Applicant: Vail Valley Medical Center Planner: Jonathan Spence Motion: Continue to August 14, 2017 First: Gillette Second: Stockmar Vote: 6-0-0 Spence introduced the project by summarizing the previous three (3) meetings at August 1, 2017 - Page 9 of 65 which the Vail Valley Medical Center (VVMC) Master Plan implementation was discussed. Three areas of focus for this meeting are: relationship of building to Meadow Drive, overall architectural approach, and pedestrian circulation. The applicant's representative, Tom Braun of Braun Associates, Inc., provided a PowerPoint presentation to the Planning and Environmental Commission (PEC). Braun summarized the project timeline and anticipated topics for future meetings. Braun stated that the PEC is responsible for establishing the development standards within the General Use (GU) District. Standards discussed included: site coverage (approximately 62%), landscaping (12%), and building height (approximately 75' 3" at the helipad, 59' is the tallest floor of the building), and setbacks (north: 2' — 9', south: 4', east: 20', and west side near Evergreen Lodge: 1/2'). Braun described the hospital operations and other programming factors that led to the design of the proposed site plan. Braun reviewed the floor plans to explain VVMC's operations and intentions for new space. The proposed parking garage was also reviewed. Gillette — Asked for clarification regarding the proposed building setbacks. Braun summarized the elements of the VVMC Master Plan that are relevant to the proposed architecture, massing, height, orientation to Meadow Drive, utility screening, and pedestrian connections. Gillette — Asked for clarification of the maximum allowable height for properties surrounding the VVMC. Braun and Spence provided the allowable heights based on zone districts. Hopkins — Asked for clarification in regards to the loading dock. Spence and Gillette asked Braun to identify the location of sidewalks and pedestrian circulation routes. Braun identified said areas and stated that more information regarding the pedestrian connections to surrounding properties would be provided at the next PEC meeting. Kurz — Asked for clarification in regards to loading operations and details on the proposed stairwells. Kurz asked if the applicant considered an escalator instead of a stairwell. Gillette added that the stairwell will also see a lot of skier traffic. Spence identified the areas for accessible access to VVMC. Public Comment: There was no public comment. Stockmar — Commended the VVMC on their planning effort, but is concerned in the long run that VVMC will need to expand again. He stated his appreciation for the efforts to accommodate the residential neighbors and South Frontage Road. Braun stated that the VVMC is looking into the future and beyond the existing Master Plan. Future areas for further expansion have already been identified. Spence asked Stockmar for his opinion on the extensive use of glass. Stockmar stated his belief that there is a glazing available to minimize light pollution from the interior. Braun August 1, 2017 - Page 10 of 65 deferred the item until the next time the project architects would be at the PEC meeting. Gillette — Stated his belief that the amount of glass was appropriate on the south facade, but not there may be too much glass on the north facade. Recommends the Design Review Board (DRB) look at the issue as the architecture is not necessarily representative of Vail. Perez — Agrees with Stockmar that a lot has been done to address concerns. Stated she likes Hopkins' earlier suggestion to bring some green elements to the deck on the south facade. Hopkins — Agrees with Gillette that the north side of the structure uses too much glass. There was also a discussion among Commissioners regarding the use of corten steel on the various facades. Lockman — Agreed with other Commissioners' comments regarding an appreciation of the efforts to address concerns thus far. He is still concerned about pedestrian circulation in the general area of the site. He asked if the pedestrian paths and patio will be heated. Chris Knight with ProjectOne responded that the patio will be heated from below. Several commissioners suggested umbrellas for providing shade on the patio in the summer. Kurz — Stated that he appreciates the applicant listening to the PEC's previous comments. He is not concerned about the overall massing of the building, but is more concerned about the area near Meadow Drive and the incorporation of fenestration and landscaping. He is not concerned about the interior circulation and is pleased with the overall direction of the project. 4. A request for review of an amendment to a conditional use permit pursuant to Section 12-16-10, Amendment Procedures, Vail Town Code, to allow for the construction of an outdoor dining patio at La Cantina Restaurant, located at 241 East Meadow Drive/Tract B & C, Vail Village Filing 1, and setting forth details in regard thereto. (PEC17-0026) 60 min. Applicant: Dominick Architects Planner: Chris Neubecker Motion: Approve, with Conditions First: Stockmar Second: Gillette Vote: 6-0-0 Conditions: 1. This Conditional Use approval is contingent upon the applicant obtaining Town of Vail approval of an associated design review application on or before November 1, 2017. 2. The applicant shall operate the outdoor patio consistent with the approved site plan dated July 14, 2017 and attached to this memorandum. August 1, 2017 - Page 11 of 65 3. Hours of operation for the outdoor dining patio shall be limited to 8:00 AM until 10:00 PM. 4. All exterior lighting for the outdoor dining patio shall meet the Town of Vail's Outdoor Lighting regulations. 5. The applicant shall ensure that sweeping of the patio is performed on a daily basis, and that all food scraps and other debris from the patio are collected and deposited in proper waste receptacles, and that food scraps and other debris are not swept or pushed off the patio onto the adjacent walkways or landscaping areas. 6. Approval of this conditional use permit amendment shall lapse and become void if a building permit is not obtained and construction not commenced and diligently pursued toward completion or the use for which the approval has been granted has not commenced within two (2) years from when the approval becomes final. 