HomeMy WebLinkAbout1995- 2 Amending Section 18.69.050 of the Vail Municipal Code Regarding the Maximum Allowable Height for Garages in the Front Setback on Lots Exceeding a Thirty Percent Average Slope~ ~ ~ ORDINANCE NO. 2 SERIES OF 1995 AN ORDINANCE AMENDING SECTION 18.69.05Q OF THE TOWN OF VAlL MUNICIPAL CODE REGARDING THE MAXfMUM ALLOWABLE HEIGHT FOR GARAGES IN THE FRONT SETBACK ON LOTS EXCEEDING A THIRTY PERCENT AVERAGE SLOPE WHEREAS, Section 18.69.050 of the Town of Vail Municipal Code allows garages to be located in the front setback when the average slope of the site, beneath the proposed structure and parking area exceeds thirty percent; and WHEREAS, it is necessary to reduce the impact of these structures in the front setback by limiting their freight to a single story with a pi#ched or flat roof with the design of the garage subject fin review and approval by the Design Review Board. NOW, THEREFORE, the Town Council ORDAINS AS FOLLOWS: 1) Section i 8.69.050. K. shall be amended as follows: K. Setbacks, as they apply to this chapter, as required by Sections 18.09.060, 18.10.060, 18.12.064, and 18.13.060, are amended as fafiows: There shall be no required front setback for garages, except as may be required by the Design Review Board. Garages located In the front setback, as provided for in this Section 18.69.050, shall be limited to one story to height (not to exceed ten feet) wlth the addition of a pitched or flat roof and subject to re~lew and approval by the Design Re~lew Board. 2} ff any part, section, subset#ian, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Tawn Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one pr more parts, sections, subsections, sentences, clauses or phrases be declared invalid. 3) The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper far the health, safety, and welfare of the Town of Vail and the inhabitants thereof. 4} The repeal or the repeal and reenactment of any provision of the Municipal Code of the Tawn of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the affective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the 1 Ordinance No. 2, Senas aF 1995 ,~. provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. 5) All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, ar ordinance, or part thereof, theretofore repealed.
