Scope of Work
Per your request, and under the guidelines defined, HERRONO Enterprises USA, Inc. (HERRONO) has concluded the
Environmental Consultation/Limited Asbestos Building Inspection at the aforementioned property.
Local, state and/or federal regulations, including but not limited to the Air Quality Control Division (AQCC) Regulation 8,
OSHA 1926.1101, and EPA (NESHAP) 40 CFR Part 61 may require a comprehensive asbestos inspection prior to a
renovation or demolition. This inspection requires an AHERA and State certified asbestos building inspector identifying and
sampling any friable and non - friable asbestos containing materials which could be affected by the activity.
HERRONO was contracted by the Client, to perform:
a Environmental Consultation/Asbestos Services, Limited Asbestos Building Inspection, specifically tailored to Friable
and Non - Friable Suspect Asbestos Containing Materials (ACM), associated with the aforementioned property,
specifically;
Client directed Limited Asbestos Building Inspection prior to a renovation of `Commercial Property', Surefoot, 278
Hanson Ranch Road, Vail, CO 81657 as follows:
Yellow Fiberglass Insulation in Back Room
Light Blue Textured Drywall/Joint Compound Walls in Front Room
Multi Colored Smooth Drywall/Joint Compound Walls in Front Room
Black Cove Base /Adbesive in Front Room

HERRONO was subsequently contracted by the Client, to perform:

Conclusion
Based on the information generated by this report, we conclude that the aforementioned property does not Contain
Regulated Asbestos Containing Material(s) (RACM), however, may have Regulated Asbestos Containing Material(s)
in other locations in accordance with local, state, and/or federal regulations for purposes of a renovation or demolition
(when conducted in accordance with local, state and/or federal regulations).

Materials that contain < =1.0% Asbestos are not considered Asbestos Containing Materials by NESHAPS or EPA but may
still be covered by OSHA. OSHA regulations may apply during potential disturbance activities.
Although a material may have been determined to contain < =1.0% Asbestos, or during a demolition, if the composition of
drywall/joint compound (when the joint compound does not cover the entire surface) has been determined to contain < =1.0%
Asbestos, this document serves as a Hazard Communication and should be followed during an activity such as a renovation
or demolition, to ensure that an exposure does not occur. The Maximum Allowable Asbestos Level (MARL) may not be
exceeded at `any' time in accordance with local, state, and/or federal regulations, including but not limited to AQCC
Regulation 8 (State), 29 CFR 1926.1101 (OSHA), 40 CFR Part 61 EPA (NESHAP), and 40 CFR 763 EPA ( AHERA).

Suspect materials which were not within the Scope of Work at the time of the inspection were:
1. `All' EPA suspect Materials not requested.
2. `Any' confirmed or suspect ACM which may have been concealed at the time of the inspection.
3. During a normal inspection, and more specifically when non - destructive sampling techniques are employed, it is not
within the scope of the inspection to remove surface materials to inspect the structures and/or materials which may be
under the surface, i.e., within or under concealed areas such as under carpet, under sub - floors, within chases, walls,
crawlspaces, tunnels, etc., to remove suspect Asbestos Containing Material(s), to move and/or sample electrical wiring
which has not been 'locked out', etc. All said areas are to be assumed as containing >1.0% Asbestos, until such a time
that these areas are made accessible, and/or rendered safe so that sampling can be performed.
4. HERRONO recommends extreme caution during a renovation or demolition of these areas in the event that an area
which was not suspect, visible, accessible and/or specified during the inspection, is discovered to contain or is suspected
of containing an Asbestos Containing Material (ACM). Under local, state and/or federal regulations, should such an
event occur, the Client and or Contractor is required to cease operations which may effect this (these) material(s) until an
inspection is concluded and a determination is made by an AHERA and State Certified Asbestos Building Inspector.

