 4. Section 3 Tt~e Tawn Council hereby finds, determines and declares that ibis ordinance is necessary and proper for the health, safiety and welfare of the Town of Vail and the inhabitants thereof. 3 ..,, ,, Section 4 The repeal or the repeal and reenactment of any provision of thv Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty- imposed, any violation that occurred prior to the effective date Hereof, any prosecution commenced, nor any other action or proceeding as commenced under by virtue of the provision repealed or repealed and reenacted. The repeal of arty provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 5 All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or part hereof, theretofore repealed.
