HomeMy WebLinkAbout2000- 9 Amending Chapter 12-10 and Section 12-2-2 of the Vail Municipal Code; with Specific Regard to Off-Street Parking Requirements for Properties within Vail's Commercial Core Areas and Variance Procedures for Off-Street Parking and Loading• ~ • ORDINANCE NO. 9 SERIES OF 2000 AN ORDINANCE AMENDING CHAPTER 12-10 AND SECTION 12-2-2, VAIL TOWN CODE; WITH SPECIFIC REGARD TOOFF-STREET PARKING REQUIREMENTS FOR PROPERTIES WITHIN VAIL'S COMMERCIAL CORE AREAS AND VARIANCE PROCEDURES FOR OFF-STREET PARKING AND LOADING; AND SETTING FORTH DETAILS IN REGARD THERETO. WHEREAS, the Vail Town Council recognizes a need to re-evaluate parking generated by commercial properties within VaB's commercial core areas in an effort to provide accurate and practical off-street parking requirements; and WHEREAS, the Vail Town Council, the Town of Vaii Planning and Environmental Commission and Town of Vail staff have worked with consulting experts at public hearings in order to examine the issue of parking in Vail's commercial core areas; and WHEREAS, the Vail Town Council considers it in the interest pf the public, health, safety and welfare to amend these code sections. NOW, THEREFORE, BE iT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: SECTION 1. Section 12-2-2 {Definitions) is hereby amended to read as follows: (Added text is shown ir7 bold and underlined Type; deleted text is shown in ~ type} 12-2-2: ^EFiN1TIONS: FLOOR AREA, SEATING (Used Only for Calculating Parkins Requirementsl: The floor area within the enclosing walls of a business or structure that is devoted to the seating 4f goes#s for dining or meetins~ purposes, exclusive of lobbies. pre-convene areas and kitchen facilities. SECTION 2. Section 12-10-1d {Parking Requirements Schedule) is hereby amended to read as follows: 12-10-10: PARKING REQU[REMENTS SCHEDULE: Off-street parking requirements shall be determined in accordance with the fallowing schedule: A. Section 12-7Q-2~ (Special Review Provisions} is hereby added to read as follows: 12-10-20: SPECIAL REVIEW PROVISIONS: Notwithstanding the provisions of Section 12-10-18 of this chapter, the Planning and Environmental Commission may approve a reduction to the number of required spaces specified in Section 12-10-10, provided a report documenting the presence of unique parking characteristics is provided by a aualified consultant and the following findings are made by the Planning and Environmental Commission: A. The parking demand will be less than the requirements identified in Section 12-10-10: and B. The probable Iona-term use of the building or structure, based vn its design. will not generate additional parkins demand: and C, The use or activity is part of a demonstrated permanent program !including but not limi#ed to "rideshare" programs, shuttle service. or staggered work shifts! intended to reduce parking demand that has been incorporated into the project's final approved development plan; and D. Proximity or availability of alternative modes of transportation !including but not limited to public transit or shuttle services! is significant and jntearal to the nature of the use or business activity. In reachjna a decision, the Planning and Environmental Commission shall consider survey data submitted by a aualified transportation planning or engineering consultant. Projects under "special review" are subject to additional scrutiny by the Planning and Environmental Commission after development plan approval if it is deemed necessary to verify continued compliance with the above-listed criteria. The maximum allowable reduction in the number of required spaces shall not exceed 25 percent of the total number required under Section 12-10-10 of this Chapter. SECTION 6. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions ofi #his ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereofi, regardless of the fact that any one or mare parts, sections, subsections, sentences, clauses or phrases be declared invalid. -4- • • • SECTION 7. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. SECTION 8. The amendment of any provision of the Town Cade as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any viglation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision amended. The amendment of any provision hereby shall not revive any provision or any ordinance previously repeated or superseded unless expressly stated herein. SECTION 9. All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution or ordinance, or part thereof, theretofore repealed.
