Re: Payment of fees in lieu of installing portions of landscaping in conjunction with the
completion of the Arrabelle.
Ms. Bannan and Mr. Anderson:
This letter is to inform you that I have received a request to put in writing the Town's
expectations and understanding with regard to Vail Resorts Development Company
(VRDC) providing payment to Lions Square Lodge Phase I to defer, the planting of
required landscaping for the Arrabelle project. The desire being that payment of fees in
lieu to Lions Square Lodge Phase I would shift the obligation of installing the required
landscaping to Lions Square Lodge Phase I.
It is the expectation and understanding of the Town of Vail that the payment of fees for
all uninstalled landscaping is accompanied by:
a valid and recent contractor's bid to perform such work including material costs;
a completed and executed Town of Vail Developer Improvement Agreement
establishing when the landscaping will be installed; and
a payment to the Town of Vail in the amount of 125% of the contractor's bid
which will be held until such time as the landscaping is installed or the Town
causes the landscaping to be installed.
Completion of these items will shift the responsibility from VRDC and allow for Final
Certificates of Occupancy to be given to the Arrabelle project once all other
requirements are met. Furthermore, it is the expectation of the Town that all incomplete
landscaping shall be installed per the approved plan. If a change in any aspect of the
landscaping plan is desired, it shall be the responsibility of Lions Square Lodge Phase I,
to submit an application to do so for review and approval prior