7. Approval of this conditional use permit amendment shall lapse and become void if the use for which the approval has been granted is discontinued for a period of two (2) years, regardless of any intent to resume operation of the use. 8. The applicant shall at all times abide by the Town of Vail Amplified Sound regulations in Section 5-1-7 Noise Prohibited, Vail Town Code. The applicant shall obtain a permit from the Town of Vail prior to installation of any outdoor speakers on the outdoor dining patio. 9. Prior to issuance of a building permit for construction of the outdoor dining patio, the applicant shall obtain a lease agreement from the Town of Vail for use of the patio area. Neubecker introduced the item by summarizing the comments from the previous PEC meeting on July 10, 2017 and the subsequent changes that resulted from said comments. Changes include: additional landscaping with more vibrant colors, a skirt below the patio to prevent pedestrian access, additional snow fencing above the awning roof, and more information on the applicant's intent to heat the patio. The applicant may have to provide their own boiler to heat the patio. There are still some structural questions that the applicant is working on addressing. Neubecker reminded the PEC that the project still requires DRB approval and that the Town Council makes the final decision on the application. Neubecker discussed the proposed conditions of approval found within the staff memo. The applicant's representative, Rick Dominick of Dominick Architects, further reviewed the proposed changes. In regards to landscaping, the intent was to make the area more visually dynamic. Dominick described the dimensions of the space underneath the patio and assured the PEC it would be difficult to access the area. August 1, 2017 - Page 12 of 65 Lockman — Asked Neubecker to further explain his concerns regarding the eastern planter area adjacent to the stairs. Neubecker stated that he wants to make sure plants are viable for the proposed width and slope of the planter. Lockman stated the importance to have sufficient screening between the patio and the stairs. He believes the revised landscape plan has addressed previously stated concerns. Stated that he believes the project meets the criteria for a conditional use permit. Hopkins — Asked if the new landscaping will be sufficiently irrigated. Dominick confirmed. Hopkins stated she supports the request. Perez — Asked if alcohol will be served on the patio. Dominick confirmed that it will be full service, including alcohol. Richard Wheelock of La Cantina stated that the whole floor is covered by their liquor license. Dominick added that there is a gate that will control access into the patio. Dominick also stated that the flow of traffic through the transportation center will not be affected. Gillette — Had no additional comments or questions. Stockmar — Stated his overall satisfaction with the revised landscape plans, but asked that even more landscaping be added. Stated that the snow fencing was a reasonable solution to protecting guests from accessing the awnings. He also, asked if there will be space heating on the patio. Wheelock confirmed. Kurz — Urged the applicant to fully consider the effectiveness of the proposed skirt / screening intended to keep the public from accessing underneath the patio. He stated his overall support for the project. There was no public comment. 5. A request for review of a Minor Amendment to Special Development District (SDD) No. 34, The Valley, Phase V, pursuant to Section 12-9A-10, Amendment Procedures, Vail Town Code, to allow for modifications to the approved development plans in order to permit a second road cut and access to the property located at 1521 Buffehr Creek Road/Lot C, The Valley Subdivision Phase V, and setting forth details in regard thereto. Applicant: Planner: Motion: First: RKD Architects Chris Neubecker Continue to August 14, 2017 Gillette Second: Hopkins Vote: 6-0-0 Neubecker summarized the request and how it relates to Items 6 and 7 on the agenda and why one item is withdrawn and the other two (2) will be continued to the next PEC meeting. He then asked for questions specifically about the SDD amendment process. Stockmar — Stated that it would be helpful to understand what the process or August 1, 2017 - Page 13 of 65 rationale is for placing the building envelope on the site. Gillette — Agreed with Stockmar's comment. Perez — Asked if there were plans for the home. Neubecker responded in the negative. Neubecker stated that the SDD has to be amended first to allow for a second curb cut within the SDD. Kurz — Asked if PEC's decision is final or if it goes to Town Council. Neubecker responded that as a minor amendment, staff has approved the item, but it can be called up by the PEC. The applicant had no formal presentation. There was no public comment. 6. The addition to the school will allow for a secure entry, plus expansion of the cafeteria service area and expansion of the library. Cosmetic changes are also proposed to the school. A four-story parking structure with 160 parking spaces is also proposed. Skier and public parking is proposed on the first 3 levels of the structure. The intent is to sell parking passes for use of the public parking. There are six (6) electric vehicle charging stations proposed. Solar panels are proposed on the south elevation of the parking structure. A one way road system is proposed, most traffic will turn right as they enter the site, but some cars can turn left to access level two of the parking structure. There are also 42 surface parking spaces on site. Panfil discussed the parking circulation options for the parking structure, with no internal ramps. He reviewed the landscaping plan, with some new landscaping proposed in front of the structure, and some landscaping near the south side of the school. A more prominent entry feature and more glass are proposed at the new school entry. Stone is also proposed, along with some wood. Panfil reviewed the elevations of the school and the floor plans to show where changes are proposed. Town Council has asked that the parking structure be designed to accommodate future structure on top, possibly affordable housing or school expansion, but such uses have not been designed or planned. He showed a shadow analysis of impacts of the parking structure on the school. No