SUBJECT: A request for final review of a major exterior alteration, pursuant to Section 12-
7H-7, Vail Town Code, to allow for the continuation of operation of a temporary
skier ticketing office and loading and delivery facilities, located at Tracts C and D
( Arrabelle), Lionshead Filing 1, and Tracts G and H, Vail Lionshead Filing 3; and
a request for final review of a major exterior alteration, pursuant to Section 12-
7H-7, Vail Town Code, to allow for the construction of a skier drop -off parking lot,
located at Tract A, Vail Lionshead Filing 3 (generally located between Antlers
and Lion Square Lodge, between Lionshead Place and Gore Creek), and setting
forth details in regard thereto. (PEC07- 0064).
Applicant: Vail Resorts, represented by Matt Lydens
Planner: Bill Gibson
I. SUMMARY
The applicant, Vail Resorts, represented by Matt Lydens, has withdrawn the request for
a final review of a major exterior alteration, pursuant to Section 12 -71-1-7, Vail Town
Code, to allow for the construction of a skier drop -off parking lot, located at Tract A, Vail
Lionshead Filing 3 (generally located between Antlers and Lion Square Lodge, between
Lionshead Place and Gore Creek), and setting forth details in regard thereto.
The applicant, Vail Resorts, represented by Matt Lydens, is requesting a final review of a
major exterior alteration, pursuant to Section 12 -71-1-7, Vail Town Code, to allow for the
continuation of operation of a temporary skier ticketing office and loading and delivery
facilities, located at Tracts C and D ( Arrabelle), Lionshead Filing 1, and Tracts G and H,
Vail Lionshead Filing 3.
Based upon Staff's review of the criteria in Section V of this memorandum and the
evidence and testimony presented, the Community Development Department
recommends approval, with conditions, subject to the findings noted in Sections VI of
this memorandum.
II. DESCRIPTION OF REQUEST
The applicant, Vail Resorts, represented by Matt Lydens, is requesting a final review of a
major exterior alteration, pursuant to Section 12 -7H -7, Vail Town Code, to allow for the
continuation of operation of a temporary skier ticketing office and loading and delivery
facilities, located at Tracts C and D ( Arrabelle), Lionshead Filing 1, and Tracts G and H,
Vail Lionshead Filing 3.
The skier ticketing offices, public restrooms and loading and delivery facilities were
previously located within the Gondola Building that was demolished to make way for the
new Arrabelle Hotel. In an effort to keep these uses in Lionshead and to maintain a
viable ski portal throughout the duration of construction, the applicant constructed a
temporary facility measuring approximately 2,225 square feet in size which would be
located east of the Eagle Bahn Gondola and south of Lionshead Centre building; and a
temporary loading and delivery facility south of the Eagle Bahn Gondola. Vehicular
access to the loading and delivery facility utilizes the bike path located on the north side
of Gore Creek.
The approvals for these temporary facilities expired on June 13, 2007; therefore, the
Applicant is now requesting an extension of the approvals for these uses until July 31,
2008.
A vicinity map (Attachment A), the Applicant's request (Attachment B), and photos of the
temporary facilities (Attachment C) have all been attached for reference.
III. BACKGROUND
On June 6, 2005, the Applicant obtained Planning and Environmental Commission
approval for the current, temporary skier ticketing office (including public restrooms) and
loading and delivery facilities. The Commission's approval of these facilities expires
within 30 days of the issuance of a Temporary Certificate of Occupancy for that portion
of the Arrabelle that permanently contains these uses, or June 13, 2007. While the
Arrabelle has not yet obtained approval for any certificates of occupancy, the June 13
deadline has past and the 2005 Commission approvals have expired.
IV. ROLES OF THE REVIEWING BOARDS
Order of Review: Generally, major exterior alteration or modification applications will
be reviewed by the Planning and Environmental Commission, and then any
accompanying design review application will be reviewed by the Design Review Board.
