SUBJECT: A request for final review of a major exterior alteration, pursuant to
Section 12 -71-1-7, Vail Town Code, to allow for the construction of a
temporary skier ticketing office and loading and delivery facilities, Vail
Town Code, located at Tracts C and D, Lionshead Filing 1, and Tracts G
and H, Lionshead Filing 3, and setting forth details in regard thereto.

DESCRIPTION OF THE REQUEST
The applicant, Vail Resorts, represented by Braun Associates, Inc, is requesting
a final review of a major exterior alteration, pursuant to Section 12 -71-1-7, Vail
Town Code, to allow for the construction of a temporary skier ticketing office and
loading and delivery facilities, located at Tracts C and D, Lionshead Filing 1, and
Tracts G and H, Lionshead Filing 3.
The skier ticketing offices, public restrooms and loading and delivery facilities
were previously located within the Gondola Building which is in the process of
being demolished in order to make way for the new Arrabelle Hotel. In an effort
to keep these uses in Lionshead and to maintain a viable ski portal throughout
the duration of construction, the applicant is proposing to construct a temporary
facility measuring approximately 2,225 square feet in size which would be
located east of the Eagle Bahn Gondola and south of Lionshead Centre building.
The applicant is proposing to construct the new temporary facilities prior to the
2005 -2006 ski season. The new facilities will be in place until the completion of
Arrabelle Hotel (estimated completion summer of 2007). A vicinity map has been
attached for reference (Attachment A).
The applicant is also proposing to construct a new temporary loading and
delivery facility south of the Eagle Bahn Gondola. Vehicular access to the new
facility will utilize the bike path located on the north side of Gore Creek. This
facility is proposed to be constructed prior to the 2005 -2006 ski season and
removed upon completion of the Arrabelle Hotel. A letter from the applicant
dated May 15, 2005, outlining their request is attached for reference (Attachment
B)
II. ROLES OF THE REVIEWING BOARDS
Order of Review: Generally, major exterior alteration or modification
applications will be reviewed by the Planning and Environmental Commission,
and then any accompanying design review application will be reviewed by the
Design Review Board.
Planning and Environmental Commission:
The Planning and Environmental Commission is responsible for final approval,
approval with modifications, or denial of a major exterior alteration or modification
application, in accordance with Section 12 -7H -7, Exterior Alterations or
Modifications, Vail Town Code.
Design Review Board:
The Design Review Board has no review authority over a major exterior
alteration or modification application. However, the Design Review Board is
responsible for the final approval, approval with modifications, or denial of any
accompanying design review application.
Town Council:
The Town Council has the authority to hear and decide appeals from any
decision, determination, or interpretation by the Planning and Environmental
Commission and /or Design Review Board. The Town Council may also call up a
decision of the Planning and Environmental Commission and /or Design Review
Board.
Staff:
The Town Staff facilitates the application review process. Staff reviews the
submitted application materials for completeness and general compliance with
the appropriate requirements of the Town Code. Staff also provides the Planning
and Environmental Commission a memorandum containing a description and
background of the application; an evaluation of the application in regard to the
criteria and findings outlined by the Town Code; and a recommendation of
approval, approval with modifications, or denial.
Ill. FINDING /CRITERIA FOR REVIEW
Consideration of Factors Regarding Maior Exterior Alteration or Modification
The review criteria for a request of this nature (amendments to an
approved development plan) are established by Section 12 -7H -8,
Compliance Burden, Vail Town Code.
"It shall be the burden of the applicant to prove by a preponderance
of the evidence before the planning and environmental commission
and the design review board that the proposed exterior alteration or
new development is in compliance with the purposes of the
Lionshead mixed use 1 district, that the proposal is consistent with
applicable elements of the Lionshead redevelopment master plan
and that the proposal does not otherwise have a significant
negative effect on the character of the neighborhood, and that the
proposal substantially comp lies with other applicable elements of
the Vail comprehensive plan. "
1) That the proposed exterior alteration or new development is in
compliance with the purposes of the Lionshead Mixed Use 1 District.
Staff believes this proposal furthers the following specific purposes of the
