AN OI2DINANCI: AMI~:NDING SI.C'I'ION 12-1_S-4 (IN'1'1?I21UlL CONVhRSION) AND
SLC1'ION 12-IS-5 (ADDITIONAL GRFA) OF'f IIC'I'OWN OF VAIL MUNiC1PAL
CODE REGARDING THE IMPLEMENTATION OF TIIE INTERIOR CONVE125ION
RCGULATION AND ADDITIONAL GRFA (25(1) FOR MULTI-FAMILY DWELLING
UNITS, AND SET'T'ING FORTH DETAILS IN REGARD THERETO.
WHEREAS, the Vail Town Council has directed the Community Development
Department to draft text amendments to the `T'own of Vail Municipal Code creating consistency
in the implementation of GRT'A regulations among all dwelling unit types and to allow greater
Ilexibility in the use of GR~A for multi-(amity dwelling units; and
WHEREAS, Section 12-I S-4 and Section 12-] 5-S of the Town of Vail Municipal Code
contains the regulations for interior conversions and additional GRrA (250); and
WHEREAS, the proposed text amendments to Section 12-45-4 and Section 12-I5-5 are
in the best interests of the community as the amendments comply with the development
objectives of the Town of Vail; and
W f IEREAS, in accordance with the provisions of the Municipal Code, the Planning and
Environmental Commission, on October l2, 1998, held a public hcariug on the proposed text
amendments and has submitted its recommendation to the Vail Town Ccnu~cil; and
WI IEREAS, the Vail 't'own Councii considers that it is reasonable, appropriate and
beneficial to the Town and its citizens, inhabitants, and visitors to amend Section 12-15-4 and
Section 12-15-5 of the Municipal Code; and
WI IEREAS, the Vail 'own Council has held a public hearing on the proposed text
amendments in accordance with the provisions of the Town of Vail Municipal Code.

SECTION I
Title 12, Chapter 15, Section 4 of the Municipal Code of the Town of Vail is hereby amended as
follows:
12-15-4: INTERIOR CONVRRSIONS:
Section 12-15-4R
Applicability:
Single-family, two-family, told--primary/secondary t~}3e c-r m-rlti-family dwelling units that
meet or exceed allowable GRfA will be eligible to make interior conversions provided the
following criteria are satisfied:

Section 12-15-SC
D. Process:
Applications shall be made to the Department of Comnuutity Development stall•on
firms provided by the Department. Applications for interior conversions to single-
family, two-family, t-nd-primarylsecondary ~ a• multi-family dwelling units located
in a special development district (SDD) pursuant to this Section shall also he allowed
without amending the GIZI~A provisions of the SI)D. t lowcvw•, properties with GIt1~A
restrictions recorded on the plat I~tr the development shall he regulated according to the
plat restrictions unless the plat is modified to remove such restrictions. The planning
staff will review the application to ensure the proposed addition complies with all
provisions of the interior conversion section. Submittals shall include:
Application fees pursuant to the current fee schedule.

'T'itle or as determined by the Department of Community Development staff.
Applicants wealcl need to submit as-built floor plans o1•the structure so that
staff can identify the existing building from any new additions that have
occurred a('ter the approval of this Chapter.
Proposals deemed by the Department of Community Development staff to be in
compliance with this Seclion and all applicable zoning and development
regulations shall be approved by the 1)cparUttent of Community
I)evelopntent or shall be forwarded to the Design Review Board in
accordance with Title 12, Chapter 1 1 of this Title. Proposals deemed to not
comply with this Seclion or applicable zoning and development regulations
shall be denied.
Upon receiving approvals pursuant to this Section, applicants shall proceed with
securing a building permit prior to initiating construction of the project.
Any decisions of the Department of Community Development pursuant to this
Section may be appealed by any applicant in accordance with the provisions
of Section 12-3-3 of this Title. (Ord. 13(1997) ? 3).
SECTION 2
Title 12, Chapter 15, Section 5 of the Municipal Code of ilte Town of Vail is hereby amended as
follows:
Section 12-15-SC

