OPEN SPACE ZONING TO SINGLE FAMILY RESIDENTIAL ZONING, A TRACT LOCATED WfTHIN SPRADDLE CREEK ESTATES SUBDIVISION, AN APPROXIMATELY 4Q ACRE PARCEL LOCATED NORTH AND EAST OF THE MAIN VAIL I-70 INTERCHANGE, WHEREAS, an application has been submitted to rezone Tract C within the Spraddle Creek Estates Subdivision, from the Greenbelt and Natural Open Space Zone District to the Single 1=amity Residential zone district, in order to provide for the addition of a permanently restricted employee housing unitlgatehause; and WHEREAS, the rezoning effort is consistent with Municipal objectives to provide permanently restricted employee housing within the Spraddle Creek Estates Subdivision; and WHEREAS, in accordance with Section 18.66.140, the Planning and Environmental Commission held a public hearing on the proposed zoning amendment and has submitted its recommendation to the Town Council; and WHEREAS, all notices as required by Section 18.66.080 have been sent to the appropriate parties; and WHEREAS, the Town Council has held a public hearing as required by Chapter 18.fi6 of the Municipal Code of the Town of Vail. NOW, THEREI=ORE, RE IT ORDAINED BY THE TOWN COUNCIL 01= THE TOWN OF VAIL, COLORADO THAT: Section 1 The Town Council finds that the procedures for a zoning amendment as set forth in Section 18.66 of the Municipal Code of the Town of Vail have been fully satisfied, and all of the requirements of the Municipal Code of the Town of Vaii relating to zoning amendments have been fully satisfied. Section 2 The Town Council hereby rezones Tract A, of the Spraddle Creek Estates Subdivision, from the Greenbelt and Natural Open Space Zane District to the Single Family Residential zone district. section 3 If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any 1 one or more parts, sec#ions, subsections, sentences, clauses or phrases be declared invalid. Section 4 The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. Section 5 The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 6 All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, or ordinance, or part thereof, theretofore repeated.
