" , ORDIl'~; CE N0.20 SERIES OF 1996 AN ORDINANCE REZONING THREE TRACTS FROM GENERAL USE SECTION 1.8,36 TO MEDIUM DENSITY MULTI-FAMILY RESIDENTIAL, SECTION 18.18 GENERALLY LOCATED AT 945 RED SANDSTONE ROAD MORE SPECIFICALLY DESCRIBED IN EXHIBITS "A" AND "B" OF THIS ORDINANCE. WI-IERLAS, an application has been submitted to rezone the three parcels from General tJse to Medium. Density Multi-Family Residential; and WHEREAS, while the current zoning, General Use, allows employee housing as a conditional use, the proposed medium density multi-family residential zone district provides an oppartunity for more effective developmrent of the land for local's housing; and WI~IERIAS, the rezoning effort is consistent with the surrounding and immediate adjacent properties; and WHEREAS, in accordance with Section 18.66.140, the Planning and Environmental Con~missian had a public hearing on the proposed zoning amendment and has submitted its recomiriendation to the Town Council; and WIIEREAS, concurrent with the request for rezoning, the applicant has made a request for a Special Development District to control the future development of the site; and Wl-IEREAS, all natices required by Section 18.66.080 have been sent to the appropriate parties; WHEREAS, the Town Council has held a public hearing as required by Chapter 18.66 of tl~e Municipal Code of the Town; of Vail; WI-IERF,AS, the United States Forest Service, as the present owner of the property described on Exhibit B, has consented to including its praperty in this rezoning process conditioned upon heal approval becoming effective when the ownership of the land is transferred to the "l,own of• Vail pursuant to the Land Ownership Adjustznent Agreement; and NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN {)F VAIN, COLORADO THAT: Section 1. The Tawn Council finds that the procedures for the provision of rezoning property in the Town of Vail have been fulfilled, and the Town Council hereby received the report of recon~mendation from the Planning and Environmental Commission recommending the rezoning of said property. Section 2. The Town Council finds this proposed zoning action is in compliance with the Town of Vail Land Use Plan which is the master plan for guiding development within the Town of Vail Section 3. The Tawn Council further finds since the Water District no longer uses the property which is the subject of the zoning proposal for water treatment and storage, this change in the canditinn of the neighborhood further supports the zoning change. Ordinance No. 20 Series of i 49b ~f r ` ~ ~ • Section 4. if ally pal't, section, subsectian, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses ar phrases be declared invalid. Section 5. The Town Council hereby finds, determines, and declares that this ardinance is necessary azad proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. Sectian 6. `l'he repeal or the repeal and reenactment of any provision of the Municipal Code of the "Yawn of Vail as pz•ovided in this ordinance slaaIl not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under ar by virtue of the provision repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 7. All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency.
