AN ORDINANCE CREATING A UTILITY EASEMENT
FOR THE COVERED BRIDGE BUILDING
WHEREAS, it is necessary to create an easement for the construction, maintenance, and
reconstruction of transmission or distribution or systems to provide services by utility to the
Covered Bridge Building; and
WHEREAS, it is necessary to locate the nonexclusive easement across property owned
by the Town of Vail; and
WHEREAS, the easement is more fully described on Exhibit "A" attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE iT ORDAINED BY THE TOWN COUNCIL, THE TOWN OF VAIL,
COLDRADO that:
1 } A utility easement, more fully described on Exhibit "A" attached hereto and
incorporated herein by reference, is created which allows the easement user the use thereof for
the construction, maintenance, and reconstruction of transmission or distribution or systems to
provide services by utility.
2} If any part, section, subsection, sentence, clause or phrase of this ordinance is for
any reason held to be invalid, such decision shall not affect the validity of the remaining portions
of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and
each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any
one ar more parts, sections, subsections, sentences, clauses or phrases be declared invalid.
3) The Town Counci! hereby finds, determines, and declares that this ordinance is
necessary and proper for the health, safety, and welfare of the Town of Vaii and the inhabitants
thereof.
4) The repeal or the repeal and reenactment of any provision of the Municipal Cade
of the Town of Vaii as provided in this ordinance shall not affect any right which has accrued, any
duty imposed, any violation that occurred prior to the effective date hereof, any prosecution

provision repealed or repealed and reenacted. The repeal of any provision hereby shall not
revive any provision or any ordinance previously repealed or superseded unless expressly stated
herein.

T 5) All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent
herewith are repealed to the extent only of such inconsistency. This repealer shall not be
construed to revise any bylaw, order, resolution, ar ordinance, ar part thereof, theretofore
repealed.
INTRODUCED, READ, APPROVED, AND ORDERED PUBLISHED ONCE IN FULL ON
FIRST READING this 16th day of August, 1994, and a public hearing shall be held on this
Ordinance on the 5th day of September, 1994, at 7:30 p.m. in the Council Chambers of the Vail
Municipal Building, Vail, Colorado.

TOWN OF VAIL
Two 20-foot wide strips of land, being l0 feet on each side of
the following described centerlines, located in Lot b, Block 5-B,
Tract B, and Bridge Street, Vail Village First Filing Subdivision
as filed under Reception No, 963$2 in the Plat Hook of Eagle
County at Fage 49 {for Sheet No. 1) and Page 50 {for Sheet No.
2}, the centerlines being more particularly described as Follows:
Parcel No. 1
Beginning at the southeast corner of said Lat b, Block 5-B,
thence N 63°19'00" W a distance of 25.64 feet along the south
line of said Lat b to the True Point of Beginning; thence along
said centerline, N 44°05'44" E a distance of 36.79 feet to a
paint; thence S 64°44'36" E a distance of 91.51 feet to a point;
thence S 14°34'02" E, 19.02 Feet to a point; thence S 3°38'34" W
a distance of 0.84 feet to the True Point of Beginning for Parcel
Nn. 2, hereinafter described; thence continuing S 3°38'34" W a
distance of 35.68 feet to a point; thence S l3°15'00" E a
distance of 20.$1 feet to the Point of Termination.
