AN ORDINANCE REPEALING AND RE-ENACTING CHAPTER 18.39, SKI
BASElRECREATION DISTRICT OF THE VAIL MUNICIPAL CODE.
WHEREAS, Chapter 18.39 of the Vail Municipal Cade describes the Ski BaselRecreation
Zone District; and
WHEREAS, Vail Associates, Inc. has submitted an application to amend Chapter 18.39
of the Vail Municipal Code; and
WHEREAS, the Planning and Environmental Commission of the Town of Vail has
recommended approval of the amendment to Chapter 18.39 of the Vail Municipal Code; and
WHEREAS, the Town Council considers it in the interest of the public health, safety, and
welfare to amend said Chapter of the Municipal Code.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
VAIL, COLORADO, THAT:
Section 1.
Chapter 18.39 of the Vail Municipa! Code is hereby repealed and re-enacted to read as follows:
18.39.010 Purpose.
The Golden Peak Ski BaselRecreation District is intended to provide for the base
facilities necessary to operate the ski mountain and to al{ow multi-family residential dwellings as
a secondary use if certain criteria are met. In addition, summer recreational uses and facilities
are encouraged to achieve multi-seasonal use of some of the facilities and provide for efficient
use of the facilities.
18.39.430 Permitted uses.
A. The following uses shall be permitted within the main base lodge building in the Golden
Peak Ski BaselRecreation District:
1. Ski lockerslemployee locker rooms.
2. Ski school and ski patrol facilities.
3. Lift ticket sales.
4. Tennis pro shop.
5. Ski repair, rental, sales and accessories.
6. Restaurant/barlsnack bar/candy sales.

Meeting roams for owner use and community-oriented organizations.
Injury prevention and rehabilitation facilities for owners' use.

11. Special community events.
B. Retail and meeting room space limitation.
1. Retail sakes space in the first two fbors shall be limited to a maximum of fifteen
percent of the non-residential gross square footage of the main base lodge
building. Under Section 18.39.034, retail shall be defined as tennis pro shop,
candy sales, ski repair/rental sales, accessories and clothing, basket rental, ski
lockers and storage for the public.
2. Meeting roams shall be limited to a maximum of ten percent of the non-residential
gross square footage of the main building.
C. Multi-family dwelling units within the main base lodge building if the fallowing
requirements are met:
1. The dwelling units shall be a secondary use within the main base lodge building if
they meet the following criteria:
a. No residential use on ground level.
b. Visual impacts such as surface parking for the dwelling units shall be
minimized by providing at least forty percent of the required parking within
the main base lodge building or in an attached parking structure.
c. The maximum gross residential floor area (GRFA} devoted to dwelling
units shall not exceed thirty percent of the total gross square footage of
the main base lodge building.
2. Before acting on multi-family dwelling units, the Planning and Environmental
Commission shall consider the following factors in regard thereto:
a. Relationship and impacts of the use on development objectives of the
town.
b. Effect of the use on light and air, distribution of population, transportation
facilities, utilities, schools, parks, and recreational facilities, and other
public facilities and public facilities needs.
c. Effect upon traffic, with particular reference to congestion, automotive and
pedestrian safety and convenience, traffic flow and control, access,

maneuverability, and removal of snow from the streets and parking area.
d. Effect upon the character of the area in which the proposed use is to be
located, including the scale and bulk of the proposed use in relation to
surrounding uses.
3. The Planning and Environmental Commission shall make the findings set forth in
Section 18.60.060 B before permitting multi-family units within the main base
lodge building,
D. Permitted uses within the Children's Ski School building:
1. Year-round child care and children's ski school and appurtenant recreational
facilities and programs.
2. Children's ski school services and programs.
3. Community events and programs.
4. Summer recreational, cultural and educational programs.
E. The following uses shall be permitted outside the main base lodge and Children's Ski
School buildings as shown on the approved development plan:
1. Ski trails, slopes and lifts;
2. Snowmaking facilities;
3. Bus and skier dropoff;
4. Surface parking lot;
5. Ski racing facilities;
6. Public parrs, tennis and volleyball courts, and playing fields, playgrounds;
7. Water-treatment and storage facilities buildings;
8. Mountain storage buildings;
9. Ski school activities;
10. Special community events;
11. Food and beverage service;
12. Indoor and outdoor ski storage.
18.39.D50 Conditional uses.
A. The following conditional uses shall be permitted in the Golden Peak Ski
BaselRecreation District, subject to the issuance of a conditional use permit in
accordance with the provisions of Chapter 18.60:
1. Recreation room/minor arcade.
2. Addition or expansion of storage buildings far mountain equipment.