5. It is expressly advised that although this is a Limited Asbestos Building Inspection, it is a limited inspection which is
designed to indicate the presence of Asbestos Containing Materials in the Building(s), and under normal the guidelines
defined, specific samples and locations have been instructed and authorized by the Client. Although some materials may
indicate that Asbestos is not present in this report, and under the protocol of limited sampling whereas not `all' suspect
materials were sampled, under local, state and/or federal regulations, including but not limited to AQCC Regulation 8
and OSHA 29 CFR 1926.110 1, a certain protocol for sampling, number of samples obtained, and assessment is required.
6. Disturbance of these areas could create a potential health hazard.
Suspect materials which were visually inspected and determined to be Non -ACM materials at the time of the inspection were:

Inspection Methodology:
HERRONO selected sample locations and frequency of sampling based on observations, Client requirements and /or
the assumption that like materials in the same area are homogeneous in accordance with EPA Publication EPA 560 /
5 -85 - 030a `Asbestos in Buildings: Simplified Sampling Scheme'.
Recommendations
As Regulated Asbestos Containing Materials were not discovered during this inspection, further action is not required.
Should a renovation or demolition occur which would affect materials that were not homogeneous to the materials which
were inspected and determined negative for Asbestos, HERRONO would recommend as a minim Plan of Action:
1. Comprehensive Asbestos Building Inspection: a continuous process in areas which may not have been accessible, or
for materials which may have been concealed in previous inspections, may be required, i.e., review and usage of previous
Asbestos Inspection(s), identification of suspect materials, friable and non - friable, approximate quantities (ACM),
discovery sampling in areas which will be affected by the renovation/demolition in order to determine the presence of
Asbestos Containing Materials (ACM), etc.
Assumptions, and Limitations
This Environmental Consultation is applicable in whole, not in part, to the entire contents of the document, and the
assumptions, and limitations of current published Terms of Services.

Reservoirs Environmental, Inc. has analyzed the following samples for asbestos content as per your
request. The analysis has been completed in general accordance with the appropriate methodology as
stated in the attached analysis table. The results have been submitted to your office.

and the sole property of the customer. Reservoirs Environmental, Inc. will not discuss any part of this study

How it relates to Building Permits:
Fill out the attached check list with the Building Permit Application
If yes was answered to any of the questions then a "Public Way" permit is required. You can pick up an
application at either Community Development, located at 75 South Frontage Road or Public Works, located at
1309 Elkhorn Drive.
Notice sign -offs for utility companies. ALL utilities must field verify (locate) respective utilities prior to signing
application. Some utility companies require up to 48 hours notice to schedule a locate.
A construction traffic control /staging plan must be prepared on a separate sheet of paper. An approved site plan
may also be used. This plan will show locations of all traffic control devices (signs, cones, etc.) and the work
zone, (area of construction, staging, etc.). This plan will expire on November 1s` and will need to be resubmitted
for consideration for approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width and depth of work).
This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Works office for review. If required, locates will be scheduled for the
Town of Vail electricians and irrigation crew. The locates take place in the morning, but may require up to 48
hours to perform.
The Public Works Construction Inspector will review the application and approve or deny the permit. You will be
contacted as to the status and any requirements that may be needed. Most permits are released 48 hours of
being received, but please allow up to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the "Building Permit" to be
released. Please do not confuse the "Public Way Permit" with the "Building Permit ".
NOTE: The above process is for work in a public way ONLY. Public Way Permits are valid only until
November 15 A new Public Way Permit is required each year if work is not complete. Re-
application each November 15 does not mean an automatic renewal.

The Town of Vail Building Department has developed the following procedures to ensure that new construction
sites have adequately established proper drainage from building sites along and adjacent to Town of Vail roads or
streets.
The Town of Vail Public Works Department will be required to inspect and approve drainage adjacent to Town of
Vail roads or streets and the installation of temporary or permanent culverts at access points from the road or
street onto the construction site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other inspection. Please call Leonard
Sandoval at 970 - 479 -2198 to request an inspection from the Public Works Department. Allow minimum of 24
hour notice.
Also, the Town of Vail Public Works Department will be approving all final drainage and culvert installation with
resulting road patching as necessary. Such approval must be obtained prior to any Final Certificate of Occupancy
issuance.

