SERIES 1992
AN ORDINANCE AMENDING CHAPTER 18.24 OF THE MUNICIPAL CODE OF THE TOWN
OF VAIL BY THE ADDITION OF SECTION 1$.24.Q5$,
GONTROLLING UNDESIRABLE PLANTS WITHIN THE TOWN,
DECLARING SUCH PLANTS A NUISANCE,
SETTING FORTH PENALTIES FOR THE VIOLATION OF THIS ORDINANCE;
AND SETTING FORTH DETAILS iN REGARD THERETO.
WHEREAS, the Town Council wishes to institute the provisions of C.R.S. Section 35=5.5-
109 dealing with the control of undesirable plants within the State of Colorado.
NOW, THEREFORE, be it ordained by the Town Council of the Town of Vail, Colorado:
1. Chapter 18.24 of the Municipal Code of the Town of Vaii is hereby amended by
the addition of Section 18.24.458 to read as follows:
A. Undesirable Plants
Russian, Spotted and Diffuse Knapweed and Leafy Spurge are declared to be undesirable
plants to be controlled in accordance with this ordinance.
B. Declaration of Nuisance
Leafy Spurge, Russian Knapweed, Spotted Knapweed, and Diffuse Knapweed, and a!I
other plants designated "undesirable plants" by the Town are declared to be a public nuisance.
Such action may be taken as is available for nuisance abatement under the laws of this state and
the Tawn of Vail, and as Tawn Council, in their sale discretion, deem necessary.
C. Removal of Undesirable Plants Required by Prnperty Owner
Property owners within the Town of Vail shall be responsible for the elimination of
undesirable plants from their property within ninety {90) days of the effective date of this
ordinance. Such remove! shah be accomplished in an ecologically feasible and environmentally
safe manner in accordance with ail applicable laws, ordinances, rules and regulations.
D. Enforcement
The Town shall have the right to eater upon any premises, lands, or places, whe#her
public or private, during reasonable business hours or upon proper notice for the purpose of
inspecting for the existence of undesirable plants, and shall. have the right to propose, implement
or enforce the management of undesirable plants upon such sands in accordance with the
provisions of C.R.S. Section 35-5.5-109.
E. Penalty
Violation of this chapter/article shall be subject to a penalty of a fne up to nine hundred

ninety nine dollars ($999.D0), in addition to any other remedies provided herein or allowed by
ordinance, {aw, rule, or regulation.
2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for
any reason held to be invalid, such decision shall not affect the validity of the remaining portions
of this ordinance, and the Town Council hereby declares it would have passed this ordinance, and
each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any
one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid.
3. The Town Council hereby finds, determines, and declares that this ordinance is
necessary and proper far the health, safety, and welfare of the Town of Vail and the inhabitants
thereof.
4. The repeal ar the repeal and reenactment of any provision of the Municipal Code
of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any
duty imposed, any violation that occurred prior to the effective date hereof, any prosecution
commenced, nor any other action or proceedings as commenced under or by virtue of the
provision repealed or repealed and reenacted. The repeal of any provision hereby shall not
revive any provision or any ordinance previously repealed or superseded unless expressly stated
herein.
5. Ali bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent
herewith are repealed to the extent only of such inconsistency. This repealer shall not be
construed to revise any bylaw, order, resolution, or ordinance, or part thereof, theretofore
repealed.

FIRST READING this 21 st day of July, 1992, and a public hearing shall be held on this Ordinance
on the 4th day of August, 1992, at 7:30 p.m. in the Council Chambers
of the Vail Municipal Building, Vail, Colorado.
