HomeMy WebLinkAbout1994- 1 Establishing the Value per Acre of Land to be Used in the Formula to Calculate the Cash to be Paid in Lieu of Land School Dedication Pursuant to Section 17.17.020 of the Vail Municipal Code~ • ORDINANCE NO. 1 SERIES OF 9594 AN ORDINANCE ESTABLISHING THE VALUE PER ACRE OF LAND TO BE USED IN THE FORMULA TO CALCULATE THE CASH TO BE PAID 1N LIEU OF LAND SCHOOL DEDICATION PURSUANT TO SECTION 77.97.020 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL. WHEREAS, Section 17.17.020 requires the value per acre of land shall be set annually by the Town Council on an acre basis with recommendations from the School District; and WHEREAS, the Town Council, with recommendations from the School District, has established values to be used for fees in lieu of land dedication. NOW, THEREFORE, BE 1T ORDAINED BY THE TOWN COUNCIL OF 7NE TOWN OF VAIL, COLORADO THAT: Section 1 The value per acre to be used to calculate the cash to be paid in lieu of land school dedication pursuant to 17.17.020 shall be fifty thousand dollars ($50,000.00) per acre. Sectian 2 If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Tawn Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or.phrases be declared invalid. Sectian 3 The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vall and the Inhabitants thereof. Section 4 The repeal or the repeal and reenactment of any provision of the Municipal Cade of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the Qrf)v151C1n 1'F3f1Ar"1IPr`1 !1C rpnPa~arf ~„~ rnc~nMn+...~.
