Applicant Town of Vail, represented by Gregg BaniePlanner: Allison Ochs BACKGROUND AND DESCRIPTION OF THE REQUEST The Town of Vail is requesting a Conditional Use Permit to allow for the relocation of 1300 ft. of low lying bike path located at the property informally known as the Katsos property / Tract A, Vail Village tlh fiting. A map has been attached for reference. The property is cunently zoned Natural Area Preservation District, which requires a Conditional Use Permit for "paved and unpaved, non-motorized, bicycle paths and pedestrian walkways." The purpose of the Natural Area Preservation District is: The Natural Area Preservation District is designed to provide areas which, because of their environmentally sensitive nature or natural beauty, shall be protected from encroachment by any building or other improvement, other than those listed in Section 12-8C-2 of this Article. The Natural Area Preservation District is intended to ensure that designated lands remain in their natural state, including reclaimed areas, by protecting such areas from development and preserving open space. The Natural Area Preservation District includes lands having valuable wildlife habitat, exceptional aesthetic or flood control value, weflands, riparian areas and areas with significant environmental constraints. Protecting sensitive natural areas is important for maintaining water quality and aquatic habitat, preserving wildlife habitat, flood control, protecting view corridors, minimizing the risk from hazard areas, and protecting the natural character of Vail which is so vital to the Town's tourist economy. The intent shall not preclude improvement of the natural environment by the removal of noxious weeds, deadfall where necessary to protect public safety or similar compatible improvements. The Town of Vail is proposing the relocation of the bike path due to the flooding that typically occurs on this portion of the path during the spring. The existing path is located in the 100-year Flood Plain. The proposed path is located at a higher grade, and out of the 100-year Flood Plain, except where the proposed path meets back with the existing lt. path. The Town of Vail has been working with the Army Corps of Engineers on this project (see conditions of approval below.) The existing path will be removed and the area will be reclaimed. The attached plan shows the proposed relocation of the bike path. Prior to the 1960's, this property, informally known as the Katsos property, located at Tract A, Vail Village 12th, had been used for sheep gnazing. In the early 1960's, it was purchased by Vail Associates, who planned to develop the property as housing. However, steep slopes and multiple geologic hazards precluded extensive development. In July of 1977, the Town of Vail purchased the property. In the late 1970's, the Town of Vail rezoned the property from Low Density Multiple Family to Greenbelt and Natural Open Space District, with a proposal to complete the bike path, which was already partially constructed on the western portion of the property. At that time, a Conditional Use Permit was not required for paved paths. In 1996, the land was rezoned to Natural Area Preservation District, which requires a conditional use permit for paved recreation paths. The Planning and Environmental Commission voted to deny this application at their April 10, 2000 meeting. The staff memo and minutes from this meeting are attached for reference. The Planning and Environmental Commission's denial was based on the finding that the envircnmenhl impacts of rcJocating the path outweighed the benefits. The Town Council voted to call-up the Planning and Environmental Commission's denial of the application at the April 11rh worksession. STAFF RECOMMENDATION The Community Development Department recommends that the Town Council overturn the Planning and Environmental Commission's denial of the Conditional Use Permit and, therefore, recommends approval of the mnditional use permit for the relocation of the bike path, subject to the following findings: 1. That the proposed location of the use is in accordance with the purposes of the conditional use permit section of the zoning code and the purposes of the Natural Area Preservation Zone District. 2. That the proposed location of the use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 3. That the proposed use will comply with each of the applicable provisions of the conditional use permit section of the zoning code. Should the Town Council choose to approve the conditional use permit for the relocation of the bike path, staff recommends the following condition: 1. Prior to construction, a permit from the Army Corps of Engineers must be submitted to the Community Development Department. ilt.REVIEW CRITERIA FOR THE GONDITIONAL USE PERMIT The review criteria for a request of this nature are established by the Town of Vail Code. The bike path is located within the Natural Area Preservation Zone District. The proposal is subject to the issuance of a conditional use permit in accordance with the provisions of Title 12, Chapter 16. For the Town Council's reference, the conditional use permit purpose statement indicates that: In order to provide the flexibility necessary to aclrieve the objectives of this title, specified uses are permitted in certain districts subject to the granting of a conditional use permit. Because of their unusual or special characteristics, conditional uses require review so that they may be located properly with respect to the purposes of this title and with respect to their effects on sunounding properties. The review process prescribed in this chapter is intended to assure compatibility and harmonious development between conditional uses and sunounding properties in the Town at large. Uses listed as conditional uses in the various districts may be permitted subject to such conditions and limitations as the Town may prescribe to insure that the location and operation of the conditional uses will be in accordance with the development objectives of the Town and will not be detrimental to other uses or properties. Where conditions cannot be devised, to achieve these objectives, applications for conditional use permits shall be denied. A. Consideration of Factors: L Relationship and impact of the use on the development objectives of the Town. Staff believes that the proposal follows the development objectives of the Town of Vail, as these objectives are stated in the Land Use Plan: 1.1.1. Vail should continue to grow in a controlled environment, maintaining a balance between residential, commercial, and recreational uses to serve both the visitor and the permanent resident. 