Planning and Environmental Commission:
The Planning and Environmental Commission is responsible for final approval, approval
with modifications, or denial of a major exterior alteration or modification application, in
accordance with Section 12 -7H -7, Exterior Alterations or Modifications, Vail Town Code.
Design Review Board:
The Design Review Board has no review authority over a major exterior alteration or
modification application. However, the Design Review Board is responsible for the final
approval, approval with modifications, or denial of any accompanying design review
application.
Town Council:
The Town Council has the authority to hear and decide appeals from any decision,
determination, or interpretation by the Planning and Environmental Commission and /or
Design Review Board. The Town Council may also call up a decision of the Planning
and Environmental Commission and /or Design Review Board.
V. CRITERIA FOR REVIEW
Consideration of Factors Regarding Major Exterior Alteration or Modification
The review criteria for a request of this nature (amendments to an approved
development plan) are established by Section 12 -7H -8, Compliance Burden, Vail
Town Code.
"It shall be the burden of the applicant to prove by a preponderance of the
evidence before the planning and environmental commission and the
design review board that the proposed. exterior alteration or new
development is in compliance with the purposes of the Lionshead mixed
use 1 district, that the proposal is consistent with applicable elements of
the Lionshead redevelopment master plan and that the proposal does not
otherwise have a significant negative effect on the character of the
neighborhood, and that the proposal substantially complies with other
applicable elements of the Vail comprehensive plan. "
1) That the proposed exterior alteration or new development is in
compliance with the purposes of the Lionshead Mixed Use 1 District.
Staff believes this proposal furthers the following specific purposes of the
Lionshead Mixed Use 1 zone district as the temporary facilities will allow for
Lionshead to remain a viable ski portal while the Arrabelle Hotel is under
construction:
• ...to provide incentives for properties to redevelop...
• ...to create an economically vibrant lodging, housing, and commercial
core...
...to ensure adequate light, air, open space and other amenities
appropriate to the permitted types of buildings and uses and to maintain
the desirable qualities of the District...
2) That the proposal is consistent with applicable elements of the
Lionshead Redevelopment Master Plan and that the proposal does not
otherwise have a significant negative effect on the character of the
neighborhood.
Staff believes the architectural style and design of the proposed temporary
structures comply with the Policy Objectives, Urban Design Principles, Design
Standards, and Architectural Design Standards of the Lionshead Redevelopment
Master Plan. This proposal has a positive effect on the character of the
neighborhood as it will enable Lionshead to remain a viable portal to the
mountain while the Arrabelle Hotel undergoes construction. The proposed
facilities will be removed upon completion of the Arrabelle Hotel.
3) That the proposal substantially complies with other applicable elements
of the Vail Comprehensive Plan.
Staff believes this proposal is consistent with the development goals of the Town
of Vail identified in the Lionshead Redevelopment Master Plan and specifically
furthers the following Vail Land Use Plan goals as the proposed temporary
facilities will allow the Lionshead ski portal to remain viable during the
redevelopment of Lionshead:
1.3 The quality of development should be maintained and upgraded
whenever possible.
2.2 The ski are owner, the business community and the Town leaders
should work together closely to make existing facilities and the Town
function more efficiently.
2.3 The ski area owner, the business community and the Town leaders
should work together to improve facilities for day skiers.
4.1 Future commercial development should continue to occur primarily in
existing commercial areas. Future commercial development in the Core
areas needs to be carefully controlled to facilitate access and delivery.
VI. STAFF RECOMMENDATION
The Community Development Department recommends that the Planning and
Environmental Commission approves, with conditions, the request for a final review of
a major exterior alteration, pursuant to Section 12 -71-1-7, Vail Town Code, to allow for the
continuation of operation of a temporary skier ticketing office and loading and delivery
facilities, located at Tracts C and D (Arrabelle), Lionshead Filing 1, and Tracts G and H,
Vail Lionshead Filing 3. Staff's recommendation of approval is based upon the review of
the criteria as outlined in Section III of this memorandum and the testimony and
evidence presented.