shadow is anticipated on the school building. Entrance to the third level of the garage should come from below, where there are no kids or faculty. Not appropriate for all this traffic near kindergarten kids. Mason — It's not geared toward public parking for skiers, but people who currently arrive and park at Ford Park. Instead, they would park here. Gillette — Likes the rail to separate sidewalk from the road, but where will the snow be pushed. Asked if a snow storage study has been conducted? Mason — Yes Hopkins — Doesn't like the emergency stairwell. Mason — There is access to allow access and egress to the garage. Gillette — Need to separate school from public parking and circulation. Only kids, parents, and faculty should be at the school level. Average guy parking in the structure should be separate from the school level. Perez — Need more information on use of the parking structure. Is this open to the public? Greg Hall — Parking will be automated, similar to Ford Park. Parking passes would be needed to use this parking. Passes can be purchased by locals, employees. Gillette — Need to separate parking for the public from the school users. Drive lane is right next to the sidewalk to the school. Rachel Hall, TAB Associates — Reviewed the parking circulation and peak use times of the school and parking structure. Kurz - There is a high level of concern for public safety and children's safety. Gillette — Cannot support unless you can separate school uses from public parking uses of the parking structure. Panfil — We are looking for any other feedback from the PEC on items of concern. Stockmar — Kids have a tendency to put themselves in jeopardy. More care is needed on the traffic circulation and kids' safety. Prefer to see better design on the parking structure. Gillette — Massing on the building is fine. Main concern is separation of public August 1, 2017 - Page 16 of 65 parking from the school. Perez — Agree, make the parking structure more attractive and separate school from public parking. Hopkins — Look at use of the parking structure as a short cut for kids to use. Lockman — Looks like low budget based on architecture of the parking structure. Kurz — Appreciate the Town of Vail and Eagle County School District working together on a parking plan for this area, and that the school will remain in this location. PURPOSE The purpose of this worksession is to engage the Vail Town Council in a discussion regarding the Town's policy concerning the regulation of commercial ski storage, ski valet and ski concierge services. The desired outcome of this discussion is for the Town Council to articulate their policy on this issue in order to facilitate possible amendments to the Vail Town Code. These amendments, if they were to occur, would be reviewed by the Planning and Environmental Commission for a recommendation prior to returning to the Town Council in the form or an ordinance. Staff encourages a policy that is focused on the following elements: • Guest Service consistent with the Vail Brand; • Considerate to existing and future business models; • Considerate of the aesthetic expectations of our guests and residents; • Considerate of pedestrian and vehicular safety; and • A policy that is fair, consistent, understandable and easily enforceable. To this end, staff has provided the following information in this memorandum: • A problem statement that explains the necessity for this discussion; • An opportunity statement that encapsulates the intent and desired outcome of this exercise; • Explanation of existing regulations pertaining to this issue and their history; • Results of interviews conducted with lodging properties and ski store operators in July 2017; and • Questions to assist the Council in communicating their desired policy that is in the best interest of the Town of Vail, its businesses, residents and guests. PROBLEM STATEMENT The Town of Vail and its regulations have not kept pace with the evolving nature of the ski industry, specifically ski storage, ski valet and ski concierge services. As a result, the Town is experiencing the following challenges: • A policy that is inconsistent with evolving customer expectations; • A policy that is difficult and/or impractical to enforce, resulting in a perception of inconsistent enforcement; and • A policy that may have resulted in unintended consequences, most notably considerable storage of ski equipment outside that has both safety and aesthetic implications. III. OPPORTUNITY STATEMENT Since 1962, Vail's commercial core areas have been purposefully planned to complement skiing and other forms of recreation on Vail Mountain. Known for its innovative and forward -thinking master planning, Vail has since laid claim to its preeminent position as the premier international mountain resort community. Much of this success can be credited with town government policies and regulations that are fundamental in maintaining a high level of vibrancy in Vail Village and Lionshead. In particular, the use of horizontal zoning has provided for dynamic retail first -floor storefronts that have been essential in maintaining Vail's pedestrian character while contributing to our economic viability via sales tax collections. This is why real estate sales and professional offices have been prohibited on the first floor of commercial core areas as well as commercial ski storage. Limited to the basement or garden levels in Vail since 1989, Vail's commercial ski storage policy has served the community well — until recently — when expectations of Vail's guests have surpassed the town government's regulatory policies. To compensate, many retailers have expanded their business models in anticipation of meeting and exceeding the full-service, concierge expectations of our guests. In many cases, ski rentals, sales, displays, tuning, storage, clubs and other services are being blended to meet these ever-increasing guest demands. As a result, fair and equitable enforcement of the 1989 commercial ski storage regulations has become increasingly difficult for the town as the location of commercial ski storage has become indistinguishable. Here too, safety is being jeopardized in some instances as skis are being stored or displayed on Town of Vail right-of-way which blocks pedestrian access and emergency vehicles. As Vail looks to the future to continue