ORDINANCE NO. 16 Series of I997 AN O1tDINANCI AMENDING `I'IIF CHARTER OF `l"HE TOWN OF VAIL, CULORADO, TO CI-]ANGE'l'HE DESIGNA'I'EI) TOWN OF VAIL REGULAR MUNICIPAL ELECTION DATE ANU `l~0 AI:,I.OW NOTIFICATION OF TIDE SUFFICIENCY OF INITIATIVE OR REFERENDCIM PETI'T'IONS 'I'O BE SENT TO THE PETITIONER'S COMMITTEE BY C,I;R'l'II~TED MAIL. WI-IEREAS, the Town Council believes that it would be advantageous to conduct the Town oi` Vail Regular Municipal election with the Eagle County Coordinated Elections; and WIII?RT?.AS, the `d'own Council believes that rather than sending notification by "registered mail," it is more appropriate to send notification to the petitioner's committee filing an initiative or referendum petition by certified mail; and Wl IEREAS, the Town Council wishes to submit these two amendments to the Charter of the '1'owar of Vail to the registered electors of the Tawn of Vail for their vote at the nest regular municipal election set for Novein6er 1$, 1997. NOW, TIIEREFC)RE, BE IT ORDAINED BY 'T'HE TOWN COUNCIL OF THE TOWN OP VAIL, COLORADO, AS FOLLO'V'VS: i , ill~on an affirmative vote of the registered electors of the Town of Vail, Section 2.3- Municipal Clections shall be amended to read as follows: Section 2.3 -Municipal Elections: A regular municipal election shall be held on the first T'~~esciay following the first Monday in November beginning on November 2, 1999, and biennially thereafter. The Town Council will decide at the time of the election whether to conduct such election with the Eagle County Coordinated Elections. Any special municipal election may be called by resolution or ordinance of the council at least thirty (30) days in advance of such election. The resolution or ordinance calling a special municipal election shall set forth the purpose or purposes of such election. Polling places for ail municipal elections which are not conducted exclusively by mail shall be open from 7 a.m. to 7 p.m. on election day. ~• • • 2. [Jpon Buz affirmative vote of the registered electors of the Town of Vail Section 5.4- Procedure after piling, Subsection {a} Certificate of Clerk shall be amended to read as follows: Section 5.4 -Procedures after Filing: (a} Certificate of Clerk. Amendment. Within ten (10} days after the petition is filed, the town clerk shall complete a certificate as to its sufficiency, specifying, if it is insufficient, the particulars wherein it is defective and shall promptly send a copy of the certificate to the petitioners' committee by certified mail. A petition certified insuff-cient for lack of the required number of valid signatures may be amended once if the petitioners' committee files a notice of intention to amend it with the clerk within two (2) days after receiving the copy of his certificate and files a supplementary petition upon additional farms within ten {10} days after receiving the copy of such certificate. Such supplementary petition shall comply with the require-nents of subsection {b) and (c} of Section 5.3, and within five (S) days after it is filed tl~e clerk shall complete a certificate as to the sufficiency of the petition as amended and promptly send a copy of such certificate to the petitioners' committee by certified mail as in the case of an original petition. if a petition or amended petition is certified sufficient, or if a petition ar amended petition is certified insufficient and the petitioners' committee does oat elect to amend or request council review under subsection {b} of tl-is section within the time required, the clerk shall promptly present his certificate to the council, and the certificate shall then be a final determination as to the sufficiency of the petition. 3. `l'he `Gown Council hereby finds, determines and declares that this ordinance is necessary anti proper for the l~calth, safety and welfare of the Town of Vail and the inhabitants thereof. 4. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall oat affect any right which has accrued, any duty imposed, any violation that occurred prior to tl~e effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed ar repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed ar superseded unless expressly stated herein. ,, 5. Al l bylaws, orders, resolutions and ordinances, ar parts thereof, inconsistent herewith arc repealed to tl~e extent only of such inconsistency.
