HomeMy WebLinkAbout1993-31 To Amend Section 18.57.060 B 13 of the Vail Municipal Coder ~ ` ~~ i • • ORDINANCE NO. 31 SERIES OF 1993 AN ORDINANCE TO AMEND SECTION 18.57.Q60 B 13 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL. WHEREAS, Ordinance No. 27, Series of 1992, amended Section 18.57.020 -Employee Housing Units {EHUs) generally of the Municipal Cade of the Town of Vail; and WHEREAS, there was a typographical error contained in Section 6 thereof improperly referring to "Type !EHU". NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO THAT: Section 1 Section 18.57.060 B 13 is hereby amended to read as follows: {13) Thirty days prior to the transfer of a deed for a Type III EHU, the prospective purchaser shall submit an application to the Community Development Department documenting that the prospective purchaser meets the criteria set forth in Sections 18.57.020 C and 18.57.064 B 11 {a) and shall include an affidavit affirming that he or she meets these criteria. Section 2 If any part, section, subsection, sentence, clause or phrase of this ordinance is fnr any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 3 The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. Section ~ The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. 1 Ordlnanoe No. 31, 8erlea o1 iBB3 Section 5 All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed #o revise any bylaw, order, resolution, or ordinance, or part thereof, theretofore repealed.