its position as the premier international mountain resort community, the opportunity is here to work with the business community to redefine the town government's regulatory policies and practices to set the industry standard for exceptional guest service without compromising Vail's vibrant commercial core and its associated tax base. As such, any new policies that are contemplated must Town of Vail Page 2 August 1, 2017 - Page 21 of 65 be clear, fair, easy to enforce, provide for the public's safety and maintain Vail's dynamic retail setting. IV. EXISTING REGULATIONS The following provisions of the Vail Town Code are relevant to the review of policy for ski storage, ski rental, ski valet/concierge service, etc.: Title 12 — Zoning Regulations, Vail Town Code Chapter 2, Definitions (in part) 12-2-2: DEFINITIONS OF WORDS AND TERMS: BASEMENT OR GARDEN LEVEL: For the purposes of implementing horizontal zoning, basement or garden level shall be any floor, or portion of any floor, of a structure located below the first floor or street level of that structure, as determined by the administrator. More than one floor, or portions of a floor or floors, may be defined as basement or garden level within a single structure. For the purposes of determining floor level, the following factors may be considered: site topography, location of building entrances and facades relative to the adjacent vehicular or pedestrian ways, interior building layout, proximity to adjacent vehicular or pedestrian ways and relationships to other floors in the structure. COMMERCIAL SKI STORAGE / SKI CLUB: Storage for equipment (skis, snowboards, boots and poles) and/or clothing used in skiing related sports, which is available to the public or members, operated by a business, club or government organization, and where a fee is charged for hourly, daily, monthly, seasonal or annual usage. This use may have, but does not require, the following components: A. Personal lockers, 8. Boot dyers, C. Ski storage racks, D. Ski tuning, E. Food and beverage service, F. Areas for congregation and/or socializing, G. Restrooms and/or shower facilities, H. Nonwinter activities, 1. Concierge ski services, J. Retail sales, K. Business center. Ski storage that is part of a lodge, or dwelling unit, in which a fee is not charged, is not considered commercial ski storage / ski club. Town of Vail Page 3 August 1, 2017 - Page 22 of 65 FIRST FLOOR OR STREET LEVEL: For the purposes of implementing horizontal zoning, first floor or street level shall be any floor, or portion of any floor, of a structure located at or nearest to (either above or below) the level of the adjacent vehicular or pedestrian way, as determined by the administrator. More than one floor, or portions of a floor or floors, may be defined as basement or garden level within a single structure. For the purposes of determining floor level, the following factors may be considered: site topography, location of building entrances and facades relative to the adjacent vehicular or pedestrian ways, interior building layout, proximity to adjacent vehicular or pedestrian ways and relationships to other floors in the structure. OUTDOOR DISPLAY: A temporary outdoor arrangement of objects, items, or products representative of the merchandise sold or rented by a retail establishment, and further regulated by Section 12-14-21, Vail Town Code. Title 8 — Public Ways and Property, Vail Town Code Chapter 7, Outdoor Display of Goods (in part) 8-7-3: OUTDOOR DISPLAY OF GOODS REGULATED: It shall be unlawful to place or maintain any outdoor display of goods on town owned property or on other publicly owned sidewalks or rights of way without complying with the provisions of this chapter. 8-7-4: PERMIT REQUIRED: It is unlawful for any person or retail establishment to utilize town owned property or other publicly owned sidewalks or rights of way without first securing an outdoor display on public property permit. Such permit shall be issued by the administrator and shall be pursuant to the requirements of this chapter. Permits may be approved for a time period of up to two (2) years. Permits shall be automatically renewed for additional two (2) year terms unless otherwise terminated. Prior to final approval of a permit, the retail establishment shall enter into a license agreement with the town of Vail, to be executed by the town attorney. Permit applications, application requirement, application fees and license fees are on file with the department of community development. 8-7-6: CRITERIA FOR DECISION: Outdoor display of goods on town owned property or on publicly owned right of way shall be lawful at specific locations for use by a specific retail establishment approved by the administrator. Retail establishments may be allowed to utilize town owned property for the use of outdoor display should the following conditions be met: Town of Vail Page 4 August 1, 2017 - Page 23 of 65 A. Zone District: The retail establishment shall be located in one of the following zone districts: 1. Commercial core 1 (CC1) district. 2. Commercial core 2 (CC2) district. 3. Lionshead mixed use 1 (LMU-1) district. 4. Lionshead mixed use 2 (LMU-2) district. 5. Ski base/recreation 2 (SBR2) district. B. Area: The area of town owned property to be utilized shall be a maximum of twenty (20) square feet for retail establishments. Businesses displaying bicycles may be permitted to license additional square footage of town owned property at the discretion of the administrator. C. Location: The property to be licensed shall be a contiguous piece of property that is directly adjacent to the business frontage. D. Circulation: The use of town owned property for outdoor display shall not impede circulation and thus, shall not block or encroach upon the required ingress/egress of doorways, walkways, stairways, and parking or loading/delivery spaces. E. Street And Sidewalk Width: A minimum street width of twenty two feet (22') shall be maintained in order to allow for emergency vehicle access. Sidewalks shall remain a minimum width of six feet (6). Connection of exit discharge to the public way, as required by the adopted building code, shall not be blocked. F. Public Safety: The use of town owned property for outdoor display shall not pose any risks to public safety. The use of town owned property for outdoor display shall not block or encroach upon any fire lane, fire staging area, and shall maintain a minimum distance to fire hydrants of seven feet (7') to side or rear, and fourteen feet (14') to the front. G. Maintenance Access: The use of town owned property for outdoor display shall not block or impede street sweeping, snow removal or snow storage/loading operations. The use of town owned property for outdoor display shall not block access to trash receptacles, dumpsters, mailboxes, manholes, water valves, flowerbeds or other landscape areas. H. Aesthetics: The use of town owned property for outdoor display shall not negatively impact established view corridor or acknowledged "postcard" images and shall not visually detract from, or block, storefront or shop windows. 