1995- 9 Rezoning a Parcel of Property Legally Described as Tract C, Vail Village First Filing from General Use District to Primary/Secondary Residential District
ORDINANCE N0.9 Series of 1995 AN ORDINANCE REZONING A PARCEL OF PROPERTY LEGALLY DESCRIBED AS TRACT C, VAIL VILLAGE FIRST FILING FROM GENERAL USE DISTRICT TO PRIMARYISECONDARY RESIDENTIAL DISTRICT; AND AMENDING THE OFFICIAL ZONING MAP IN RELATION TO THE REZONING OF SAID PROPERTY. WHEREAS, the property to be rezoned is located within the municipal limits of the Town of Vail; and WHEREAS, the Planning and Environmental Commission has considered the appropriate rezoning for the property and has unanimously recommended that the Town Council rezone the parcel from General Use District to PrimarylSecondary Residential District; and WHEREAS, the Town Council considers it in the public interest to rezone said property. NOW, THEREFORE, BE !T ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, AS FOLLOWS: Section 1. The Town Counci! finds that the procedures for the provision of rezoning property in the Town of Vaii have ben fulfilled, and the Town Council hereby received the report of recommendation from the Pianning and Environmental Commission recommending the rezoning of said property. Section 2. Pursuant to Section 18.68.100 - 18.66.180 ofi the Vail Municipal Code, the parcel of property legally described as Tract C, Vail Village First Filing is zoned as General Use District. Section 3. As provided in the ordinances of the Town of Vail, the zoning administrator is hereby directed to modify and amend the official zoning map to include the zoning specified in Section 2 above. Section 4. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining partians of this ordinance;; and the Town Council hereby declares it would have passed this ordinance, and each Dart, section. subspctifln. sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. s . • Section 5. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vaii and the inhabitants thereof. Section 6. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereofi, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeai of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 7. All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or part thereof, theretofore repealed.