CODE 5 -2 -10: DEPOSITS ON PUBLIC WAYS PROHIBITED
:V Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or deposit, or cause to
be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any other debris or material upon any
street, sidewalk, alley or public place, or any portion thereof.
Notice; Abatement: The Director of Public Works may notify and require any person who violates or causes another
to violate the provision of subsection A hereof, or who has in the Director's employment a person who violates or
causes another to violate the same, top remove such sand, gravel, rocks, mud, dirt, snow, ice or any other debris or
material within twenty four (24) hours after receipt of said notice by the Director of Public Works. In the event the
person so notified does not comply with the notice within the period of time herein specified, the Director of Public
Works, or other authorized agent, may cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other
material to be removed from any street or alley at the expense of the notified.
�( Summons and Penalty: As an alternative to the notice for removal provided in subsection B above, any person
who violates or causes another to violate the same, may be issued a summons to appear before the Municipal Court of
the Town for said violations, and upon being found guilty of a violation hereunder be punished as provided in Section
1 -4 -1 of this code.
Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the Director of Public
Works as provided in subsection B hereof, and any such person shall, in addition to payment of the expense of removal
incurred by the Director of Public Works, as provided in subsection B hereof, upon being found guilty of a violation
hereunder, be punishable as provided in Section 1 -4 -1 of this Code. (1997 Code: Ordinance 6 (1979).
CODES 7 -3A -1 AND 7 -3A -3: PARKING OBSTRUCTING TRAFFIC & IMPOUNDMENT AUTHORIZED
No person shall park any vehicle upon a street or at any other place within this Municipality in such a manner or under
such conditions as to interfere with the free movement of vehicular traffic or proper street or highway maintenance.

Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a street or upon any
place within this Municipality in such a manner as to constitute a violation of any section of this Article, or left
unattended for a period of twenty four (24) hours or more and presumed to be abandoned under the conditions
prescribed by Colorado Revised Statutes section 42 -4 -1102, as amended, the officer shall require the vehicle to be
removed or cause it to be removed and placed in storage in the nearest garage or other place of safety designated or
maintained by this Municipality, and the charges for towing and storage of such vehicle shall be charged to the owner
of the vehicle in addition to a ten dollar ($10) impoundment charge. (Ord. 2(1968) § 3: Ord. 28(1981) § 1)

Vail Village and LionsHead Village Construction Hours
Information Handout
Problem Statement
The Vail Village and LionsHead Village are invaluable assets to the community. Thousands of people come to Vail each year to
sightsee, recreate, shop and to enjoy everything the Vail Valley has to offer. The community and merchants rely upon our guests to
generate revenue. Our summer /winter guests expect a pleasant experience while in Vail.
To insure that all of the proposed construction has as little negative impact on the community and on our guest as possible, the Town
of Vail finds it imperative to create and implement the Vail Village and LionsHead Village Construction Hours Handout.
It would be irresponsible for the Town of Vail, the construction contractors and the merchants, to not actively participate to minimize
the impact of construction in the Vail and LionsHead Village areas.
The Vail Village Streetscape Project will continue through 2006. Improvements scheduled for
2006 will be concentrated along Gore Creek Drive west of the Children's Fountain, Gore Creek
Promenade and around the frontage of the Mill Creek Court Building. Additional streetscape
improvements are scheduled to begin along East Meadow Drive.
All construction projects and /or remodels within the Vail Village Core Area should contact
Scott Bluhm, Town of Vail Streetscape Coordinator, at 970 - 477 -3418 for further information.
Givens
The following givens are intended to provide the basic foundation by which construction will be completed in
the villages:
• The public's health, safety and welfare shall be honored at all times..
• Adequate pedestrian, loading /delivery, vehicle, and emergency vehicle access and circulation shall be
maintained.
• Roadways and pedestrian walkways shall be kept clean and free of dirt and debris.
• All construction deliveries, equipment, tools and materials entering the Vail Village and pedestrian areas
must go through CheckPoint Charlie. All LionsHead construction activity must go to the Vail Police
Department for a parking permit. Do not use delivery zones for construction parking; refer to approved
staging plan or make other arrangements for parking.
• The hours of outside construction activity shall be as follows:
- April 15 — June 23 & September 5 - November 17, 7:00 a.m. until 7:00 p.m., seven days a week.
June 30 thru September 1, work must end by 4:00 p.m. on Fridays.
November 13 — April 15, 2007 work allowed within daylight hours only.
- Deliveries shall be restricted to the hours of 7:00 a.m. to 11:30 a.m. on Gore Creek Drive and 7:00 a.m.
to 8:30 a.m. on Bridge Street.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works) review and approval,
a Planning Department review or Health Department review, and a review by the Building Department, the
estimated time for a total review will take as long as three (3) weeks.
All commercial (large or small) and all multi - family permits will have to follow the above mentioned maximum
requirements. Residential and small projects should take a lesser amount of time. However, if residential or
smaller projects impact the various above mentioned departments with regard to necessary review, these
projects may also take three (3) weeks to review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

