Dear Bruce:
I received your letter dated December 6, 2001 with regard to the duplex residence located at 748 Potato
Patch Road.
On March 12,1996, the Town of Vail Community Development Deparnnent received an application to add
a single car garage and convert an existing garage to living area. The applicant was proposing to utilize the
250 Additional GRFA provisions of the zoning regulations to faciliate the cotrvercion.
On May 13,1996, the Town of Vail Planning & Environmental Commission approved the 250 request with
one condition. The condition required the applicant add more landscaping to screen the foundation portion
of the new addition.
On May 14, 1996, I staff approved the applicant's Design Review Board application. The staff approval
was conditioned upon the applicant planting five (5) additional bushes/shrubs along the west elevation of
the building foundation prior to approving a TCO for the construction.
Pursuant to our zoning regulations at the time ofthe approval, in part, "The applicant must obtain a
building permit within one year offnal Planning & Environmental Commission approval or the approval
for additional GRFA shall be voided."
Furthermore, the rcgulations state, again in part, "Approval of the design (Design Review) ofa project as
prescribed by this Chapter shall lapse and shall become void one year following the date offnal approval
of the project unless pior to expiration of one year, a building permit is issued and construction is
commenced and diligently pursued toward completion. "
Therefore, it is the position of the Community Development Department that the approvals of 1996 are now
null and void.
