HomeMy WebLinkAbout2001-34 Making Supplemental Appropriations to the Town of Vail General Fund, Capital Projects Fund and Others of the 2001 Budget for the Town of Vail; and Authorizing the Expenditures of Said Appropriations as Set Forth Herein• • • ORDINANCE NO. 34 SERIES OF 2001 AN ORUINANCF., MAKING SUPPLEMENTAL APPROPRIATIONS TO THE TOWN OF VAIL (.rI:;NERAL FUND, CAP[TAL PROJECTS FUND, DISPATCH SERVICES FUND, AND THE REAI, F?S"1'A`C'1=, rI"RANSFER TAX FUND OF THE 2001 BUDGET FOR THE TOWN OF VAIL, COLORADO; AND AUTHORIZING THE EXPENDITURES OF SAID APPROPRIATIONS AS SI=:T I~OI~'I'II I-IEREIN; AND SETTING FORTI-I DETAILS IN REGARD TIIERETO. WI IEREAS, contingencies have arisen during the fiscal year 2001 which could not 11ave been reasonably f~n•eseen or anticipated by the Town Coru~cil at the time rt enacted Ordinance No. 28, Series oI' 200(), adapting the 2001 Budget and Financial Plan for the Town of Vail, Colorado; and, WIIEREEIS, the Town Manager has certified to the Town Council that sufficient funds are available to discharge the appropriations referred to herein, not otherwise reflected in the Budget, in 7ccordance with Section 9.10(a) of the Charter of tl~e Town of Vail; and, WIIERI E1S, in order to accolnplisll the foregoing, the Town Counci! finds that it should make certain supplemental appropriations and budget adjustments as set forth herein. NOW, 'CI~EREFORE, BE IT ORDAINED, BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COI_,ORADO that: Pursuant to Section 9.10(a} of the Charter of the Town of Vail, Colorado, the Town Council hereby mattes tl~e following supplen~eutal appropriations and budget adjustments for the. 20(?1 Budget and financial Plan for the Town of Vail, Colorado, and authorizes the expenditure of said appropriations as follows: General Fund 347,099 Capital Projects Fti~~d {52,356) Real Estate 'Transfer Tax Fund l 1,000 Dispatch Services Fund 27_SOfI Total 333,243 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is For any rL'aSC)n helCl t() hC LIlValld, such decision shall not affect the validity of the remaining portions of this ordinance; and the 7`own Council hereby declares it would have passed this ordinance, and each part, seetioll, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more piu•ts, sections, subsections, sentences, clauses or phrases he declared invalid. The Town Council hereby finds, determines, and declares that this ordinance is • • necessary and proper for the health, safety, and Welfare o~f the Town of Vail and the inhabitants thcreol'. 4. The repeal or the repeal and reenactment of any provision of the Municipal Code of the `I'owa of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, at~y prosecution commenced, nor any other action or proceedings as commenced under or by virhte of the provision repealed or repealed and reenacted. "l~lte repeal of any provision Hereby shall not revive any provision, or any ordinat~ec previously repealed or superseded unless expressly stated herein. 5. All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsisten# herewith are repealed to the extend only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, or ordinance, or part thereof, theretofore repealed.