GRFA for the site. Any application of such additional GRFA must meet the following
criteria:
5. Guideline Compliance; Review: All proposals under this Section shall be
reviewed for compliance with the design review guidelines as set forth in
Chapter 11 of this Title. Existing properties for which additional GRFA is
proposed shall be required to meet minimum Town landscaping standards as set
forth in Chapter 11 of this Title. General maintenance and upkeep of existing
buildings and sites, including the multi-family dwellings, landscaping or site
improvements (i.e., trash facilities, berming to screen surface parking, etc.) shall
be reviewed by the staff after the application is made for conformance to said

the multi-family dwelling site and building have been completed as required.

7. ~ Applicability: The provisions of this Section are applicable only to GRFA
additions to individual dwelling units. No pooling of GRFA shall be allowed in
multi-family dwellings. No application for additional GRFA shall request more
than two hundred fifty (250) square feet of gross residential floor area per
dwelling unit nor shall any application be made for additional GRFA until such
time as all the allowable GRFA has been constructed on the property. The use
of additional GRFA by individual dwelling unit owners, pursuant to the
additional GRFA provisions, is permitted only when 100% of the owners in
the structure are also proposing to utilize their additional GRFA as well.
When exterior additions are proposed to amulti-family structure, the
addition of the GRFA shall be designed and developed in context of the
entire structure.
8.9. Nontransferable To Demo/Rebuild: Any building which has previously
been granted additional GRFA pursuant to this Section and is demo/rebuild,
shall be rebuilt without the additional GRFA as previously approved.
9. -1-8- Demo/Rebuild Not Eligible: Any multiple-family structure or dwelling
unit which is to be demo/rebuild shall not be eligible for additional GRFA.
Section 12-15-SD
D. Procedure:
Application; Content: Application shall be made to the Department of
Community Development on forms provided by the Department of
Community Development by the Condominium Association or a similar
governing body and shall include:
a. A fee pursuant to the current schedule shall be required with the
application.
b. Information and plans as set forth and required by subsection 12-11-
4C of this Title.

Compliance Uctermincd: If the Department of Community Development staff
determines that the site f~~r which the application was submitted is in
compliance with "Gown landscaping and site improvement standards, the
applicant shat! proceed as follows:
a. Applicatiolt for GRFA additions which involve no change to the
exterior of a structure shall be reviewed and approved by the Deparhnent
of Community Development.
h. Applications for GRFA additions involving exterior changes to a
building shall be reviewed and approved by tl-c tlktt~rri»g-aid

the provisions of ibis Section.
Compliance Required: If the Deparhnent of Community Development staff
determines that the site (i~r which additional GRFA is applied for pursuant to

standards as provided herein, the applicant will be re<uired to bring the site
into compliance with such standards before any such temporary or
permanent certiiicatc ofoccupancy will be issued (or the additional GRFA

submit appropriate plans and materials indicating how the site will be
brought into compliance with said Town minimum standards, which plans
and materials shall be reviewed by and approved by the Department of
Community Development.
Building Permit: lJpon receiving the necessary approvals pursuant to this
Section, the: applicant shall proceed with the securinb of a building permit
prior to beginninb the construction of additional GRFA. (Ord. 13(1997) ? 3)
Section 3.
if any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held
to be invalid, such decision shall not effect the validity of the remaining portions of this
ordinance; and the `l'ows Council hereby declares it would have passed this ordinance, and each
part, section, subsection, sentence, clause or pllrasc thereof, regardless of the fact that any one or
more parts, sections, subsections, sentences, clauses or phrases be declared invalid.
Section 4.
The `town Council hereby linds, determines and declares tl-at this ordinance is necessary and
proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
Sectirn~ 5.
The amendment of any provision of the Vail Municipal Code as provided in this ordinance shall

hereby shall not revive any provision or any ordinance previously repealed or superseded unless
expressly stated herein.
Section 6.
All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are
repealed to the extent only of such inconsistency. This repealer shall not be construed to revise
any bylaw, order, resolution or ordinance, or part thereof, theretofore repealed.