1.1.2. The quality of the environment including air, water, and other natural resources should be protected as the Town grows. 1.1.3. The quality of development should be maintained and upgraded whenever possible. 2.7 The Town of Vail should improve the existing park and open space lands while continuing to purchase open space. In addition, Staff believes that the proposal follows the development objec{ives of the Town of Vail, as "improving the pedestrian and bike system" is identified as a priority in the Comprehensive Open Lands Plan. 2. 3. Because the existing path is located within the floodplain, there will be activig within the floodplain when the existing path is removed. The proposed path is not located within the floodplain, except at the point where the proposed path joins the existing path (see attached map). The effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recrcation facilities, and other public facilities needs. The relocation of the bike path will improve the circulation of the entire bike path throughout the spring when this section is typically flooded. Effect upon traffic with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the street and parking aneas, The relocation of the bike path will improve pedestrian safety and convenience. Staff believes there will be no effect on the other above- mentioned criteria. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses. Staff believes there will be no effect on the above-mentioned criteria. Findinos The Town Council shall make the following findings before granting a conditional use permit: 1. That the proposed location of the use is in accord with the purposes of the mnditional use permit section of the zoning code and the purposes of the district in which the site is located. 2. That the proposed location of the use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 3. Relationship and impact of the use on development objectives of the Town.2. Effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities and public facilities needs.3. Effect upon traffic, with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the streets and parking areas.4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses.5. Such other factors and criteria as the Commission deems applicable to the proposed use.6. The environmental impact report conceming the proposed use, if an environmental impact report is required by Chapter 12 of this Title.7. Conformance with development standards of zone district Desion Review Board: The Design Review Boardis responsrb/e for evaluating the Design Review application for: 1. Architectural compatibility with other structures, the land and surroundings2. Fitting buildings into landscape 3. Configuration of building and grading of a site which respects the topography4. Election of 2000 Chair - Vice-Chair - Galen Aasland made a motion to table the Chair/Vice-Chair eleqtion to the next meeting when all members are present. Doug Cahill seconded the motion. The motion passed by a vote of 4-0. 3. A request for a conditional use permil, to allow for the consolidation of two units within the Wall Street Building, located at 225 Wall StreeULot B, C, Block 5C, Vail Village 1"' Filing. Applicant Eugene Fahey, represented by Sally Brainerd, RKD, Inc.Planner: Allison Ochs Allison Ochs gave an overview of the staff memo. She said it was going to the DRB meeting on the 19rn for any exterior modifications. John Schofield asked if the applicant or public had any comments. There were no applicant or public comments. Doug Cahill had no problem with this application and thought it to be positive. Chas Bemhardt had no problem. Galen Aasland agreed wiih the staff memo. John Schofield concuned with his fellow Commissioners. Doug Cahill made a motion for approval, in accordance with the staff memo. Chas Bemhardt seconded the motion. A request for a conditional use permit, to allow for one Type lll and four Type lV Employee Housing Units, located at the Vail Athletic Club & Spa, 352 East Meadow Drive/a part of Tract B, Vail Village First Filing. Applicant: Ron Byrne, d.b.a. VML, L.L.C., represented by Tom BraunPlanner: George Ruther George Ruther gave an overview of the staff inemo. John Schofield asked if the applicant had any comments. Tom Braun asked about the condition regarding the TCO. He said if that were interpreted to be any TCO, some of the EHU's might not be ready. John Schofield asked if the building permit would be for each phase. Tom Braun said very likely il would be phased, but we still need an interpretation of the TCO. George Ruther said they could look through the employee generalion impact. He said due to the additional square footage required and the greatest impact of the employee need, he would recommend the TCO be for the hotel and fractional fee units of the building. John Schofield asked for any public comments. There were no public comments. Galen Aasland said he was in favor of this. He agreed to build the restaurant, but stated a specific landmark should be set. Doug Cahill agreed with Galen, but didn't know the best split, residential or commercial, to tie in the employee units being completed. Chas Bemhardt agreed. John Schofield asked what specific portion of the project should the TCO be tied into. George Ruther stated that essentially with a proposed redevelopmeni, if the reslaurant