(PEC080024) Applicant: Vail Resorts, represented by Kyle Griffith Planner: Bill Gibson I. SUMMARY The applicant, Vail Resorts, represented by Kyle Griffith, is requesting a final review of a major exterior alteration, pursuant to Section 12-7H-7, Exterior Alterations or Modifications, Vail Town Code, to allow for the continued operation of a temporary public restroom and skier ticketing office, located at Lot 2, Lionshead 6`h Filing, and setting forth details in regard thereto. Based upon Staff's review of the criteria in Section V of this memorandum and the evidence and testimony presented, the Community Development Department recommends approval, with condition(s), subject to the findings noted in Sections VI of this memorandum. II. DESCRIPTION OF REQUEST The applicant is requesting a final review of a major exterior alteration, pursuant to Section 12-7H-7, Exterior Alterations or Modifications Vail Town Code, to allow for the continued operation of a temporary public restroom and skier ticketing office, located at Lot 2, Lionshead 6th Filing, and setting forth details in regard thereto. The Lionshead skier ticketing offices and public restrooms were previously located within the Gondola Building that was demolished to make way for the new Arrabelle Hotel. In an effort to keep these uses in Lionshead and to maintain a viable ski portal throughout the duration of construction, the applicant constructed a temporary facility measuring approximately 2,225 square feet in size which would be located east of the Eagle Bahn Gondola and south of Lionshead Center building. The approvals for these temporary facilities originally expired on June 13, 2007 and were then extended with the Planning and Environmental Commission's approval until July 31, 2008. This summer the applicant plans to relocate the skier ticking uses from the temporary building to their permanent location on the lowest level of Lionshead Center building's adjacent to the ski yard. While the applicant has both Planning and Environmental Commission and Design Review Board approval to replace the temporary skier 1 , ticketing/public restroom building with a permanent public restroom building, the applicant will be unable to construct these permanent improvements during this summer's construction season. Instead the applicant is proposing to construct these permanent improvements after the 2008/2009 ski season. Therefore, the applicants are requesting an extension of the major exterior alteration approval for the temporary public restroom and skier ticketing office building until July 31, 2009. A vicinity map (Attachment A) and photos of the existing temporary facility (Attachment B) have been attached for reference. III. BACKGROUND On June 6, 2005, the Applicant obtained Planning and Environmental Commission approval for the current, temporary skier ticketing office (including public restrooms) and loading and delivery facilities. The Commission's approval of these facilities expired within 30 days of the issuance of a Temporary Certificate of Occupancy for that portion of the Arrabelle that permanently contains these uses, or June 13, 2007. On March 12, 2007, the Planning and Environmental Commission approved a major exterior alteration application for the permanent public restroom building. The associated design review application was approved by the Design Review Board on March 22, 2007. On May 7, 2008, Staff approved a one-year extension of this design review approval. On November 12, 2007, the Planning and Environmental Commission approved an extension of these major exterior alteration approvals until July 31, 2009. IV. ROLES OF THE REVIEWING BOARDS Order of Review: Generally, major exterior alteration or modification applications will be reviewed by the Planning and Environmental Commission, and then any accompanying design review application will be reviewed by the Design Review Board. Planning and Environmental Commission: The Planning and Environmental Commission is responsible for final approval, approval with modifications, or denial of a major exterior alteration or modification application, in accordance with Section 12-7H-7, Exterior Alterations or Modifications, Vail Town Code. Design Review Board: The Design Review Board has no review authority over a major exterior alteration or modification application. However, the Design Review Board is responsible for the final approval, approval with modifications, or denial of any accompanying design review application. Town Council: The Town Council has the authority to hear and decide appeals from any decision, determination, or interpretation by the Planning and Environmental Commission and/or Design Review Board. The Town Council may also call up a decision of the Planning and Environmental Commission and/or Design Review Board. 