HomeMy WebLinkAbout1992-32 Making Supplemental Appropriations from the Town of Vail General Fund, Capital Projects Fund, and others; and Authorizing the Expenditures of Said Appropriations as Set Forth Herein. ~ ~' . • ~ ORDINANCE N0.32 SERIES OF 1992 AN ORDINANCE MAKING SUPPLEMENTAL APPROPRIATIONS FROM THE TOWN OF VAIL GENERAL FUND, CAPITAL PROJECTS FUND, VAIL MARKETING FUND, THE REAL ESTATE TRANSFER TAX FUND, POLICE CONFISCATION FUND, L10NSHEAD MALL PROJECT FUND, CONSERVATION TRUST FUND, LIONSHEAD MALL DEBT SERVICE FUND, BOOTH CREEK DEBT SERVICE AND CONSTRUCTION FUND, HEAVY EQUIPMENT FUND, TOWN OF VAIL DEBT SERVICE FUND, WEST PAIL DEBT SERVICE FUND, AND POLICE BUILDING CONSTRUCTION FUND OF THE 7992 BUDGET AND THE FINANCIAL PLAN FOR THE TOWN OF VAIL, COLORADO; AND AUTHORIZING THE EXPENDITURES OF SAID APPROPRIATIONS AS SET FORTH HEREIN; ESTABLISHING A RESERVE FUND BALANCE OF $5,740,OD0; CREATING AN EMERGENCY CASH OR ASSET RESERVE IN THE VALUE OF $550,000; AND Sc E i LNG FORTH DETAILS IN REGARD THERETO. WHEREAS, contingencies have arisen during the fiscal year i 992 which could not have been reasonably foreseen or anticipated by the Town Council at the time it enacted Ordinance No. 39, Series of 1991, adopting the 1992 Budget and Financial Plan far the Town of Vail, Colorado; and, WHEREAS, the Town has received certain revenues not budgeted for previously; and, WHEREAS, the Town Manager has certified to the Town Council that sufficient funds are available to discharge the appropriations referred to herein, not otherwise reflected in the Budget, in accordance with Section 9.i0(a) of the Charter of the Town of Vail; and, WHEREAS, in order to accomplish the foregoing, the Town Council finds that it should make certain supplemental appropriations as set forth herein. WHEREAS, the Town Council wishes to establish a reserve fund balance in the amount of $5,740,000, and WHEREAS, the Town Council wishes to establish an emergency cash or asset reserve - in the value of $550,000. NOW, THEREFORE, SE IT ORDA{NED, BY THE TOWN COUNCIi_ OF THE TOWN OF VAIL, COLORADO that: 1. Pursuant to Section 9.i 0(a) of the Charter of the Town of Vail, Colorado, the Town Council hereby makes the fallowing supplemental appropriations for the 1992 Budget and Financial Plan for the Town of Vail, Colorado, and authorizes the expenditure of said appropriations as follows: FUND General Fund Capital Prpjects Fund Real Estate Transfer Tax Fund Vail Marketing Fund Police Confiscation Fund Heavy Equipment Fund Lionshead Mall Project Fund Conservation Trust Fund Lionshead Ma1.1 Debt Service Fund Booth Creek Debt Service Fund Booth Creek Construction Fund Town of Vail Debt Service Fund West Vail Debt Service Fund L'o.Iic~: Bui~.ding Construction Fund AMOUNT $ 520,821 2,278,086 822,298 45,000 27, 605 12,000 66, 468 7,800 4, 500 500 1$,aoo 20,126,030 500 100,000 24, 029, 60$ 1 ' ~. The Town Council hereby establishes a reserve fund balance of $5,740,40x. 3. The Town Council hereby establishes an emergency cash or asset reserve in the t value of $550,000. 4. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decislan shall not affect the validity of the remaining portions of this ordinance; and the Tawn Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. 5. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. 6. The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof; any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. 7. All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extend only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, or ordinance, or part #hereof, theretofore repealed. INTRODUCED, READ, APPROVED, AND ORDERED PUBLISHED ONCE 1N FULL ON FIRST READING this 1st day of December, 1992, and a public hearing shall be held on this Ordinance on the i 5th day of December, 1992, at 7:30 p.m. in the Council Cumbers of the Vaii Municipal Building, Vaii, Colorado. ~.