4. HERRONO recommends extreme caution during a renovation or demolition of these areas in the event that an area
which was not suspect, visible, accessible and/or specified during the inspection, is discovered to contain or is suspected
of containing an Asbestos Containing Material (ACM). Under local, state and/or federal regulations, should such an
event occur, the Client and or Contractor is required to cease operations which may effect this (these) material(s) until an
inspection is concluded and a determination is made by an AHERA and State Certified Asbestos Building Inspector.

5. It is expressly advised that although this is a Limited Asbestos Building Inspection, it is a limited inspection which is
designed to indicate the presence of Asbestos Containing Materials in the Building(s), and under normal the guidelines
defined, specific samples and locations have been instructed and authorized by the Client. Although some materials may
indicate that Asbestos is not present in this report, and under the protocol of limited sampling whereas not `all' suspect
materials were sampled, under local, state and/or federal regulations, including but not limited to AQCC Regulation 8
and OSHA 29 CFR 1926.110 1, a certain protocol for sampling, number of samples obtained, and assessment is required.

Recommendations
As Regulated Asbestos Containing Materials were not discovered during this inspection, further action is not required.
Should a renovation or demolition occur which would affect materials that were not homogeneous to the materials which
were inspected and determined negative for Asbestos, HERRONO would recommend as a minimum Plan of Action:
1. Comprehensive Asbestos Building Inspection: a continuous process in areas which may not have been accessible, or
for materials which may have been concealed in previous inspections, may be required, i.e., review and usage of previous
Asbestos Inspection(s), identification of suspect materials, friable and non - friable, approximate quantities (ACM),
discovery sampling in areas which will be affected by the renovation/demolition in order to determine the presence of
Asbestos Containing Materials (ACM), etc.
Assumptions, and Limitations
This Environmental Consultation is applicable in whole, not in part, to the entire contents of the document, and the
assumptions, and limitations of current published Terms of Services.

1 have inspected the installation of the ducting system for the Surefoot retail space on 10/27/06.
The owner requested that the ductwork into the showroom be minimized and changed from the
engineered plans. With the reduced ducting the system will provide adequate heating for the
space.
I am also aware that the fan coil unit has been installed upside down to provide access to the unit.
It is my understanding that the blower motor has been reinstalled since orientation of this motor
is critical for proper long term operation. 1 am unaware of any other reasons which would
preclude proper operation of the fan coil in the current orientation; however the manufacture