4. Redevelopment of water storage extraction and treatment facilities.
5. Redevelopment of ski racing facilities.
6. Redevelopment of public parks, playgrounds.
7. Summer seasoriai community offices and programs.
8. Additions or expansions of public or private parking structures or spaces.
9. Seasonal structures to accommodate athletic, cultural, or educational activities.
10. Redevelopment of ski lifts and tows.
11. Food and beverage cart vending.
12. Bed and breakfast as further regulated by Section 18.58.510.
15. Type III EHU as defined in Section 18.57.060.
14. Type IV EHU as defined in Section 18.57.070.
15. Public, private or quasi-public clubs.
18.39.070 Accessory Uses
The following accessory uses shall be permitted in the Golden Peak Ski Base/Recreation
District:
A. Accessory uses customarily incidental to permitted and conditional uses and
necessary for the operation thereof.
B. Home occupations, subject to the issuance of a home occupation permit in
accordance with the provisions of Sections 18.58.130 through 18.58,190.
18.59.080 Location of business activity.
A. All offices and retail sales conducted in the Golden Peak Ski Base/Recreation
District shall be operated and conducted entirely within a building except for
approved special events and food and beverage vending.
18.39.490 Development plan required.
A. To ensure the unified development, the protection of the natural environment, the
compatibility with the surrounding area and to assure that development rn the
Golden Peak Ski Base/Recreation District will meet the intent of the district, a
development plan shall be required.
B. The proposed development plan shall be in accordance with Section 18.39.110
and shall be submitted by the developer to the zoning administrator, who shall
refer it to the Planning and Environmental Commission, which shall consider the
plan at a regularly scheduled meeting. A report of the Planning and
Envir:,~mentai Commission stating its findings and recommendations shall be
transmitted to the town council for approval in accordance with the applicable
provisions of Section 18.66.060 of the Municipal Code.
C. The approved development plan shall be used as the principal guide for all
development within the Golden Peak Ski Base/Recreation District.
D. Amendments to the approved development plan will be considered iri accordance
wi#h the provisions of Section 18.40.100.
~. The development plan and any subsequent amendments thereto shall require the
approval of the design review board in accordance with the applicable provisions
of Chapter 18.54 of the Municipal Code prior to the commencement of site
preparation.
18.39.110 Development Plan -Contents
The fallowing information and materials shall be submitted with an application for a
proposed development plan. Certain submittal requirements may be waived or modified
by the Director of the Department of Community Development if it is demonstrated that
the material to be waived or modified is not applicable to the review criteria, or that other
practical solutions have been reached.
A. Application form and filing fee.
B. A written statement describing the project including information on the nature of
the development proposed, proposed uses, and phasing plans.
C. A survey stamped by a licensed surveyor indicating existing conditions of the
property to be included in the development plan, including the location of
improvements, existing contours, natural features, existing vegetation, water
courses, and perimeter property lines of the parcel.
D. A title report, including schedules A and B.
E. Plans depicting existing conditions of the parcel (site plan, floor plans, elevations,
etc.), if applicable.
F. A complete zoning analysis of the existing and proposed development including a
square footage analysis of all proposed uses, parking spaces, etc.
G. A sits Nlan at a scale not smaller than ~" = 20', showing the location and
dimensions of all existing and proposed buildings and structures, all principal site
development features, vehicular and pedestrian circulation systems and
proposed contours and drainage plans.
H. Building elevations, sections and floor plans at a scale not smaller than
118" = 1', in sufficient detail to determine floor area, circulation, location of uses
and scale and appearance of the proposed development.
I. A vicinity plan showing existing and proposed improvements in relation to all
adjacent properties at a scale not smaller than 1" - 50'.
J. Photo overlays and/or other acceptable visual techniques for demonstrating the
visual impact of the proposed development on public and private property in the
vicinity of the proposed development plan.
K. An architectural ar massing model a# a scale sufficient to depict the proposed
development in relationship to existing development on the site and on adjacent
parcels.
1_. A landscape plan at a scale not smaller than 1" = 20', showing existing landscapo
features to be retained and removed, proposed landscaping and other site
development features such as recreation facilities, paths and trails, plazas,
walkways and water features.
M. An Environmental Impact Report in accordance with Chapter 18.56, unless
waived by Section 18.56.030.
N. Any additional information or material as deemed necessary by the Director of the
Community Development Department.
With the exception of the model, four complete copies of the above informa#ion shall be
submitted at the time of the application. When a model is required, it shall be submitted
a minimum of two weeks prior to the first formal review of the Planning and
Environmental Commission. At the discretion of the Director of Community
Development, reduced copies in 8.5" x 11"format a# all of the above information and
additional copies for distribution to the Planning and Environmental Commission and
Town Cauncil may be required.

