SERIES QF 1999
:
AN ORDINANCE CREATING THE VAIL LOCAL MARKETING DISTRICT.
WHI:RF.'AS, Titie 29, Article 25, known as the "Local Marketing District Act," provides that
local governments have the power to create ar;d establish Local Marketing Districts; and
WIIEREAS, such Local Marketing Districts have the power to pravide the following
S{:I'VICE;S:
• C)rganization, promotion, marketing, and management of public events;
• 1lctivities in support of business recruitment, management, and deveIopznent;
• Coordinating tourisnz promotian activities; and
WHEREAS, petitions for the arganization of the Vaii Local Marketing District ("District")
within thc Town of~ Vail, Eagle County, Colarado have been filed in the office of the Clerk of the
Town of Vail; and
WHERL?AS, Sectian 29-25-101, et. sec C.R.S., renuires a public hearing by the Vazl Town
Counczi ta cansider if'the petitions have been signed and presented in coxrforrnity with the Act, and
all other applicable provisions of the Acf have been satisfied; and if so, to approve the organization
of the DiStr«t.
NOW THEREFQRE, BE IT ORDANED BY THE TQWN COUNCZL OF THE TOWN QF
vnlL, cOLoRAUO, THAT:
Section 1.
"f'he name oi'the proposed District shaIl be "Vail Locai Marketing District".
Section 2.
7'here shall be suhmitted to the registered electors of the Tawn of Vail, Colorado at th.e next
general e3cction to be held on November 2, 1999, ballot questions establishing thc Districi and a
ciew r3narlceting aud promotion tax on the purchase price paid or charged to persons for rooms ar
accommodations at a rate not to exceed 1.4 % and vvhether the praceeds of such tax shall provide
revenue f'nr organizing and operating the district and furnishing services. All registered electors
o1'tfie `Cown of Vail shall be entitled to vote at such election.

Section 3.
'I,hc Vail Town Council shall constitute the exofficio board of directors of the District until
appointment of the perrnanent board of directors of the District pursnant to Section 29-25-108(b).
Section 4.
'I'17e houildaries and service area af the District sha11 be the present legaI boundaries af the Town
oi'Vail, Colarado, as more specifically illustrated an the Town Map on file in the Off ce of the
Town Clcrk and as shown in the Public Records of the County of Eagle, Calorado.
Section 5.
rChe term of the Distzict is an indefinite terrn and shail continue until repealed, rescinded or
ternlinated by the Vaii Town Council thraugh the adoption of an Ordinance repeaZing, rescinding
or terzninating s<iid District; and upon such dissolution ail assets of the District shall be
di5tributed to the Town of Vail.
Section 6.
rC'he District shall have all powers gran.ted by the LocaI Marketing District Act, Section 29-25-
1Ol , et. M-, C.R.S.
Section 7.
T'lae C)istrict shall constitute a separate politicat subdivzsion and body corporate of the State and
shall have all of the duties, privileges, immunities, rights, liabilities and disabilitzes of a public
body politic and corporate.
Section 8.
On the conclusion oi.'the public hearings xequired 6y the Act, the Town Council finds:
{a} that the petition submitted for the organization of the Town of Vail Local
MarIceting District is signed in conformity with the Act;
{b} that the signatures contained on the petition are genuine and meet the
i•equiremeiits oi:'the Act;
(c) t]iat there is no properfy within the boundaries of the distrzct to be excluded
herelrozn.

"l'his Urdinance shall finally and conciusively establish the regular organization of the
Veiil Loca1 Marketing Distxict against all persons unless an action is filed attacking the validity
withii1 sixly (CO) days after the effective date of this Qrdinance.
Section 10.
tf ~iny part, seation, stibsection, sentence, clause or phrase ot'this ordinance is for any reason heId
to be invalid, such decisian shail not affect the validity of the remaining portions of this
ordinance; and tne Town Council hereby declares it would have passed this ordinance, and each
part, section, subsection, sentence, clause or phrase thereof, regardless of the £act that any one or
inore parts, sections, subsections, sentences, cIauses or phrases be declaxed invalid.
Section 11.
The Town Cauncil hereby finds, determines, and declares that this ordinance is necessar•y and proper
f'oz• tlie llealth, safety, and welfare of the Tovvn of VaiI and the inhabitants thereof.
Section 12.
'1'he repeal or the repeal and re-enactment of any provisions of the Vail Municipal Code as
provided iu this ardinance shall not affect any right which has acerued, any duty imposed, any
violation that occurred prior to the effective date hereof, any prosecution commen.ced, nor any
c>tlicr action or proceeding as commenced under or by virtue of the provision repealed or repealed
and rEenacted. I'he repeal of any provision hereby shall not revive any provisioii ar arzy
ordinance prc;viausly repeaied or superseded unless expressly stated herein.
Section 13.
All hylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are hereby
rcpealed to the extent only of such incansistency. The repealer shall not be canstrued to revise
any hylaw, arder, resalution or ordinance, or part thereof, heretofore repealed.