Lionshead Mixed Use 1 zone district as the temporary facilities will allow
for Lionshead to remain a viable ski portal while the Arrabelle Hotel is
under construction:
...to provide incentives for properties to redevelop...
...to create an economically vibrant lodging, housing, and
commercial core...
... to ensure adequate light, air, open space and other amenities
appropriate to the permitted types of buildings and uses and to
maintain the desirable qualities of the District...
2) That the proposal is consistent with applicable elements of the
Lionshead Redevelopment Master Plan and that the proposal does
not otherwise have a significant negative effect on the character of
the neighborhood.
Staff believes the architectural style and design of the proposed
temporary structures comply with the Policy Objectives, Urban Design
Principles, Design Standards, and Architectural Design Standards of the
Lionshead Redevelopment Master Plan. This proposal has a positive
effect on the character of the neighborhood as it will enable Lionshead to
remain a viable portal to the mountain while the Arrabelle Hotel
undergoes construction. The proposed facilities will be removed upon
completion of the Arrabelle Hotel.
The Public Works Department has prepared a memorandum, dated June
7, 2005, which identifies several items which need to be addressed in
conjunction with the applicant's application for a building permit
(Attachment C).
3) That the proposal substantially complies with other applicable
elements of the Vail Comprehensive Plan.
Staff believes this proposal is consistent with the development goals of
the Town of Vail identified in the Lionshead Redevelopment Master Plan
and specifically furthers the following Vail Land Use Plan goals as the
proposed temporary facilities will allow the Lionshead ski portal to remain
viable during the redevelopment of Lionshead:
1.3 The quality of development should be maintained and
upgraded whenever possible.
2.2 The ski are owner, the business community and the Town
leaders should work together closely to make existing facilities
and the Town function more efficiently.
2.3 The ski area owner, the business community and the Town
leaders should work together to improve facilities for day skiers.
4.1 Future commercial development should continue to occur
primarily in existing commercial areas. Future commercial
development in the Core areas needs to be carefully controlled to
facilitate access and delivery.
B. The Planning and Environmental Commission shall make the following
findings before granting approval of an exterior alteration or modification:
"That the proposed major exterior alteration is in compliance with the
purposes of the LMU -1 district as specified in section 12 -7H -8 of this
article; that the proposal is consistent with applicable elements of the
Lionshead redevelopment Master Plan, and the Vail Comprehensive
Plan; and that the proposal does not otherwise negatively alter the
character of the neighborhood. "
IV. STAFF RECOMMENDATION
The Community Development Department recommends that the Planning and
Environmental Commission approves the request for a final review of a major
exterior alteration, pursuant to Section 12 -7H -7, Vail Town Code, to allow for the
construction of a temporary skier ticketing office and loading and delivery
facilities, located at Tracts C and D, Lionshead Filing 1, and Tracts G and H,
Lionshead Filing 3. Staff's recommendation of approval is based upon the
review of the criteria as outlined in Section III of this memorandum and the
testimony and evidence presented.
Should the Planning and Environmental Commission choose to make approve
this application, staff recommends that the Conditions be required of the project
and the following finding(s) be made:
"That the proposed major exterior alteration is in compliance with the
purposes of the LMU -1 district as specified in section 12 -7H -8 of this
article; that the proposal is consistent with applicable elements of the
Lionshead redevelopment Master Plan, and the Vail Comprehensive
Plan; and that the proposal does not otherwise negatively alter the
character of the neighborhood. "
Conditions:
The Developer shall address the following conditions of approval prior to final
review of the development applications by the Town of Vail Design Review
Board:
The temporary skier ticketing office shall be shifted to the south in
order to provide a twenty foot (20') clearance between the building
and any overhangs of the temporary facility and the south side of
Lionshead Centre property line. In this area there shall be twenty
(20) feet of improved surface in order to provide for adequate fire and
vehicle access.
The Developer shall address the following conditions of approval prior to applying
for a building permit for the improvements from the Town of Vail Community
Development Department: (note: A grading plan shall constitute a building
permit.)