18.39, ~ 20 DevE,~pment StandardslCriteria for evaluation.
The following criteria shall be used as the principal means for evaluating a proposed
development plan. It shall be the burden of the applicant to demonstrate that the
proposed development plan complies with all applicable design criteria.
Building design with respect to architecture, character, scale, massing and
orientation is compatible with the site, adjacent properties and the surrounding
neighborhood.
2. Buildings, improvements, uses and activities are designed and located to
produce a functional development plan responsive to the site, the surrounding
neighborhood and uses, and the community as a whole.
3. Open space and landscaping are both functional and aesthetic, are designed to
preserve and enhance the natural features of the site, maximize opportunities for
access and use by the public, provide adequate buffering between the proposed
uses and surrounding properties, and when possible, are integrated with existing
open space and recreation areas.
4. A pedestrian and vehicular circulation system designed to provide safe, efficient
and aesthetically pleasing circulation to the site and throughout the development.
5. Environmental impacts resulting from the proposal have been identified in the
project's Environmental Impact Report, i# not waived, and all necessary mitigating
measures are implemented as a part of the proposed development plan.
6. Compliance with The Vail Comprehensive Plan and other.applicable plans.
18.39.130 L.at area,
The minimum lot or site area shall be forty acres of site area, at least one acre of which
shall be buildable area.
18,39.150 Setbacks.
In the Golden Peak Ski BaselRecreation District, front, side, rear and stream setbacks
shall be as indicated on the approved development plan.
18.39.170 Height.
Up to sixty percent of the building (building coverage area} may be built to a height of
thirty-five feet, or less. No more than forty percent of the building (building coverage
area) may be higher than thirty-five feet, but not higher than forty feet. Towers, spires,
cupolas, chimneys, flagpoles, and similar architectural features not useable as gross

residential flc~~ area may extend above the height Nmit a distance of not more than
twenty-five percent of the height limit nor more than fifteen feet.
18.39.180 Density Control.
Total density shall not exceed one dwelling unit per eight acres of site area.
18.39.190 Site coverage.
Site coverage shall be as shown on the approved development plan,
18.39.210 Landscaping and site development.
Landscaping requirements shalt be as shown on the approved development plan. Ail
areas within the area{s) of disturbance in the landscape plan not occupied by building,
ground level decks or patios, or parking shall be landscaped.
18.39.230 Parking Plan and Program
Parking Pian and Management Program shall be as shown on and described in the
approved development plan.
Section 2.
!f any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason
held to be invalid, such decision shall not efifect the validity of the remaining portions of this
ordinance;, and the Town Council hereby declares it would. have passed this ordinance, and'
each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that
any one or more parts, sections, subsections, sentences, clauses or phrases be declared
invalid.
Section 3.
The Town Council hereby finds, determines and declares that this ordinance is necessary and
proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
Section 4.
The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as
provided in this ordinance shall not affect any right which has accrued, any duty imposed, any
violation that occurred prior to the effective date hereof, any prosecution commenced, nor any
other action or proceeding as commenced under or by virtue of the provision repealed or
repealed and reenacted. The repeal of any provision hereby shall not revive any provision or
any ordinance previously repealed or superseded unless expressly stated herein.
Section 5.
All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are
repealed to the extent only of such inconsistency. This repealer shall not be construed to revise
any bylaw, order, resolution ar ordinance, or part thereof, theretofore repealed.
INTRODUCED, READ ON FIRST READING, APPROVED, AND ORDERED PUBLISHED
ONCE 1N FULL, this 5th day of December, 1995. A public hearing on this ordinance shall be
held at the regular meeting of the Town Council of the Town of Vail, Colorado, on the 19th day of
December, 1995, in the Municipal Building of the Town.