1. Lack of Available Space: Retail establishments may only be located on a site without twenty (20) square feet of privately owned exterior space adjacent to the business frontage. Town of Vail Page 5 August 1, 2017 - Page 24 of 65 J. Outdoor Display Fixtures: Outdoor display fixtures shall be freestanding, temporary in nature, and shall be removed from the exterior location when the business is closed. K. Code Compliance: All aspects of the outdoor display shall remain in compliance with this code and the Vail comprehensive plan. The definitions of basement or garden level and first floor or street level reference a term, horizontal zoning, which is not defined in the Vail Town Code. The concept of horizontal zoning, or "zoning -by -floor," was first introduced in the Town in 1975. Ordinance No. 16, Series of 1975 established horizontal zoning within the Commercial Core 1 (CC1) District in order to, "promote a variety of retail shops at the pedestrian level." Horizontal zoning was subsequently applied to the Lionshead area in 1978. Ordinance No. 39, Series of 2007, further clarified the Town's use of horizontal zoning by providing the definitions of basement or garden level and first floor or street level. The ordinance states: The intent of this "horizontal zoning" technique is to encourage a vibrant retail environment adjacent to the pedestrian areas of both Vail Village and Lionshead; while also facilitating mixed use developments composed of office, residential and commercial uses. Horizontal zoning is further supported within the Town's master plans. For example, horizontal zoning is cited as a means of achieving Goal Number Two of the Vail Village Master Plan, "to foster a strong tourist industry and promote year-round economic health and viability for the village and for the community as a whole." In addition to increasing street life and vitality, horizontal zoning also allows for the generation of more tax revenue than service-oriented uses. V. BUSINESS COMMUNITY OUTREACH In an effort to better understand the issues that businesses face concerning commercial ski storage, ski concierge services, and ski rentals, the Community Development and Police departments reached out to local ski related businesses to obtain their feedback. The goal of this effort was to hear directly from the people who own and operate ski based businesses in town. This effort allowed the Town to understand how our local businesses operate, store and display equipment, and how the Town can respond to the needs of the business community and the expectations of guests. Town staff organized a questionnaire related to this topic that is included as Attachment A. On July 13, 2017 this questionnaire was mailed to twenty five (25) businesses and lodging properties that participate in providing ski storage, ski valet and ski concierge services. Also on July 13, 2017, the Town of Vail Code Enforcement Officers hand delivered the questionnaire to each establishment. These actions were followed up with phone calls and emails to confirm receipt and to encourage participation. Between July 17th and July 25th, Community Development staff met with eighteen (18) businesses, a participation rate of 72%. The graph and chart below indicate the types and names of those businesses participating. Comments are summarized as follows: • Challenges and Obstacles to Providing a Desired Level of Customer Service o Enforcement of Existing Regulations: Seven (7) of the interviewees, or 37%, directly stated their belief that existing regulations are either not enforced or inconsistently or unequally enforced. Owners/managers that store skis at basement or garden level spoke of feeling at a competitive disadvantage to those who are seen as Town of Vail Page 9 August 1, 2017 - Page 28 of 65 being allowed to store skis at ground floor or street level. Multiple owners/managers spoke of their desire to be good citizens and follow existing regulations, but are tempted to break the regulations in order to remain competitive. Also, owners/managers frequently mentioned the competitive advantages and disadvantages of their location and the ability to provide outdoor display of their equipment. Those who do not have private outdoor display area argue that businesses with outdoor display area have a competitive advantage. Those businesses with private outdoor display areas argue that they pay more in rent to have such an advantage. Six (6) interviewees, or 32%, specifically stated their concern about either the in - Village outdoor displays or all of the ski racks at the mountain bases and believe it creates visual clutter and makes for an unaesthetic Town image. o Lack of Clarity: Partially reinforced by their view of the enforcement of existing regulations, a few owners/managers discussed their confusion as to what is exactly allowed by the existing regulations within the Vail Town Code. Based on staff's experience, there have been examples of owners/managers not following existing regulations simply because they were unaware or unsure of how their business model fits into the existing regulations. Another common issue was the lack of clarity in regards to outdoor display. There is confusion as to the location of property lines, easements, and access at the bases of the mountain. The lack of clarity in regards to property lines appears to be one of the primary factors for complaints among owners/managers. There is also a lack of clarity in regards to ownership of certain delivery areas and drive aisles and who has rights to place equipment at the mountain bases. o Equipment Transportation: Eight (8) interviewees, or 42%, discussed some problem with the transportation of their equipment. Frustrations with the movement and delivery of ski equipment include transporting equipment from their business locations back and forth from the bases of the mountain as well as congestion at the bases, especially in the late afternoon. Even a few owners/managers with businesses located at the base of the mountain expressed issues dealing with skier congestion due to too many ski racks in one location and transportation issues due to loading and unloading of vehicles from resorts, other businesses, etc. Town of Vail Page 10 August 1, 2017 - Page 29 of 65 o Staffing and Employee Housing: Six (6) interviewees, or 32%, stated that maintaining employees is difficult due to a lack of affordable housing in the area. • The Future o Expansion: In regards to the possibility of future expansion, seventeen (17) of the nineteen (19) interviewees fully responded. Two (2) businesses were unsure. Of the respondents, two (2) businesses, or 12%, definitely plan on expanding. Six (6), or 35% of respondents, do not plan on expanding. Nine (9), or 53% of respondents, expressed an interest an expanding but are in some way limited from doing so. The most common answer was their businesses were out of physical space for storage. o New Services: There were mixed responses in regards to new services that owners/managers intend on implementing. There was a general agreement that customer expectations are changing to a point where they demand more lift -side services such as ski valet and other amenities like boot warmers, ski tuning and waxing, etc. • Suggestions and Ideas: Multiple interviewees expressed a desire for the Town and Vail Resorts to better organize ski -related activities. Suggestions included: o Provide a clear management plan with dedicated locations for ski racks at the mountain bases. For example, "an off -slope business only" area for certain ski racks similar to a taxi lane at an airport. o Coordinate delivery/pick-up times for equipment at the mountain bases. o More ski racks dispersed throughout Vail Village and Lionshead. o Create dedicated delivery zones closer to the mountain bases. Consider making Hanson Ranch Road open for deliveries only. Multiple interviewees expressed a belief that the Town or Vail Resorts should provide additional ski storage. Suggestions included: o The Town of Vail should build and operate a ski storage facility or lease some of their property to a management group to operate such a facility. Town of Vail Page 11 August 1, 2017 - Page 30 of 65 o Follow the "Aspen Model" and have on -mountain ski storage provided by Vail Resorts. Suggestions for in-store ski storage and outdoor display included: o Limit the amount of outdoor display to a proportionate amount of the businesses' interior space. o Consider allowing ground floor ski storage if it is at the rear of the building and there is a certain minimum amount of ground floor area dedicated to retail space. o Allow businesses to fully utilize the land they own or rent. Other suggestions include the following: o Two (2) interviewees specifically mentioned that using push carts to go to and from the base would be made easier and more efficient if they were allowed, even at limited times, to use a small motorized vehicle to tow the equipment. o Two (2) interviewees suggested technology-based solutions like incorporate ski storage information into the Vail App or even developing an AirBnb-type system that lets skiers know where there are businesses with ski storage space available, the rates, and reserve a storage space. o Make hotels provide ski storage only in the basement or garden level. o Beautify and make safe the utility boxes at the rear of the Vista Bahn building. VI. DISCUSSION ITEMS FOR TOWN COUNCIL To assist the Town Council in its discussions, staff has provided the following questions: • Are the current operational characteristics of ski storage, ski valet and ski concierge services acceptable? • If so, should the Vail Town Code be revised to more closely represent and allow these characteristics? • If not, what characteristics, specifically, are inconsistent with the Vail Brand or present other complications? • Is it the consensus of the Town Council that the regulations be revised to address these identified unwanted characteristics? NEXT STEPS Following a discussion between the Town Council, the community and staff, Community Development will draft possible revisions to the Vail Town Code based on the feedback and direction received. Background During the July 11, 2017 Town Council meeting a council member requested clarification regarding current fire restrictions and the Town of Vail Code pertaining to outdoor fires. 11. Current Situation The Town of Vail code (Title 5, Chapter 8) currently prohibits open burning. Open burning refers to fires which to fires in which the fire is uncontained and there is no chimney. Typically open burning is associated with the disposal of vegetation, trash, or bonfires. The International Fire Code (2015), which is the adopted fire code for the Town of Vail, specifically states that recreational fires and portable outdoor fireplaces are not considered open burning. As a matter of practice, Vail Fire and Emergency Services has historically only allowed the use of portable outdoor fireplaces equipped with a screen which serves as a spark arrestor. The use of portable outdoor fireplaces is permissible in the Town of Vail during stage 1 fire restrictions. On July 6, 2017, Eagle County enacted Stage 1 fire restrictions. Due to the fact that the Town of Vail does not allow open burning, these restrictions had little effect on the Town of Vail. The other fire districts within Eagle County allow recreational fires in approved devices during Stage 1 restrictions, which is consistent with the Town of Vail. Stage 2 fire restrictions prohibit the use of all outdoor fires. Staff is not aware of any instances of a portable outdoor fireplace used in compliance with the fire code spreading to the wildland or causing damage to structures within the Town of Vail. Improper disposal of fireplace ashes and uses charcoal briquettes have been responsible for a number of fires within the Town of Vail. August 1, 2017 - Page 37 of 65 III. Options 1) Amend Town of Vail code to prohibit all outdoor fires, including recreational fires and portable outdoor fireplaces. This will require a significant public education and enforcement effort. This restriction would not apply to propane and natural gas burning outdoor fireplaces. Council would also need to determine if this ban is to be in effect year-round or only during the summer months. 