Should the Planning and Environmental Commission choose to approve this request, the
Community Development Department recommends the Commission pass the following
motion:
"That the proposed major exterior alteration is in compliance with the purposes of
the LMU -1 district as specified in section 12 -7H -8 of this article; that the proposal
is consistent with applicable elements of the Lionshead redevelopment Master
Plan, and the Vail Comprehensive Plan; and that the proposal does not
otherwise negatively alter the character of the neighborhood. "
Should the Planning and Environmental Commission choose to approve this variance
request, the Community Development Department recommends the following
conditions:
The temporary facilities shall adhere to all Town of Vail Code requirements
regarding noise and lighting.
2. The temporary facilities shall be removed entirely within 30 days of receiving
a Temporary Certificate of Occupancy for that portion of the Arrabelle which
will permanently contain the uses identified in this application as being
temporary. This approval shall expire and require a new review and approval
regardless of the state of the Arrabelle Hotel project on July 31, $.
3. There shall be no outdoor storage of goods or materials at the loading and
delivery facility.
4. There shall be no vehicle parking permitted in the turnaround area located
beneath the Lionshead Skier Bridge.

RE: Amendment to Development Plans for Arrabelle at Vail Square Temporary
Loading Dock facilities /Ticket and Bathroom Facilities and Proposed Skier Drop
Off
Dear George,
Attached you will find an application for an amendment to the approved development
plan for The Arrabelle at Vail Square. These amendments involve two Temporary and
one permanent use:
Temporary Ticket and Restroom Building:
This temporary building is currently constructed and was previously approved by the
Planning and Environmental Commission on June 13, 2005. The original permit required
the building to be removed prior to the opening of The Arrabelle at Vail Square. This
building will be used to sell tickets and provide restrooms for the 07 -08 ski season. Vail
Resorts is requesting an extension to the conditional use permit (PEC Number
PECO50040) through- 3ume9, 2008.
- Sul y 31
Plans Submitted for this Temporary building includes:
Site Plan and floor plan for Chair 8 Skier Services Building prepared by Melick
Associates, Inc
• Site Plan and utility plan prepared by Alpine Engineering, Inc.
Temporary Loading and Delivery Dock:
This Temporary Loading dock is currently constructed and was previously approved by
the Planning and Environmental Commission on June 13, 2005(PEC Number
PECO50040). Vail Resorts requests the continued use of the temporary loading dock
located below the Eagle Balm Gondola building for the 07 -08 ski seasons. Access to this
dock requires the use of the bike path along Gore Creek and below Lions Square Lodge.
The original permit required Vail Resorts to return the impacted portion of the bike path
and loading dock area to its original condition prior to TCO. Vail Resorts is requesting to
return the path to the original condition by 3 2008.
3uly 31
Plans included for this temporary loading dock are:
• Lionshead Bid Delivery Plans prepared by Alpine Engineering.
Proposed Skier Drop Off
Vail Resorts is requesting the preliminary review of the skier drop off proposed to be
located on Tract A west of Lion Square Lodge and east of The Antlers (see csk 109).
Vail Resorts believes this location would resolve the potential traffic control problem
which may result with skiers being dropped of in front of LSL and before the Arrabelle
Porta Cochere. The skier drop off would include six parking spots with easy
snowmelted access to the mountain. Additionally, Vail Resorts would work with Lions
Square Lodge to coordinate and provide control measures on Lionshead Place, north of
the drop off, to ease the congestion of the Porta Cochere and provide continued
unobstructed access into LSL Parking lot during peak times. Vail Resorts believes this
would solve the potential traffic issues the Town of Vail and The Arrabelle are expecting
once construction control measures are removed on Lionshead Place, and vehicle access
is no longer controlled. Currently the TOV is looking for a solution, as the town believes
this may be a problem resulting in increased traffic patrol and implementing difficult
control measures and potentially blocking emergency access on to the Lionshead Mall.