THE TOWN COUNCIL OF THE TOWN OF
VAIL, COLORADO, THAT:
SECTION 1,
The Town Council finds that all fha prOtadures
set forth for Spacial Development Districts in
Chapter 18,40 of the Municipal Code of the Town
of Vail have tleen fully satisfied,
SECTION 2.
Special Developmem District No. 31 was
established to ensure comprehensive development
and use oS an area in a manner that will Ire
harmonious with the general character of ma Town,
provide adequate open space, employee housing,
slraefscapa Improvements and other amenities,
and promote the oblectives of the Town's Zoning
ordinance. Tha development is regarded as
complementary to the Town by the Town CouncN
and the Planning and Environmental Commission,
and there ere significant aspects of the special
development whbh cannot be satisfied through the
imposition of standard zoning dislrNts on the area.
SECTION 3.
Spacial Developmen! Dlstrici No. 31 was
established for Iha devaklpmanl on a parcel of land
compdsing 6,375 square feet in the Vail Vi€lage area
of Iha Town; Special Development District No. 31
and said 8,375 square feat may be referred [o as
"SDD Nn. 31'
SECTION 4.
The Town Council finds that [he amendment
to the approved development plan for SDD. No. 31
meets each of the standards set forth in Section
18.40.OBD of file Municipal Code of the Town Of
Vail ar damonstratss that either one or mare of
them is not applicable, Or that a practical solution
Consistent with the public interest has bean
achieved. In accordance vrilh Section 18.40.040,
Iha amendment to the development plan far SDD
No. 31 Is approved. The amended development

A. Lot Area -The lot area shall consist Of
approximately 8,375 square feat.
B. Setbacks -The required setbacks stroll be

C. Height -Tha maximum height of Ehe
Golden Peak House Building shall be es indicated
on fha Approved Deveklpmen[ Plans. '
D. Density Control -The maximum GRFA for
fha Golden Peak House shall not exceed 16,715
square feet. Th€s figure Includes 2,781 square

Building Permit for the eonslruMion of SDCf No. 31,
GPH Partners, Lld. shall cause to be permanently
restricted, two off-site, two-bedroom, employee
housing units perlha Town of Vall Housing
Ordinance. FBCh unit shall ba a minimum size of
700 square feel. The units shall meet die Tawn of
Vail Housing Ordinance requirements and such
units shall be within the Tawn of Vail.
2. That prior to the Town's issuance Of a
Building Permit for the redevelopment project, the
Gokfen Peak House Condominium Assocation will
contribute $32,OD0.00 towards the redesign and
redevelopment at Seibert Circle. The $32,D00
contrybutbn towards the redevelopment of 6elbert
Circle shah ba „ow;,o3lowards the Golden Peak
House, should a future Speclat Improvement
District be created far this project.
3. That prior to the Town's issuance of a
building permk for the redevatopmeni project, Vait
Associates, inc., will dedicate open spats Eo the
Town. The minimum area of open space shall be at
least an equivalent area, to that of the area of the
Tract E'ovemang end deck' raasemems. A portion
of Iha Mill Creak stream tract will be dedicated to
the Town of Veit as permanent open space end the
Pirate Shlp Park area of 7rect ~ will 6e leased to
the Tgwn of Vail for the purpose of maintaining the
park. The terms of the lease era to be agreed upon
by the parties.
4. That th0 Gokfen Pack House Condaninium
Association and Vell Associates, inc. shall reserve
a public pedestrian access, across Lot C, which is
located between iho Golden Peak House and the
Hill Building, by declaration t0 ba retooled w$it Iha
Eagle County Recorder. Such declaration shalt be
permanent and poly revocable upon written
agreement with Iha Town of Vail, The declaration
of public pedestrian access shalt occur prior to the
Town's issuance of a Building Permit for the
project.
5. Thal prior to tfie Town's issuance of a
Temporary Certificate of Occupancy for the
redevelopment pro)ect, GPH Partners, Ltd. shall
dead restrict two thr9a•bgtlrObm dwelling units
(Units 201 end 401) to be included in a short-term
rental program, at comparable market rates, at all
times when said dwelling units era not Orx:upiad by
the owneror his guests.
6. That prior to the Town's issuance of a