and club alterations were completed, the requiremenl would be reduced, so to tie it into the AU's, FFU's, and condo units . Galen Aasland made a motion, in accordance to the staff memo, with a change to Condition 1 that the triggering mechanism for the TCO would be the construction of any of lhe AU's, FFU's, or condos, and said if the scale of the project was changed they would have to come back to the PEC. Greg Barrie stated that the path was overlaid in 1990, or once in the last ten years. He stated that this was nol an emergency, but they are always looking around Town for improvements. John Schofield asked for any public comment. There was no public comment. Galen Aasland said after a site visit. he couldn't see the environmental inveslment of all the resources to move the path and doesn't see how public safety would be affected. Doug Cahill said he was concerned that the Town doesn't have a permit on the existing path form the Corp, and technically everything needed a permit. He suggested getting a permil for the enlire length of the path. Chas Bemhardt asked how bad is it? He said he thought it was in great shape and that there was way more disturbance lo the sunounding area by moving it. John Schofield said they were all in agreement. He said to tear up the existing path and put in such a small path, the environmental impacts would be excessive. He said his personal opinion was that Gouncil would be wasting our good tax dollars. Greg Barrie said moving the path up the hill would get it out of the flood plain. Galen Aasland said we should be looking at the balance of environmental impacts. John Schofield asked for any public comments. There were no public comments. Doug Cahill said it was a balancing act and if it came back on a different scale, maybe there could be some remedy and this was not an issue we should drop entirely. Greg Barrie said if it becomes an issue with the Corp., we will have to do this. Doug Cahill said what we have lhere now, l'm happy with. Ghas Bernhardt made a motion to deny this application, with the finding that the environmental negative impact would outweigh the positive impacts. Galen Aasland seconded the motion. The motion passed by a vote of 4-0. 6. Final review of the Town of Vail's revised parking generation analysis and proposed amendmenls to Chapter 12-10, Town Code. Applicant: Town of VailPlanner: Brent Wilson Planning and Environmential Commission Minutes April 10,2000 Approved 4l24lOO Brent Wilson gave an overview of the staff memo . John Schofield asked if the applicant or public had anything to add. There were no public or applicant comments. Galen Aasland said the real demand was by the ski company, bul we were given direction by the Council to review this. He said he didn't agree with the restaurant and residenlial space. He said that outdoor seating on the patio should be encouraged and this ordinance would discourage it and he would like to see another Joe's Famous Deli again. Doug Cahill agreed with Galen to encourage that type of use, wilhout putting a festriction on them. He said as a recommendation to Council. he would like to move these issues onto Council. Chas Bemhardt said he couldn't do a complete approval of this until ihe parking plan was completed next September. John Schofield said he was not comfortable with the original study and until we had a comprehensive look at the whole iown, this was jusi pulting a couple of pieces of the puzzle together. He suggested waiting another 6 months to do the whole puzzle and get it right. He said the study would have an impact on what we are doing right now. He said this should be recommended to Council as a good start. Galen Aasland asked if Joe's Famous Deli was a conditional use permit, because ii was a patio on public space. Brent Wilson said it would be a conditional use in order to review issues such as fire lane and adjacent property impacts. Chas Bemhardt said if this came up and parking was in question they would come lo the PEC. Galen Aasland said we could do this similar to the General Use Zone District where parking could be reviewed. Brent Wilson said we do not assess parking for outdoor dining. Chas Bernhardt asked to table this. Brent Wilson said a code amendment would come from an ordinance and if the position of the PEC is not ready to finalize this, then you should iable this. George Ruther asked for any PEC input before tabling it. Brent Wilson said PEC comments will be fonryarded. John Schofield said he couldn't support this as it slands as one piece. Doug Cahill said he wanled io encourage lhe restaurant uses as in the pasl, but he can't make a decision how it blends. Planning and Environmental Commission Mnutes April 10, 2000 Approved 4P4100 Brent Wilson said that once the comprehensive study was done, the group's feeling should be incorporated as a finding Chas Bernhardt made a motion to table this with the finding that it be tabled until such time that the Comprehensive Day-Skier Parking Study is completed to review it altogether and that the PEC is in general agreement that this is a step in the right direction to encourage businesses in the core area. Doug Cahill seconded the motion. The motion passed by a vote of 3-1 with Galen opposed and requested that his supporl for approval of the proposal be forwarded to Council. 7. If ftere has been co struction, improvements or major repairs undertaken on the property to be purchased within six months prior to the Date of the Commitment, the requirements to obtain coverage for unrecorded liens will include: disclosure of certain construction information; financial informrtion as to the seller, the builder and or the contractor; payment of the appropriate premium fully executed Indemnity Agreements satisfactory to the company, and, any additional requirements as may be necessary after an examination of the aforesaid information by ttre Company. No coverage will be given under any circumstances for labor or material for which the insured has contracted for or agreed to pay.
