HomeMy WebLinkAbout1997-23 Second Amendment to the Town of Vail Police and Fire Employees' Pension Plani >~ . , ORDINANCE N0.23 ~' SERIES OF 1997 SECOND AMENDMENT TO THE TOWN OF VAIL POLICE AND FIRE EMPLOYEES' PENSION PLAN WHEREAS, the Town of Vail adopted, effective January 1, 19$3, a qualified money purchase pension plan known as the Town of Vail Police and Fire Employees' Pension Plan (the "Plan"), for the purpose of providing retirement benefits far its police and fire employees; and WHEREAS, the Town of Vail has amended from time to time the Plan, and restated the Plan to incorpoxate all prior amendments and other changes required by law effective January 1, 1994; and WHEREAS, the Town of Vail adopted the First Amendment to the Plan effective January 16, 1996; acrd W[-IL`,REAS, the Town of Vail desires to further amend the Plan. NOW 'T'HEREFORE, in consideration of the premises, the Plan is hereby amended as follows: ! . Section 2.12, "Highly Compensated Emplovee", shall be deleted, effective January 1, 1997, in its entirety and each subsection thereafter shall be renumbered. 2. Section 4.7, "Contribution Percentage Test for Matching and F,mnlovee Contributions". shall be deleted, effective January 1, 1997, in its entirety and each subsection thereafter shall be renumbered. 3. Section 5.3, "Participant Accounts", shall be restated, effective January 1, 1997, as follows: Section 5.3 -- Participant Accounts. The following accounts shall be maintained for the Participants in the Plan: (aj Ernalover Contributions Account. The account maintained for a Participant to record his share of the contributions of the Employer, and all amounts transferred (if any} from the Participant's account in the Town of Vail Pension Plan, and adjustments relating thereto. Ordinance No. 23, Series of 1997 ~• ~ ~ ~ • (b) Participant Contributions Account. The account maintained for a Participant to record his current interest in the Trust Fund resulting from all contributions made by the Participant and adjustments relating thereto. (c) Participant Rollover Account. The account established to hold and account for the contributions rolled over from another qualified plan. The term "Aggregate Account" means the value of all accounts maintained on behalf of a Participant. The maintenance of individual accounts is only for accounting purposes, and a segregation of the assets of the Trust Fund to each account shall not be required. 4. Anew Sectian 5.5, Participant Direction of lnvestmeni, will be added, effective January 1, 1997, and the remaining Sections of Article V shall be renumbered accordingly: Section S.5 -- Participant Direction of lnvestment. The Plan Administrator may establish Hiles, regulations and policies to permit each Full-Time Regular Employee who is a Participant to direct the investment of funds allocated to that Participant's Aggregate Accounts. The Plan Administrator shall select and make available several investment vehicles which Participants may elect to invest the funds allocated to their Aggregate Accounts. The Aggregate Accounts of Participants who are not Full-Time regular Employees shall not be eligible for Participant direction of investment. A Participant who is not aFull-Time Regular Employee, then becomes aFull-Time Regular Employee (as defined in Section 2.11) shall become immediately eligible to transfer his Aggregate Account into any investment vehicle allowed to a Full-Tune Regular Employee. The Plan Administrator shall adopt and establish rules, regulations and policies concerning Participant direction of investment, options available, election forms, limitations on the type or mix of investment vehicles and procedures for Participants to change their investments. 5. Section 7.3, Time of Distribution, subsection {c), Distribution i7nnn C?ther TPrrr,;natinn of Emnlovrnent, shall be restated, effective January 1, 1997, as follows: (c) Distribution Unon Other Termination of F,mniovment 2 Ofdinance No. 23, Series of 3997 ~ • ~ if a Participant terminates his or her employment for any reason. other than retirement, disability or death, and the Participant's interest, pursuant to Section 5.5, is less than $3,500, such interest shall be distributed commencing no later than the last day of the Plan Year after the Participant incurs a Break in Service, subject to spousal consent requirements. b. Section 7.9, Spendthrift Provisions, shall be restated, effective January I, 1997, as follows: Section 7.9 -- Spendthrift Provisions. (a} Nonalienation of Renefits. Except as otherwise provided hereunder, all amounts payable hereunder by the Retirement Board shall be paid only to the person or persons entitled thereto, and all such payments shall be paid directly into the hands of such person or persons and not into the hands of any other person or corporation whatsoever except for transfers to other qualified retirement plans or individual retirement accounts at the written direction of a Participant, and such payments shall not 6e liable for the debts, contracts or engagenrients of any such person or persons, or taken in execution by attachment or garnishment or by any other legal or equitable proceedings; nor