HomeMy WebLinkAbout1996-23 Annual Appropriation Ordinance: Adopting a Budget and Financial Plan and Making Appropriations to Pay the Costs, Expenses, and Liabilities of the Town of Vail for 1997.~ ri ! ~ ORDINANCE NO. 23 SERIES OF 199fi ANNUAL APPROPRIATION ORDINANCE: ADOPTING A BUDGET AND FINANCIAL PLAN AND MAKING APPROPRIATIONS TO PAY THE GOSTS, EXPENSES, AND LIABILITIES OF THE TOWN OF VAiL, COLORADO, FOR 1TS FISCAL YEAR JANUARY 1, 1997, THROUGH DECEMBER 31, 1997, AND PROVIDING FOR THE LEVY ASSESSMENT AND GOLLECTION Of= TOWN AD VALOREM PROPERTY TAXES DUE FOR THE 1996 TAX YEAR AND PAYABLE fN THE 1997 FISCAL YEAR; AND, FURTHER, CONSIDERING A BUDGET AND FINANCIAL PLAN FOR ITS FISCAL YEAR JANUARY 1, 1998 THROUGH DECEMBER 31, 199$ WITHOUT FORMAL ADOPTION. WHEREAS, in accordance with Article iX of the Charter of the Tdwn of Vail, Colorado, the Town Manager prepared and submitted to the Town Council a proposed long-range capital program for the Town and a proposed budget and financial plan for all Town funds and activities far the 1997 and 1998 fiscal years; and WHEREAS, notice of public hearing on the proposed Town budget and capita! program was published an the 8th day of November, 1998, mare than seven (7} days prior to the hearing held on the 19th day of November, 1996, pursuant to Section 9.5 of the Charter; and WHEREAS, it is necessary far the Town Council to adopt a budge# and financial plan for the 1997 fiscal year, to make appropriations for the amounts specified in the budget, and to provide for the levy, assessment and collection of Tawn ad valorem property taxes due for the 1996 year and payable in the 1997 fiscal year; and WHEREAS, it is believed appropriate and fiscally sound for the Town Manager to present the budget and financial plan for 1998 to be considered by the Town Council to provide a complete financial plan on a biennial basis. NOW, THEREFORE, be it ordained by the Tawn Council of the Town of Vail, Colorado, that: 1. The procedures prescribed in Article IX of the Gharter of the Tawn of Vail, Colorado, for the enactment hereof have been fulfilled. 2. Pursuant to Article IX of the Charter, the Town Council hereby makes the following annual appropriations far the Tawn of Vail, Colorado, for its fiscal year beginning on the firs# day of January, 1997, and ending an the 31st day of December, 1997; FUND General Fund Capital Projects Fund Rea! The Town Council hereby adopts the full and complete Budget and Fnancial Plan for the 1997 fiscal year for the Town of Vaif, Colorado, which are incorporated by reference herein and made part hereof, and copies of said public records shall be made available to the public in the Municipal Building of the Town. 4. for the purpose of defraying part of the operating and capital expenses of the Town ofi Vaif, Colorado, during its 1997 fiscal year, the Town Council hereby levies a property tax of 4.71 mills upon each dollar of the total assessed valuation of $394,681,500 for the 1996 tax year of all taxable property within the Town, which will result in a gross tax levy of $1,858,949, calculated as follows: Ease mill levy 4.69 $1,851,066 Abatement mill levy .02 7.893 Total mill levy 4.71 $1.858.949 Said assessment shall be duly made by the County of Eagle, State of Colorado, as directed by the Colorado Revised Statutes (1973 as amended), and as otherwise required by law. 5. The Town Council has considered the budget and financial plan for the fiscal year January 1, 1998 through December 31, 1998 as presented by the Town Manager, takes no formal action in regard to it at this time and further directs the Town Manager in accordance with Article IX of the Charter of the Town of Vail to present the proposed 1998 budget and financial plan for adoption no later than thirty (30) days prior to the close of the 1997 fiscal year. 6. This Ordinance shall take effect five {5) days after publication following the final passage hereof. 7, If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. 8. The Town Council hereby finds, determines, and declares tha# this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. 9. The repeal or the repeat and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any o#her action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. 1 D. All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency.