Plans included for this improvement are:
Csk 109 Concept Plan- skier drop off parking provided by Alpine Engineering
Inc.
Please let me know if you require further information to process these requests.

Matt Lydens

LAND PLANNING & COMMUNITY DEVELOPMENT
May 15, 2005
Mr. George Ruther
Chief of Planning
Town of Vail
75 South Frontage Road
Vail, CO 81657
RE: Amendment to Development Plans for Arrabelle at Vail Square
Temporary Loading Facilities /Ticket and Bathroom Facilities
Dear George:
Attached you will find an application for an amendment to the approved development
plan for Arrabelle at Vail Square. These amendments involve two temporary uses:
Temporary Ticket and Rest Room Building
Lift ticket sales and rest rooms are currently located in the Gondola Building. These
facilities will obviously be removed with the demolition of the Gondola Building. While
the Arrabelle will provide new ticket windows and rest rooms, temporary facilities will
be needed during construction of the hotel.
A temporary building of approximately 2,225 sq. ft. is proposed to be located just east of
Chair 8. This building will accommodate public rest rooms, lift tickets, advance tickets
and season passes. These modular buildings will be faced with board and batten siding.
An asphalt walkway will be constructed in order to provide access to the building. This
walkway will connect with existing asphalt walkways on the east and west sides of the
building.
This building is proposed to be in place prior to the 2005 -06 ski season and be removed
upon completion of the Arrabelle.
Plans submitted for this temporary building includes:
• Site Plan and Floor Plans for the Chair 8 Skier Services Building prepared by Melick
Associates, Inc.
• Chair 8 Skier Service Building Vicinity Map
Eagle Bahn (Gondola Building) Temporary Loading Facility
As you may be aware the Eagle Balm Gondola Building is used to delivery virtually all
food and other supplies to Vail Mountain. Currently materials are packaged in large bins
and brought to the existing Gondola Building via trucks. Bins are then moved to the
Opal Building • 225 Main Street • Suite G -2 • Edwards, CO 81632
970- 926 -7575 • 970- 926 -7576 fax • www.braunassociates.com Attachment: B
Eagle Bahn via an underground tunnel where they are moved up the mountain via the
gondola. While the Arrabelle will provide this same function, a new access route and
temporary modifications to the Eagle Bahn will be needed during the construction of the
Arrabelle.
A temporary loading dock and lift are proposed for the southwest corner of the Gondola
Building. This dock will allow for trucks to be unloaded at this location and bins will
then be lowered (via a lift) to the lower level of the Eagle Bahn Building. From this point
the bins will be moved to the main level of the Eagle Bahn and moved up the mountain.
Detailed drawings of the loading dock/lift facility are depicted on attached plans prepared
by SMG. The relationship of these improvements to surrounding conditions is depicted
on attached plans prepared by Alpine Engineering.
A variety of alternatives were considered for accessing the Eagle Bahn during
construction of the Arrabelle. The proposed access involves using a portion of an
existing bike path from Lionshead Place to the Gondola Building. It is proposed that this
path be widened to 12' and a pull -out be constructed at the mid -point of the route. The
bike path would be restored to its existing condition upon completion of the Arrabelle.
This portion of bike path is located on town -owned land and as such the request to utilize
this land will need to be presented to the Town Council.
Plans included for these improvements are:
• Lionshead Bin Delivery prepared by Schmeuser Gordon Meyer.
• Lionshead Bin Delivery Preliminary Plans prepared by Alpine Engineering.
This facility would be constructed this summer and be removed upon completion of the
Arrabelle.
Given the temporary nature of these improvements, a detailed description of how this
proposal complies with applicable master plan and design- oriented documents has not
been provided.
Please let me know if you need any other information in order to begin processing this
application.
Sincerely,
Thomas A. Braun