redevelopment project, GPM Partners, Ltd. shall

against, any improvement district(s) which may be
established by the Town of Vail for the purposes of
constructing improvements as set forth in the
Town of Vail Streetscape Master Plan andlor the
Vail Transportation Master Plan, it and when an
improvement district(s) is fonnad.
9. That the Golden Peak House Condominium
Association end GPH Partners, Ltd. shall
cooperate with, and shall not protest or
remonstrate against. any efforts by the Town of
Vail to estabgsh additional view cgrridors or
amendments to exislirrg view __..::..> as anharrced
by the project. Such changes end sdddions shell be
pursuant to the Municipal Coda of the Town of Vall.
10. That Iha pedestrian arcade (which was
griginalry propOSed over the first ilocr retail wkldaws
an die north elevation), and that Iha original ground
floor plan, which does not include the curved reteu
windows along the eastern portion of the building,
ba reviewed by Iha Design Review Board and
Included in fha final building design, u required by
the Design Review Board.
11. That GPH Partners, Ltd. further artfCUlate

lights to Iha large single panes of glass.
12. That the Design Review Board review fha
propOSed roof form aver the main entry an the

13. That the proposed tar and gravel roof for

Amendments to Iha approved development

BUI]GET YEAR.
WHEREAS, the A11MUm Town Council of the
Town at Mintum, Cvbrado has etlopled the annum
budget b accordance with Rho Lpcel Govemment
Budget Law, pn November 15, 1995, and;
WHEREAS. the amount Of money ..z.;,,a„ary
to balance the budget far general operating
purposes is ~ 129,918, and;
WHEREAS, the 1996 valuation for
assessment !or Me Tptrm at Mintum, Cobredo as
certilied by the County Assessor is § 7,600,820,
and;
WHEREAS, Amendment 1 of the Colorado
Constitution, the TABOR amendment, ~rovkles for
cebulatfons of property tax revenue and mill levy
limitations based pn local growth and iMlation and
provides for a refund of property tax assessed and
tolEevted in excess of such limitations. The Town
Council hereby ritooses to grant a Temporary MIH
Levy Credit to the same effect ae a refund thus
avoltling the edministrafive expense o! actual
refunds attar colleclbn of property tax in excess vF
said limitaticns.
NOW, THEREFORE, THE TOWN OF
MINTURN, COLORADO ORDAINS:
SECTION 1. For the purpose of defraying
parr ai Me operating end capital expanses of Me
Town of Mintum, Colorado, during its 4998 fiscal
year, the Town Council hereby levies a Property
Tax of 17.934 mills end a Temporary Mill Levy
Grpdit of 1.2795 mills upon each dollar of the total
assessed valuation of $7,800,820 foi Me 1995 tax
year of alt taxable property within Me Toren, wlticfl
will result in net tax levy of $129,91 Sr tabulated as
follows:

FOR THE TOWN OF MIN'CURN, COLORADO,
FOR THE 1996 BUDGET YEAR.
WHEREAS, the Mintum Town Council has
adopted the annuli budget in accordance with the
Lacaf Government Budget Law, an November
15,1995, and;
WHEREAS, iha Mintum Tpwn Council has
made provision therein for revenues in an amount
equal to or greater than the total proposed
expenditures as sat forth it said budget and;
WHEREAS, it is not only required bylaw, but
also necessary to appropriate the revenues
provided in the budget to end ipr the purposes
described bebw, sa as not to impair the pperetions