3. The applicant shall address each of the items identified in the
memorandum from the Public Works Department, dated June 7,
2005.
�-1 The following conditions of approval shall be placed upon the operation of the
temporary ticketing, restroom, and loading and delivery facilities:
1. The temporary facilities shall adhere to all Town of Vaiko e
requirements regarding noise and lighting. or

2. The temporary facilities shall be removed entirely-prior te the - issuance
of,atTemporary Certificate of Occupancy for that portion of the
Arrabelle which will permanently contain the uses identified in this
application as being temporary. This approval shall expire and
require a new review and approval regardless of the state of the
Arrabelle Hotel project on June 13, 2007.
3. There shall be no outdoor storage of goods or materials at the I04ng
and delivery facility.
4. There shall be no vehicle parking permitted in the turnaround area
located beneath the Lionshead Skier Bridge.

RE: Amendment to Development Plans for Arrabelle at Vail Square
Temporary Loading Facilities /Ticket and Bathroom Facilities
Dear George:
Attached you will find an application for an amendment to the approved development
plan for Arrabelle at Vail Square. These amendments involve two temporary uses:
Temporary Ticket and Rest Room Building
Lift ticket sales and rest rooms are currently located in the Gondola Building. These
facilities will obviously be removed with the demolition of the Gondola Building. While
the Arrabelle will provide new ticket windows and rest rooms, temporary facilities will
be needed during construction of the hotel.
A temporary building of approximately 2,225 sq. ft. is proposed to be located just east of
Chair 8. This building will accommodate public rest rooms, lift tickets, advance tickets
and season passes. These modular buildings will be faced with board and batten siding.
An asphalt walkway will be constructed in order to provide access to the building. This
walkway will connect with existing asphalt walkways on the east and west sides of the
building.
This building is proposed to be in place prior to the 2005 -06 ski season and be removed
upon completion of the Arrabelle.
Plans submitted for this temporary building includes:
• Site Plan and Floor Plans for the Chair 8 Skier Services Building prepared by Melick
Associates, Inc.
• Chair 8 Skier Service Building Vicinity Map
Eagle Bahn (Gondola Building) Temporary Loading Facility
As you may be aware the Eagle Bahn Gondola Building is used to delivery virtually all
food and other supplies to Vail Mountain. Currently materials are packaged in large bins
and brought to the existing Gondola Building via trucks. Bins are then moved to the

Eagle Bahn via an underground tunnel where they are moved up the mountain via the
gondola. While the Arrabelle will provide this same function, a new access route and
temporary modifications to the Eagle Bahn will be needed during the construction of the
Arrabelle.
A temporary loading dock and lift are proposed for the southwest corner of the Gondola
Building. This dock will allow for trucks to be unloaded at this location and bins will
then be lowered (via a lift) to the lower level of the Eagle Bahn Building. From this point
the bins will be moved to the main level of the Eagle Bahn and moved up the mountain.
Detailed drawings of the loading dock/lift facility are depicted on attached plans prepared
by SMG. The relationship of these improvements to surrounding conditions is depicted
on attached plans prepared by Alpine Engineering.
A variety of alternatives were considered for accessing the Eagle Bahn during
construction of the Arrabelle. The proposed access involves using a portion of an
existing bike path from Lionshead Place to the Gondola Building. It is proposed that this
path be widened to 12' and a pull -out be constructed at the mid -point of the route. The
bike path would be restored to its existing condition upon completion of the Arrabelle.
This portion of bike path is located on town -owned land and as such the request to utilize
this land will need to be presented to the Town Council.
Plans included for these improvements are:
Lionshead Bin Delivery prepared by Schmeuser Gordon Meyer.
Lionshead Bin Delivery Preliminary Plans prepared by Alpine Engineering.
This facility would be constructed this summer and be removed upon completion of the
Arrabelle.
Given the temporary nature of these improvements, a detailed description of how this
proposal complies with applicable master plan and design- oriented documents has not
been provided.
Please let me know if you need any other information in order to begin processing this

The Public Works Department has reviewed the Chair 8 Skier Services Building plans and the Temporary
Lionshead Bin Delivery preliminary plans and have the following comments.
Chair 8 Temporary Skier Services Building
1. Provide utility approval for those utilities that will be effected by the location of these buildings. (i.e. I
believe the new water line is below the new building footprint)
2. Show grading, elevations, revegetation limits.
3. Provide erosion control plan, staging plan, traffic control plan. You may reference the Arrabelle plan set
for the above.
4. The relocated path shall be a minimum of 20' at all locations from any building structure or overhang.
5. The floor plan shows an overhang in front of the ticket windows show this on the site plan.
6. Provide bike path section detail or reference the Loading Bin Plans if they are on one permit.
Loading Bin Dehavery
1. Provide a final condition plan. What asphalt/concrete is planned to be removed, what stays? PW
requests that the path be left meeting minium bikepath standards at 10' width with shoulders,
however it may be as wide as 12' with shoulders. All other asphalt/concrete and curb and gutter
shall be removed, and revegetated.
2. Show cross slopes and grades of path. Final configuration shall not exceed existing grades.
3. The lift drain will drain oil and water? If yes needs to drain to a sand /oil separator.
4. Provide erosion control plan, staging plan, traffic control plan. You may reference the Arrabelle
plan set for the above.
5. Provide a winter maintenance plan that includes delivery schedule, required signage (bikepath
closures), etc...
6. Show turnaround movements for delivery vehicles.
7. Show limits of grading/disturbance line.
8. Show all necessary walls with TOW /BOW elevations.
9. Show 100 yr floodplain on plan
10. Show limits of disturbance fence on plan.

I reviewed the plans for the "temporary" ticket office behind Lionshead Centre.

2. The doors are shown on grade. Are they installing steps down from the snow, plowing the snow, what?
3. The show snow fences at the edge of the roof. Are they installing heat tape as well? This is a
modular.
C fr.�4. We need details on the water, power, gas, etc. as to location of disconnects.
5. What about lighting? Are they shutting down at dark? Working late? What about the impact of
exterior lighting on the condo owners at Lionshead Centre?
6. What is the intended use during the summer? I doubt they will take the buildings out and replace them
twice.
7. The last time we did a "temp" use there, we allowed them to put kids into tents for two years. Are we
OK on zoning?
