HomeMy WebLinkAbout1999-30 Authorizing the Conveyance of Fee Title to the Following Land Owned by the Town of Vail and Located on Rockledge Roadc ORDINANCE N0.30 SERIES OF 1999 AN ORDINANCE AUTHORIZING THE CONVEYANCE OF FEE TITLE TO THE FOLLOWING LAND OWNED BY THE TOWN OF VAIL AND LOCATED ON ROCKLEDGE ROAD, MORE FULLY DESCRIBED AS FOLLOWS: 'l~hat portion of Lots 2, 3A and 3B {Resubdivision of Lot 3, Block 7), 4, 7, 8A, 9A, LOA and10B {Resubdivision of Lot 10, Block 7), and 13B (Resubdivision of Lot 13, 131ock 7}, Black 7, Vail Village First Filing, lying South of the North Line of Lat 2 of the Raethex Minor Subdivision (formerly Government Lot 3), and North of the North boundary of Rockledge Road and/or North of the North boundary of Tract A Fast of the East end of Rockledge Road, as described in the Final Plat of A Replat of a Portion of Black 7, Vail Village First Filing, and Lot 2 of Raother Minor Subdivision, Section 7, Township 5 South, Range 80 West, fith Principal Meridian prepared by Thompson-Langford Corporation and dated September 7, 1999, (as that plat may be modified with the consent of the Town of Vail), together with all interests of the Town of Vail in alI easements and other appurtenances associated with said Purchased Property as shown on said Final Plat. In addition, pursuant the Agreement Creating Restrictive Covenants, attached as Exhibit B, the Town of Vail agrees to create restrictive covenants, which shall be covenants running with the land, for the benefit of the owners of Lots 2, 3A, 3B, 4, 7, 8A, 9A, 10A, l OB and 13B, which Restrictive Covenants shall be on the fallowing described real estate in the Town of Vai[, County of Eagle anal State of Colorado, to wit: Tract A, Final Plat of A Replat of a Portion of Black 7, Vail Village First Filing, and Lat 2 of Raother Minor Subdivision, Section 7, Township 5 South, Range 80 West, Cith Principal Meridian prepared by Thompson-Langford Corporation and dated Septerrzber 7, 1999, (as that plat may be modified with the consent of the Town of Vail). (See attached Exhibit A -Final Plat of A Replat of a Portion of Black 7, Vail Village First filing, and Lot 2 of Raother Minor Subdivision, Section 7, Township 5 South, Range 80 West, 6th Principal Meridian prepared by Thompson-Langford Corporation and dated September 7, 1999.) WHEREAS, the Town of Vail is the owner of certain property particularly described in 1_?xhibit A, attached hereto; and W1-IEREAS, the land being conveyed herein was acquired by the Town of Vail from the United States Forest Service in the Land Ownership Adjustment Agreement; and Wl-IERLAS, the Land Ownership Adjustment Agreement and the conveyance of this land is consistent with the Vail Comprehensive Open Space Plan adapted in 1994; and WHEREAS, it is contemplated that this conveyance will be concluded through a series of transfers to adjoining property owners on Rockledge Road that will assist removing private encroachrrzents from publicly owned land, providing a boundary between the Town of Vail and the United States l:,orest Service property. ~r NOW, THEREFORE, BE IT ORDAINED, BY THE TOWN COUNCIL Ob' THE TOWN OT' VAII_,, COLORADO that: The "fawn Council hereby approves the sale of property for a total purchase price of $1,40[},1}(}(}. 2. `Che Town Manager is hereby authorized and directed to execute such instruments of conveyance as are <ippropriaie to convey fee title from the Town of Vail to adjoining property owners. 3. if any part, section, subsections, sentence, clause or phrase of this ordinance is for any reaso~~ held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Tawn Council hereby declares it would have passed this ordinance, and each part, sc;ction, subsection, sentence, clause or phrase thereof regardless of the fact that any one or mare parts, sections, subsections, sentences, clauses or phrases be declared invalid. 4. 7'he Town. Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Tawn of Vail and the inhabitants thereof S . `1'hc repeal or the repeal and reenactment of any provision of the Municipal Cade of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty unposed, any violation that occurred prior to the effective date hereof; any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previorisly repealed or superseded unless expressly stated herein. 6. All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extend only of such inconsistency.