shall any such person or persons have any right to alienate, anticipate, commute, pledge, encumber or assign any such payments or the benefits, proceeds ar avails thereof; provided that nothing herein shall affect, restrict ar abridge any right of setoff, lien or security interest which the Trust may have iti the Participant's interest as a result of its use as security for a Participant loan to such Participant. (b) Qualified Domestic Relations Order. Paragraph (a) of this Section shall not apply to the Trustees compliance with a Qualified Domestic Relations Order ("QDRO"). A QDRO is a judgment, decree or order (including approval of a property settlement agreement) rrrade pursuant to a state domestic relations law (inr,1„rlinQ community property law) that relates to the provision of child support, alimony payments or marital property rights to a spouse, former spouse, child or other dependent of a Participant ("Alternate Payee") and which; 3 Ordinance No. 23, Series of 1997 {i) creates or recognizes the existence of an Alternate Payee's right to, or assigns to an Alternate Payee the right to, receive all or a portion of the benefits payable to a Participant under this Plan; (ii) specifies (1) the name and last known mailing address of the Participant and each Alternate Payee covered by the order; (2) the amount ar percentage of the Participant's Plan benefits to be paid to any Alternate Payee; or the manner in which such amount or percentage is to be determined; and (3) the number of payments or the period to which the order applies and each plan to which the order relates; and (iii) does not require the Plan to: (1) provide any type or foam of benefit or any option not otherwise provided under the Plan; (2) pay any benefits to any Alternate Payee prior to the earlier of the affected Participant's temunation of employment or the earlier of either: (] }the earliest date benef is are payable under the Plan to a Participant; or (2) the later of the date the .Participant attains age SQ, or the earliest date on which the Participant could obtain a distribution form the Plan if the Participant separated form service; (3} provide increased benefit; or {A~) pay benefits to an Alternate Payee that are required to be paid to another Alternate Payee under a prior QDRO. For purposes of this Plan, an Alternate Payee who had been married to the Participant for at least one year may be treated as an Eligible spouse with respect to the portion of the Participant's benefit in which such Alternate Payee has an interest provided that the QDRO provides far such treatment. In addition, if the QDRO so provides, this Plan, shall have the right to make an immediate distribution of fhP Alternate Payee's benefit, notwithstanding the fact that the Participant rrzay not be eligible for immediate payment. 4 Ordinance Ho. 23, Series of 1997 • ~ • • However, under no circumstances, may the spouse of an Alternate Payee {who is not a Participant hereunder) be treated as an Eligible Spouse under the terms of the Plan. Upon receipt of any judgment, decree or order relating to the provision of payment by the Plan to an Alternate Payee pursuant to a state domestic relations law, the Trustees shall promptly notify the affected Participant and any Alternate Payee of the receipt of such judgment, decree or order and shall notify the affected Participant and any Alternate Payee of the Trustee's procedure for determining whether or not the judgment, decree ar order is a QDRO. The Trustee's shall establish a procedure to determine the status of a judgment, decree or order as a QDRO and to administer Plan distributions in accordance with a QDRO. Such procedure shall be in writing, shall include a provision specifying the notification requirements enumerated in the proceeding paragraph, shall permit an Alternate Payee to designate a representative for receipt of communications form the Trustees and shall include such other provisions as the Trustee shall determine, including provisions required under regulations promulgated by the General Assembly of the State of Colorado. 7. Section 7.11, Authorisation of Loans to Participants, subsection (f} Default, shall be restated, effective January 1, 1997, as follows: {fj Default. Notwithstanding any other provision of this Section, a Participant loan made pursuant to this Section is not in default if a Participant fails to make two months scheduled loan repayments, provided that by the last day of the fallowing month such delinquency is cured. A loan shall be deemed to be in default if the Participant misses three consecutive months of scheduled loan xepayments. Once the loan is in default, it shall become immediately due and payable as of the last day of the month in which it is deemed in default. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. t). The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Town of Vail and the inhabitants thereof. 1 {}. "The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision repeated or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein, 11. .All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, or ordinance, or part thereof, theretofore repealed.