2 , _ V. CRITERIA FOR REVIEW The review criteria for a request of this nature (amendments to an approved development plan) are established by Section 12-7H-8, Compliance Burden, Vail Town Code. "It sha11 be the burden of the applicant to prove by a preponderance of the evidence before the p/anning and environmenta/ commission and the design review board that the proposed exterior alteration or new deve/opment is in compliance with the purposes of the Lionshead mixed use 1 district, that the proposal is consistent with applicable elements of the Lionshead redevelopment master p/an and that the proposal does not otherwise have a significant negative effect on the character of the neighborhood, and that the proposa/ substantially complies with other applicable e/ements of the Vail comprehensive plan." 1) That the proposed exterior alteration or new development is in compliance with the purposes of the Lionshead Mixed Use 1 District. Staff believes this proposal furthers the following specific purposes of the Lionshead Mixed Use 1 zone district as the temporary facilities will allow for Lionshead to remain a viable ski portal while the Arrabelle Hotel is under construction: • ...to provide incentives for properties to redevelop... • ...to create an economically vibrant lodging, housing, and commercia/core... • ...to ensure adequate light, air, open space and other amenities appropriate to the permitted types of buildings and uses and to maintain the desirab/e qualities of the District... 2) That the proposal is consistent with applicable elements of the Lionshead Redevelopment Master Plan and that the proposal does not otherwise have a signicant negative effect on the character of the neighborhood. Staff believes the architectural style and design of the existing temporary structures comply with the Policy Objectives, Urban Design Principles, Design Standards, and Architectural Design Standards of the Lionshead Redevelopment Master Plan. This proposal has a positive effect on the character of the neighborhood as it will enable Lionshead to remain a viable portal to the mountain while the Arrabelle Hotel undergoes construction. 3) That the proposal substantially complies with other applicable elements of the Vail Comprehensive Plan. Staff believes this proposal is consistent with the development goals of the Town of Vail identied in the Lionshead Redevelopment Master Plan and specifically furthers the following Vail Land Use Plan goals as the existing temporary facilities will allow the Lionshead ski portal to remain viable during the redevelopment of Lionshead: 1.3 The quality of deve/opment should be maintained and upgraded whenever possible. 3 , , / 2.Z The ski area owner, the business community and the Town leaders should work together closely to make existing facilities and the Town function more efficiently. 2.3 The ski area owner, the business community and the Town leaders shou/d work together to improve facilities for day skiers. 4.1 Future commercia/development shou/d continue to occur primarily in existing commercial areas. Future commercia/ development in the Core areas needs to be carefully controlled to facilitate access and delivery. Vi. STAFF RECOMMENDATION The Community Development Department recommends that the Planning and Environmental Commission approves, with condition(s), the request for final review of a major exterior alteration, pursuant to Section 12-7H-7, Exterior Alterations or Modifications, Vail Town Code, to allow for the continued operation of a temporary public restroom and skier ticketing office, located at Lot 2, Lionshead 6' Filing, and setting forth details in regard thereto. Staff's recommendation is based upon review of the criteria outlined in Section V of this memorandum and the testimony and evidence presented. Should the Planning and Environmental Commission choose to approve this request; the Community Development Department recommends the Commission pass the following motion: "The P/anning and Environmental Commission approves, with condition(s), the request for final review of a major exterior a/teration, pursuant to Section 12-7H- 7, Vail Town Code, to allow for the continued operation of a temporary public restroom and skier ticketing office, located at Lot 2, Lionshead 6h Filing, and setting forth details in regard thereto. (PEC080024)" Should the Planning and Environmental Commission choose to approve this request; the Community Development Department recommends the Commission pass the following findings: "That the proposed major exterior alteration is in compliance with the purposes of the LMU-1 district, that the proposal is consistent wifh applicab/e e/ements of the Lionshead Redeve/opment Master Plan and the Vail Comprehensive P/an, and that the proposal does not otherwise negative/y a/ter the character of the neighborhood." Should the Planning and Environmental Commission choose to approve this request, the Community Development Department recommends the following condition: "1. This major exterior alteration approval shall expire on July 31, 2009." VII. ATTACHMENTS A. Vicinity Map B. Photographs of the Existing Temporary Facilities C. Griffith" To: "Bill Gibson" Date: OS/30/2008 1:44 PM Subject: RE: Lionshead Temporary Restrooms CC: "Graham Frank" Bill, I just talked with the contractor to get some of this information. As far as the renewal goes, we are planning to do the work on this building in July/August and want it renewed through next ski season. Not sure if that answers your question. The ticket office portion of the existing building will remain there, not sure if we will be selling tickets from those windows or not. I would assume they will be closed. The exterior of the building will remain unchanged and the only work will be done inside. Based on this, I don't believe we need to submit by June 3d due to the fact that no exterior modifications are going to occur. I will have the architect draw up some plans to submit when we file for building permit. Let me know if you have any problems or questions. Thanks, Kyle Kyle O.
