WHEREAS, The Town of Vail (the `Town"), in the County of Eagle and State of Colorado is a home rule municipal corporation duly organized and existing under the laws of the State of Colorado and the Town Charter (the "Charter"); and WHEREAS, the members of the Town Council of the Town (the "Council") have been duly elected and qualified; and WHEREAS, the Council wishes to extend the time which amplified-sound equipment maybe used for commercial purposes on Friday and Saturday nights from 10:00 p.m. to 11:00 p.m.; and • NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Section 5-1-7(H)(2)(d) Vail Town Code is hereby amended to read as follows: In all other zones, except such portions thereof as may be included within one hundred feet (100') of any residential zone, the operation or use of sound-amplifying equipment for commercial purposes is prohibited between hours of ten o'clock (10:00) P.M. and eight o'clock (8:00) A.M. of the following day on Sundav through Thursclav. and between the hqurs of eleven o'clock (11:001 P.M. and eight o'clock (8:001 A.M. of the following day on Fridav and Saturdav. Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any • Ordinance No. 14, Series of 2007 1 i r one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. • Section 3. The Town Coun it c hereby fords, determines, and declares that this ordinance ''s necessary and proper for the health, safety; and welfare of the Town of Vail and the inhabitants thereof. Section 4. The amendment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision amended. The amendment of any provision hereby shall not revive any provision or any ordinance previously amended or superseded unless expressly stated herein. Section 5. All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, or ordinance, or part thereof, theretofore repealed. ' Section 6. This ordinance, as adopted by the Town Council, shall be numbered and recorded by • the Town Clerk in the official records of the Town. The adoption and publication shall be authenticated by the signatures of the Mayor, or Mayor Pro Tem, and Town Clerk, and by the certificate of publication. Section 7. This ordinance shall be in full force and effect five days after publication following final passage.
