HomeMy WebLinkAbout1997- 7 Amending Section 15.02.030(C) of the Vail Municipal Code to Provide for the Adoption of an Annual Elevator Inspection FeeORDINANCE NO. 7 Series of 1997 AN ORDINANCE AMENDING SECTION 'IS-02-03p(C] OF THE MUNICIPAL CODE OF THE TOWN OF VAIL TO PROVIDE FOR THE ADOPTION OF AN ANNUAL ELEVATOR INSPECTION FEE. WHEREAS, the Vail Tawn Council believes it would be a benefit to the health, safety, and welfare of the citizens and visitors to Vail to continue to provide commercial inspection of elevators, commercial dumbwaiters, and platform lifts; and WHEREAS, in order to provide for the appropriate cast of such inspections the Vail Town Council wishes to adopt the Northwest Colorado Council of Governments new elevator permit fees schedule; and WHEREAS, the Town of Vail believes it is necessary to continue to provide for the assessment of a will call inspection fee in tale amount of $3.00 per permit to pay for inspection Call SerVlCes, NOW, THEREFORE, BE iT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. (1) Section 15-02-030(C) of the Municipal Code of the Town of Vail is hereby amended to provide far annual elevator, escalator, moving walkway, commercial dumbwaiter, and platform lift inspection fees in the amounts as set forth in the attached Northwest Colorado Council of Governments elevator permit fee schedule which is hereby adopted by the Town Council and ;5half be set forth on the schedule of fees maintained in the building division of the Community Development Department. (2) The schedule of fees will continue to include a will calf inspection fee in the amount of $3.00 per permit to pay for inspection call services. (3) Future changes in fees will be considered for adoption by Resolution. Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Tawn Council hereby declares it would have passed this ordinance, and each part, section, subsec#ian, sentence, clause or phrase thereo#, regardless of the fact that any one ar more parts, sections, subsections, sentences, clauses or phrases be declared invalid. s ~ ~ section 3. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 4. The amendment of any provision of the Vail Municipal Cade as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision amended. The amendment of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 5. All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or part thereof, theretofore repealed.
