HomeMy WebLinkAbout2007-39 Amending Section 12-2-2, Definitions, And Subsections 12-7B-2A Definitions (Basement or Garden Level), 12-7B-3A Definitions (first Floor or Street Level; 12-7H-2A, 12-7H-3A, 12-7IK-2A, 12-7I-3A to Allow for Amendments to the Definitions ORDINANCE NO. 39 SERIES 2007 AN ORDINANCE AMENDING SECTION 12-2-2, DEFINITIONS, AND SUB- SECTIONS 12-713-2A, DEFINITIONS (BASEMENT OR GARDEN LEVEL); 12- 713-3A, DEFINITIONS (FIRST-FLOOR OR STREET LEVEL); 12-7H-2A, DEFINITIONS (BASEMENT OR GARDEN LEVEL); 12-7H-3A, DEFINITIONS (FIRST-FLOOR OR STREET LEVEL); 12-71-2A, DEFINITIONS (BASEMENT OR GARDEN LEVEL); 12-71-3A, DEFINITIONS (FIRST-FLOOR OR STREET LEVEL), VAIL TOWN CODE, TO ALLOW FOR AMENDMENTS TO THE DEFINITIONS OF "BASEMENT OR GARDEN LEVEL" AND "FIRST FLOOR OR STREET LEVEL," AND SETTING FORTH DETAILS IN REGARD THERETO. WHEREAS, on December 10, 2007, the Planning and Environmental Commission of the Town of Vail held a public hearing and reviewed and forwarded a recommendation of approval for the proposed text amendments to the Zoning Regulations to the Vail Town Council in accordance with the procedures and criteria and findings outlined in Chapter 12-3 of the Zoning Regulations of the Town of Vail; and, WHEREAS, within the Commercial Core 1, Lionshead Mixed Use 1, and Lionshead Mixed Use 2, Districts; the Vail Town Code allows for different land uses on each level of a building. The intent of this "horizontal zoning" technique is to encourage a vibrant retail environment adjacent to the pedestrian areas of both Vail Village and Lionshead; while also facilitating mixed use developments composed of office, residential, and other commercial uses; and, WHEREAS, the Town Council finds and determines that the amendments are consistent with the applicable elements of the adopted goals, objectives and policies outlined in the Vail Comprehensive Plan and is compatible with the development objectives of the Town, based upon Section IV of the Staff memorandum to the Planning and Environmental Commission dated December 10, 2007, and the evidence and testimony presented; and, WHEREAS, the Town Council finds and determines that the amendments further the general and specific purposes of the Zoning Regulations, based upon Section IV of the Staff memorandum to the Planning and Environmental Commission dated December 10, 2007, and the evidence and testimony presented; and, WHEREAS, the Town Council finds and determines that the amendments promote the health, safety, morals, and general welfare of the Town and promote the coordinated and harmonious development of the Town in a manner that conserves and enhances its natural environment and its established character as a resort and residential community of the highest quality, based upon Section IV of the Staff memorandum dated December 10, 2007, WHEREAS, the Town Council finds and determines that the public health, safety, and welfare will be served by these adopting regulations, based upon Section IV of the Staff memorandum to the Planning and Environmental Commission dated December 10, 2007, and the evidence and testimony presented. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: 1 Ordinance No. 39, Series of 2007, second reading Section 1. Section 12-2-2 of the Vail Town Code is hereby amended by the addition of the following definitions (text that is to be deleted is 9Wskep, text that is to be added is bo/d, and Sections of text that are not amended may be omitted): Basemenf or Garden Level: For the purposes of imp/ementing horizonta/ zoning within specific zone districis, basement or garden level shall be any floor, or portion of any f/oor, of a structure /ocafed substanfially be/ow the first f/oor or street level of that strucfure, as determined by the Administrator or the P/anning and Environmenta/ Commission. More than one floor, or portion of floors, may be defined as basement or garden level wifhin a sing/e structure. First F/oor or Sfreet Level: For the purposes of implementing horizonta/ zoning within specific zone districts, firsf f/oor or streef level shall be any floor, or portion of any floor, of a structure /ocated af or nearest fo (either above or be/ow) fhe level of the adjacent vehicular or pedestrian way, as determined by the Administrator or ihe Planning and Environmenta/ Commission. More than one f/oor, or portion of floors, may be defined as streef level within a sing/e strucfure. Section 2. Article12-713, Commercial Core 1, of Vail Town Code (in part) is hereby amended as follows (text that is to be deleted is eMiskep, text that is to be added is bold, and Sections of text that are not amended may be omitted): 12-78-2: PERMITTED AND CONDITIONAL USES; BASEMENT OR GARDEN LEVEL: ~ " VaFden " er- ~ A. Permitted Uses: The following uses shall be permitted in basement or garden levels within a structure: 1. Retail shops and establishments, inc/uding the following: Apparel stores. Art supply stores and galleries. Bakeries and confectioneries. Bookstores. Camera stores and photographic studios. Candy stores. Chinaware and glassware stores. Delicatessens and specialty food stores. Drugstores. Florists. Gift shops. Hea/th food stores. Hobby stores. Jewelry stores. Leather goods stores. Music and record stores. Newsstands and tobacco stores. Sporting goods stores. Stationery stores. Toy stores. Variety stores. Yardage and dry goods stores. 2. Personal services and repair shops, including the following: Beauty and barber shops. 2 Ordinance No. 39, Series of 2007, second reading Commercia/ ski storage. Sma/l appliance repair shops. Tailors and dressmakers. Trave/ and ticket agencies. 3. Eating and drinking establishments, inc/uding the following: Bakeries and delicatessens with food service, restricted to preparation of products specifically for sale on the premises. Cocktail lounges and bars. Coffee shop. Fountains and sandwich shops. Restaurants. 4. Professional offices, business offices and studios. 