2) Amend Town of Vail code to allow recreational fires in an approved device (portable outdoor fireplace), but require an annual inspection of the device and its clearance to all combustibles, including vegetation. Include language which requires the extinguishment of the fire the smoke is determined to be a nuisance. If this approach is adopted, staff recommends that recreational fires and portable outdoor fireplaces be prohibited in short term rental by owner occupancies (RBO) due to practical difficulties in ensuring that short term renters understand limitations on the use of these devices and proper disposal of ashes. 3) Maintain the existing code language which allows portable outdoor fireplaces but ban all outdoor fires in (RBOs) for the reasons described above. Add language which requires the extinguishment of the fire the smoke is determined to be a nuisance. 4) No change to current Town of Vail code. IV. Staff Recommendation Staff recommends option 2. This option provides for public safety and enjoyment, while mitigating the problem of fires conducted in a manner which creates a nuisance. Several were isolated and low density zoning. Braun and the Board discussed 3 lots behind Safeway in West Vail, the lot between Bighorn Road, Lupine and Columbine owned by a metropolitan district, the steep Bighorn lot and lot across from Bighorn Park. VLHA wants to make sure housing remains on the Open Lands plan. Braun stated the current review does not address existing developed lands and growth potential. Lindstrom asked if there were documents online the Board could review. Braun will update and get records to the Board. Board discussed reviewing Town GIS maps to determine potential parcels so they can write letter. Up next the Board considered the challenges faced by RBOs and if the Town is collecting all funds. They believe RBO fees could be earmarked for reoccurring housing fund source. All agreed. Lindstrom stated the taxing should be above and beyond administrative costs. He would like to see the full tax passed through to cover deed restriction purchases. Members want to see any data from finance with regard to how many RBOs are licensed today, the cost to administer now and monies collected. It is published twice annually as soon as practical after the data has become available, is limited in scope by the availability of data from secondary sources and is thought to be generally accurate but not independently verified. Tourism Vail's 2016/17 winter season experienced a "mixed bag" of growth and declines in tourism indicators. During the 2016/17 winter season, Vail experienced a slight increase in occupancy (+2.2%), a rebound from the prior year, which saw a slight decline in occupancy for the first time since the "Great Recession", which started just before the 2008/09 season. Average Daily Rate (ADR) continues to increase year over year (+10.5%) resulting in a significant increase in revenue per available room (+12.9%). This metric typically correlates proximate to Town of Vail's lodging tax collections, however the closure of some properties, including the long-term closure of the Vail Cascade for renovation, has resulted in a disparate data set for the duration of the closure, the details and impact of which are covered under separate documentation forthcoming. Vail's occupancy during the 2016/17 season is still (-3.5%) below its pre -recession high of 60.3% in 2006/07. ADR is up for the 5th consecutive season (+39.3%) and above its pre -recession peak. This further reinforces the theory that lodging supply is a limiting factor as demand increases and drives rate increases during many times of the year. Comparatively other U.S. western mountain resorts (based on overall DestiMetrics industry data), increased less in occupancy (+0.5%) and less in rate (+6.6%) and achieved an increase in total revenue per available room (+5.2%), which underperformed Vail's increase (+12.9%). Other metrics to note are snowfall, which decreased (- 26.4%) on -mountain and (-11.2%) in town. Parking in the Vail parking structures also saw a decline (-7.8%). Gasoline prices increased significantly (+30.0%) after a dip during the 2015/16 season but had little effect on drive traffic, which can be seen from the basically static year over year Tunnel Traffic (+1.0%). Deplanements at Eagle County Regional Airport, which have seen consistency in flights and capacity over the past 4 years, decreased slightly (-3.5%). A variety of special events took place during the winter months, with overall attendance and participation remaining consistent to the prior year except for Vail Yeti Hockey League, which is newly added to this report and accounted for 10,400 spectators during the winter of 2016/17. Event attendance reporting is now consistently being measured by a third party research firm (RRC Associates), which is resulting in less dramatic increases/decreases in event attendance data from season to season. Real Estate i This season's real estate indicators (excluding commercial sales) show a slight increase in Average Sale Price per transaction (+2.0%) but a more significant increase in Average Price per Square (+12.4%). Number of Transactions (inclusive of commercial sales) declined slightly (-4.4%) with Total Gross Sales increasing dramatically (+37.5%) over the prior year, which includes one transaction for $47 million. These metrics reflect more demand for higher priced and larger homes than in the prior season. Town Revenues Sales Tax is segmented by business type (retail, lodging and food/beverage) and further broken down geographically by Vail neighborhoods. Excluding out of town collections, all segments combined showed a slight decrease in overall winter sales tax revenue (-2.9%) following the previous winter season's sales tax revenue, which had increased slightly. Specifically, lodging tax collections saw a decline (-3.7%) overall with the Cascade/Sandstone/East & West Vail neighborhoods declining dramatically (-46.3%) due to the