DESCR]PTION OF VARIANCE REQUESTED
Jack carnie built the existing duplex on Lot l0 in 1977. In April lgzg aCertificate.of Occupancy was issued with the understanding that the drivewaypaving would be completed by september .l97g. A statement-to this etieci-'-"was-signed by Mr. carnie when the certificate of Occupancy was issued (seeencl osed statement ) .
This summer Mr. carnie came to the Town w'ishing to build a small add.i tiont0.his gqlqse, at which time he was told he would have to fulfill hjs commitmentmade in ]978 to pave his drivevray. Mr. carnie indicated that he would liketo apply for a variance and the iown attorney indicated that a varianceprocedure would be appropriate.
Mr- carnie wishes to obtain a variance from section 1g.52.0g0 (E) whichstates that ''All parking areas should be paved and provided wiih'adequatedrainage facil ities. "

Consideration of Factors
The relatjonship of the requested variance to other existinuses a

would result in practical difficulty or unnecessary physical hardship incons'istentwith the objectives of this title.
There are exceptions or extraordinary circumstances or conditions applicableto the site of the varjance that do not apply generally to other propertiesin the same zone.
The stri ct or literal interpretation and enforcement of the spec'i fied regulation
would deprive the applicant of privileges enjoyed by the owners of other propertiesin the same district.
STAFF RECOMMENDATION:
fhe effect oj the,requested varjance on liqht and air, distribution of population,

The vari ance would not influence the above.
The staff recommends denial of the requested variance. Mr. carnie's justifi-
cation for the variance is that Lot l0 is a 1ong, thin lot. This is notan "extraordinary circumstance or condition applicable to the site of thevariance that does not apply generaily to other properties in the same zone."(see findings above. ) Many of the lots in the Bboth creek area are thisgeneral rectangular shape, and this shape is not uncommon throughout Vail.
The shape and size of this lot by no means constit0te a physical hardshipin paving the drive. Also, to grant the variance would be a grant of specialprivilege and would set a very poor precedent for other homeowners in vajlwho have not paved their driveways.

It should be noted that the driveway for the residence locatedon Lot 10, Block I, Vail Village'l3th, has irot been paved. Due to theseason' it is almost impossible to obtain paving at this time, also,there exists the h'igh probabi'lity of elimihatioi of this ordinance.
It is agreed upon by Mr. Jack Carnie, that this matter willbe.resolved by either: 1.) paving the driveway;2,) elimination of theordinance; or, 3.) app] ication for a variance. Section 10, Subsection 4-b of the Eagle County Building Resolution and Section
302(d and e) ofthe Uniform Building Code states construction is not to be dis-gontinued or suspended for one year. No work has been done at this site for ayear and one half (1'l years). as of 29 December 19?6, permit No. 0114 is
canceled. A new permit is required from the Town of Vail to finish construction.
The last inspection was made by the Eagle County Building Department on 4 December
1914. A copy of the inspection report is enclosed.