5. Banks and financial institutions. 6. Additional uses determined to be similar to permitted uses described in subsections 81 through B5 of this section, in accordance with the provisions of section 12-3-4 of this title so long as they do not encourage vehicular traffic. 7. Lodges. 8. Type IV employee housing units, as further regu/ated by chapter 13 of this tit/e. C, B. Conditional Uses: The following uses shall be permitted in basement or garden levels within a structure, subject to issuance of a conditional use permit in accordance with the provisions of chapter 16 of this title: Electronic sales and repair shops. Household appliance stores. Liquor stores. Luggage stores. Major arcades. Meeting rooms. Multiple-family dwellings. Outdoor patios. Theaters 12-78-3: PERMITTED AND CONDITIONAL USES; FIRST FLOOR OR STREET LEVEL: ' Z „ W „ ~ A. Permitted Uses: The following uses shall be permitted on the first floor or street level within a structure: 1. Retail stores and establishments, including the following: Apparel stores. Art supply stores and galleries. Bakeries and confectioneries. Bookstores. Camera stores and photographic studios. Candy stores. Chinaware and glassware stores. Delicatessens and specialty food stores. Drugstores. F/orists. Gift shops. Hobby stores. Jewe/ry stores. Leather goods stores. Luggage stores. Conditional Uses: The following uses shall be permitted on the first floor or street level floor within a structure, subject to issuance of a conditional use permit in accordance with the provisions of chapter 16 of this title: Banks and financial insfitutions. Beauty and barber shops. Electronics sales and repair shops. Household appliance stores. Liquor stores. Outdoor patios. 12-7B-4: PERMITTED AND CONDITIONAL USES; SECOND FLOOR: A. Permitted Uses; Exception: The following uses shall be permitted on the second floor abe~e-gFawithin a structure; provided, however, that a conditional use permit wil/ be required in accordance with chapter 16 of this title for any use which eliminates any existing dwelling or accommodation unit or any portion thereof.• 1. Multiple-family residential dwelling. 2. Lodges. 3. Professional otfices, business offices and studios. 4. Banks and financial institutions. 5. Persona/ services and repair shops, inc/uding the following: Beauty and barber shops. Business and office services. Tailors and dressmakers. Travel and ticket agencies. 6. Retail stores and establishments, including the following: Apparel stores. Art supp/y stores and galleries. Bakeries and confectioneries. Bookstores. Camera stores and photographic studios. Candy stores. Chinaware and glassware stores. Delicatessens and specialty food stores. Drugstores. Florists. 4 Ordinance No. 39, Series of 2007, second reading Gift shops. Hobby stores. Conditional Uses: The following uses shall be permitted on second floors abeve-grade, subjecf to the issuance of a conditional use permit in accordance with the provisions of chapter 16 of this title: Dog kennels. Electronics sales and repair shops. Household appliance stores. Liquor stores. Luggage stores. Meeting rooms. Outdoor patios. Theaters. Type !ll employee housing units (EHU) as provided in chapfer 13 of this title. 12-76-5: PERMITTED AND CONDITIONAL USES; ABOVE SECOND FLOOR: A. Permitted Uses: The following uses shall be permitted on any floor above the second f/oor abeve-gFade: Lodges. Mulfiple-family residential dwellings. Type IV employee housing units, as further regulated by chapter 13 of this title. 8. Conditional Uses: The following uses shall be permitted on any floor above the second floor abevegrade, subjecf to the issuance of a conditional use permit in accordance with the provisions of chapter 16 of this title. Any permitted or conditiona/ use which eliminates any existing dwelling or accommodation unit, or any portion thereof, shall require a conditional use permit. Such uses may include: 1. Retail stores and establishments, inc/uding the following: Apparel stores. Art supply stores and galleries. Bakeries and confectioneries. Bookstores. Camera stores and photographic studios. Personal services and repair shops, including the following: Beauty and barber shops. Business and office services. Small appliance repair shops. Tailors and dressmakers. Travel and ticket agencies. 6. Theaters. 7. Additional uses determined to be similar to permitted uses described in subsections B 1 through 85 of this section in accordance with the provisions of section 12-3-4 of this title, so long as they do not encourage vehicular traffic. 8. Multip/e-family residentia/ dwelling units, timeshare units, fractional fee clubs, lodge dwe/ling units, and emp/oyee housing units (type lll (EHU) as provided in chapter 13 of this title). Radio, TV stores, and repair shops. Theaters. Additional uses determined to be similar to condifional uses described in this subsection, in accordance with the provisions of section 12-3-4 of this title. 12-7H-3: PERMITTED AND CONDITIONAL USES; FIRST FLOOR OR STREET LEVEL: „ • " AgWeet " er- A. Type IV employee housing units, as further regulated by chapter 13 of this title. Additional uses determined to be similar to permitted uses described in this subsection, in accordance with the provisions of section 12-3-4 of this title. ~G, B. Conditiona/ Uses: The following uses shall be permitted on the first floor or street level floor within a structure, subject to issuance of a conditional use permit in accordance with the provisions of chapter 16 of this title: Accommodation units. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 6. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 7. The amendment of any provision of the Town Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision amended. The amendment of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 8. All bylaws, orders, resolutions and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency.