temporary closure of both the Vail Cascade Resort and the Holiday Inn for renovations. However, Lionshead and Vail Village lodging tax collections combined increased (+4.4%). Food and beverage (-3.8%) and Retail (- 0.7%) each saw experienced a decline year over year. When segmented by neighborhood, Vail Village (+3.0%) and Lionshead (1.8%) both experienced increases overall compared to Cascade/Sandstone/East & West Vail, which (again, due to the closure of the Vail Cascade Resort and the Holiday Inn for renovations) showed a dramatic decrease (-28.7%). A study conducted by DestiMetrics shows that the average of taxable sales at comparable ski towns was up season -over -season in lodging sales (+4.5%) and total taxable sales (+3.1%). Attachment: Vail, gmr iq Jrgl@'*fbrs FPS 44 of 65 EMEir TOWN OF VAlL DestiMetrics Other Tax Collections by the Town of Vail include construction use tax, property tax and real estate transfer tax and are reported on a calendar -year basis. As a result, these taxes do not correlate with the seasonal indicators above. Construction use tax showed a decrease in 2016 from 2015 (-19.7%). Real estate transfer tax collections decreased somewhat in 2016 from 2015 (- 1.8%). In 2016, property taxes increased significantly (+11.9%) from 2015. Town Reserves as measured by General Fund Balances remain very healthy at $27.3 million, an increase +15.6% over the previous ear. Business Growth Macro Economics Business Growth is based on broader county and national indicators, many of which are tracked on an annual basis, lag significantly and have just been updated for the 2016 calendar year. While not as telling of the current market conditions, the Business Growth indicators show a healthy economy as evidenced by unemployment in Eagle County, which experienced another significant decrease for the second consecutive ear, from 3.1% to 2.8%. The broader economic conditions have a significant impact on determining consumers' discretionary spending and leisure habits, which in turn can significantly impact Vail's economic performance. The US domestic economy, though strong, is facing its challenges with federal policy implementation apparently stalled with respect to banking regulation, tax reform, health care and infrastructure repair. However, rather than drawing back, domestic markets are biding their time while Washington works to sort the management of dysfunctional governance. Over the course of the past six months both financial and consumer markets have gained strongly, though they both appear to be on a temporary plateau. The impact of these gains on the mountain travel industry for the winter 2016/17 season in general, and Vail in particular, is apparent to some degree in an ongoing consumer tolerance for strong year -over -year rate gains. Among the positive economic variables is the continuing low cost of gas and other transportation fuels. Among the negative is the continued strength of the US dollar against foreign currencies, particularly the Canadian and European markets, resulting in a decrease in foreign visitation to ski/mountain destinations. (1) Consumer Confidence is firmly established above the 110 -point mark for the first time since 2001 and remains above 115 points in the past four months. Consumers are feeling more confident in both the current and long-term economic outlook and expect the economy to continue to improve over the coming six months. But consumers are also nervous about earnings, which have not significantly increased since the end of the Great Recession, though the cost of living and discretionary consumer goods, particularly travel, have increased dramatically over that same time. (2) Job Creation & Unemployment continues to be an extremely consistent part of the economic/consumer engine, with job creation levels essentially unchanged in the most recent six months from the prior six-month period at about 187,000 jobs per month. While this is a decrease from this same time last year, expectations should include a slowdown as the national unemployment rate hovers at 4.3 to 4.4 percent. (3) Wall Street and other domestic financial markets have shown incredible resilience and growth in recent months as they patiently await proposed legislative initiatives such as deregulation of banking restrictions and tax reform, both of which promise to work in Wall Street's favor, but neither of which has yet been enacted. Overall, the Dow Jones has added a dramatic 7.5 percent in the past six months, and the tech -heavy Nasdaq 10.8 percent while the more consumer -reflective Standard & Poors 500 has added 6.9 percent. (4) Foreign Exchange Rates continued to be very high for inbound visitors to the US as the US dollar remained the strongest major currency in the global marketplace. On the flip side creating great deals for international travel out from the US, but at some consequence to domestic travel in so doing. If you are interested in running for Town Council, the first day to circulate nomination petitions is August 8. Here is the process: • Petitions are available at the Vail Town Clerk's office, 75 S. Frontage Road, Vail beginning August 8 • Candidates need their petitions signed by a minimum of 10 Town of Vail residents • Deadline to complete petition filing is August 28 by 5 pm. Submit to Vail Town Clerk's office There will be three council seats open for a four-year term and one council seat open for a two-year term. The election will be conducted at the Vail Municipal Building as a polling location. This is NOT a mail ballot election and is separate from the Eagle County Clerk's mail ballot election. Year to date collections of $14,424,018 are down 2.4% from prior year and up 0.7% from budget. Inflation as measured by the consumer price index was up 1.6% for June. Real Estate Transfer Tax (RETT) RETT collections through July 27 total $3,498,593 up 29.6% from this time last year. The annual 2017 RETT budget totals $5.85 million. Construction Use Tax Use Tax collections through July 27 total $1,009,084 down 14% compared to collections of $1,179,345 from this time last year. The annual budget totals $1,545,000. Summary Across all funds, year-to-date total revenue of $37.2 million is up 0.2% from the amended budget and down 1.4% from prior year. Variances from prior year are the result of decreases in sales tax and construction fees.