MFH OPERATION & MAINTENANCE
DESCRIPTION
An MFH terminal may be used as a horizontal (ONLY) furnace or blower heater. When used with a remote
primary air damper, the discharge of the MFH unit is inserted into the low pressure duct work down stream
of the primary air damper.
INSPECTION AND HANDLING
Immediately inspect each unit for damage upon receipt. File damage claims with the freight carrier and
advise the shipper. Store in a clean dry location and do not stack units or cartons more than four high.
Do not lift units by the collars.
INSTALLATION
A. Before installation, remove packing and all foreign material from unit
B. Suspend unit from building structure in a horizontal plane with access panels on the sides. Do not
obstruct access panels with support channels, straps or T -bar supports.
C. Check blower wheel for free rotation.
D. Slip flexible or hard duct over inlet collar. Fasten and seal connections to prevent leakage. Close
coupling of the inlet to main supply duct is not recommended. For optimum control, allow at least 1 1/2
duct diameters up stream of the inlet to be straight and unrestricted.
E. Connect outlet end of the assembly using low pressure insulated duct. Fasten and seal all joints to
prevent leakage.
F. Filters must be installed where required. ( Highly recommended on units with hot water coils).
G. Thermostat must be calibrated and in control at desired setting.
H. Duct work and duct connections must be tight and free from leaks.
1. All foreign materials must be removed from duct system.
Maintenance
Filters - Disposable filters should be changed and washable filters should be cleaned a minimum of twice
per heating season to avoid excessive restriction of air flow. If excessive accumulation is noted due to dusty
environment, change filters more frequently.
Blower and Motor- Fan terminals are supplied with PSC motor. Inspect motor assembly at least twice a
year. Motors are permanently lubricated for normal lifetime use However if lubrication is required oil motor
with two drops of 3 -in -1 oil or 10 weight oil. Clean as necessary. Motors and blowers are mounted on a motor
plate assembly located behind access panel. Motor has built in thermal overload which automatically
resets after a short time.
CAUTION
Electrical requirement
A. Provide a safety disconnect per NEC 424 -19, 20 & 21.
B. Disconnect incoming power before wiring or servicing unit.
C. All field wiring must be in accordance with NEC and local requirements. All units with electric heat
should have copper wire sized at least 125% of nameplate amperage.
D. Observe wiring diagram and instructions mounted on the unit. 208/480/3 Phase wire units require a 4th
wire (NEUTRAL) wire in addition to the full sized ground wire. All units must be grounded as required by
NEC 424 -14 and article 250.

The fan pac offers the advantages of eliminating large and unsightly roof -top package equipment, and through the roof duct systems which require costly
installations with greater horsepower requirements.
Commercial or Industrial Unit Heaters:
Since the fan pac incorporates a centrifugal blower designed to operate at static pressures of up to .70 inches w g., it isideally suited for hanging in unused
overhead spaces and forcing the warm air to occupied Floor areas. Ductwork can also be utilized to circulate the heated or ventilated air overlarge areas that may
not be in the vicinity of the fan pac.

Specifications:
The fan packages shall be factoryassembled complete with electric heat/hot water coils. Factory mounted control panel shall provide all internal control and fan power
wiring for a single point field connection. An optional factory mounted disconnect switch shall be furnished and prewired so as to disconnect all electrical components
in the fan package A single point field connection will be made at the disconnect switch. Fan package must be labeled and listed by a nationally recognized and locally
accepted testing laboratory, such as ITS Intertek testing services. Fan packages must be tested for safety and in accordance with the latest National Electric Code

Stan,
Thanks for making us aware of the !EEC energy saving code that the town has
adopted. Unfortunately, the electrical plans that I enlisted Rader Engineering to
develop based on the requirements of the project designer do no comply with
this code.
To come into compliance, the designer has elected to install eight (8) two lamp
fluorescent fixtures and sixteen (16) 70 watt metal halide fixtures in lieu of the
quantities of fixtures originally shown on the plan.
As the lighting track the fixtures are installed on will remain the two circuit
type,the lighting will be capable of two level switching. In reviewing the code, I
am unsure if automatic shutoff control if necessary. We could install a
occupancy sensor if required. Please advise.
I have attached the executed IECC Lighting Compliance Certificate for your
review and use. Please call with any questions or if you need any additional
information.
