HomeMy WebLinkAbout1999- 1 Amending Ordinance No. 23, Series 1998, to Add "Transportation Business" and "Temporary Use of the Tennis Facility for Conference and Conventions" as a Conditional Use, Subject to Permit ORDINANCE NO. 1 SERIES OF 1999 AN ORDINANCE AMENDING ORDINANCE NO. 23, SERIES OF 1998, TO ADD "TRANSPORTATION BUSINESS" AND "TEMPORARY USE OF THE TENNIS FACILITY FOR CONFERENCES AND CONVENTIONS" A5 A CONDITIONAL USE, SUBJECT TO THE ISSUANCE OF A CONDITIONAL USE PERMIT IN ACCORDANCE WITH THE PROVISIONS OF THE ZONING REGULATIONS, IN DEVELOPMENT AREA A, CASCADE VILLAGE, SPECIAL DEVELOPMENT DISTRICT NO. 4; AND SETTING FORTH DETAILS 1N REGARD THERETO. WHEREAS, the Vail Cascade Hotel & Club and Westrac, Inc. dba Thrifty Car Rental, have requested amendments to the existing Special Development District No. 4, Development Area A, Cascade Village; and WHEREAS, the Planning & Environmental Commission has held public hearings on the proposed amendments in accordance with the provisions of the Municipal Code of the Town of Vail; and WHEREAS, the Planning & Environmental Commission finds that the proposed amendments comply with the review criteria outlined in the Zoning Regulations for amendments to Special Development Districts; and WHEREAS, the Planning & Environmental Commission has voted unanimously to recommended approval of the proposed amendments to the Vail Town Council; and WHEREAS, the Vail Town Council considers tha# i# is reasonable, appropriate, and beneficial to the Town and its citizens, inhabitants, and visitors to amend Ordinance No. 23, Series of 1998 to provide for amendments to Special Development District No. 4, Cascade Village, NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Ordinance No. 23, Series of 1998, is hereby amended as follows: Section 4. Conditional Uses A. Area A, Cascade Village Add as new #7, Transportation Business. Add as new #8, Temporary Use of the Tennis Facility for Conferences and CQT1VentlOnS 1 a Section 2. All other Sections of Ordinance #23, Series of 1998 shall remain unchanged. Section 3. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 4. The repeal or the repeal and re-enactment of any provisions of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal' of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section b. Ail bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are hereby repealed to the extent only of such inconsistency. The repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or part thereof, heretofore repealed.
