BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact lhe various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this depaftment to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and ihat if I fail to do so it may affect future permits that I apply for.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Buildino Permit ApBlication.
If yes was answered to any of the questions then a "Public Way" permit is reguired. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhom Drive.
Notice sign-offs for utility companies. ALL utilities must field verifli (locate) respective
utilities prior to signing application. Some uUlity companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November lst and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffc control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and inigation crew. The locates take place in
the morning, but may require up to 48 hours to peform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within ,E hours of being received, but please allow up
to one (1) week to process,
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

DRAINAGE AND CULVERT INSPECTIONS ARE REOUIRED BY PUBLIC WORKS!
Please read and check off each of the items below:
o The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culvefts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2198 to request an inspection from
the Public Works Department. Allow a minimum of 24 hour notice.
Also, the Town of Vail Public Works Department will be approving all final drainage
and culvert installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Certificate of Occupancy issuance.

CODE 5-2-10: DEPOSITS ON PUBUC WAYS PROHIBITED
u Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
r Notice; Abatement: The Director of Public Works may notifo and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rock, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
a Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear

amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

will keep the jobsite as clean as possible and practical during the construction, and a
thorough cleaning of Plath's work areas will be performed upon completion. Plath
Construction will take all reasonable precautions to protect the interior of the building from
water and weather. However, Plath Construction shall not be held liable for any interior
damage sustained from leaks caused by sudden andfor unforseen storms that occur during
the tear off phase of this work.
2] Inspect the plywood for water damage, and replace as needed.rt This work, if required, will be an additional charge over and above the contract price,
and will be charged at the rate of $ 1.75 per sguare foot. No additional charges will be

Due to the current volatility of the market, material prices cannot be guaranteed past 30

2l Winter work is not figured in this proposal. If roofing work is falls between November

under adverse winter conditions. Any such charges shall not exceed tWo of the remaining
coqtract amount and are in addition to any snow removal and priming charges that may

3l Plath Construction carries property damage liability insurance in the amount of
$1,000,000.00 per occurrence. Plath Construction carries auto insurance in the amount of

On DecemberT, 1993, the Vail Town Council, by avote of 7-0, approved yoursign variance
request for the purpose ot locating two eight square foot project identification signs at the
Pineridge Townhouses, Lots 2, 3, and 4, Vail Heights Subdivision. The Town Council
approved the variances contingent upon compliance with the two conditions outlined in the
Design Review Board (DRB) recommendation ol approval. Specifically, the conditions of
approval are as follows:
1. That the top of the signs be no higher than 5 feet above finished grade-
2. That any trash dumpsters currently located in the public right-of-way be
relocated onto the Homeowner's Association property and screened from public
view with landscaping, per the attached site plans.

Paul |ohnston supported the mirprity position of the PEC. He felt the Lot should be left the way it
was now.
Sybill Navas was opposed b the rezoning and saw no benefits to the commmity. She also observed
the neighborhood opposition to the proposal. She advised she had qpokm with some of the PEC
mernbers who had voted in favs of the rezoning, but felt they were qualifying their vo@s because
they felf compelled by tre ordinanaeo. She did not feel they were committed in theory to the
proposal. She indicated she would voE no.
Tom Steinberg disagrced that the rezoning would be cpnsistmt with the surnounding and immediate
fieighborhoods. lle also disagreed that it would be a benefit to the courmunity. He felt the requircd

from this proposal w€re not trings the applicant had contnol to grve away. He felt the original

felt they were right and asked why TOV should look back 30 years and drange that for one person's
private gain. He was opposed.
Mayor Osterfoss felt although rezoning was a theoretical possibility based on the size of this lot, this
specific ProPosal did not address Land Use Plan criteria B referencing converrient workable
rdatiorships withland uses consistmt with municipal objects nor did it address item D compliance
with Vail land Use Plan. She felt it failed to meet these criteria based on adding additional units
and additional GRFA. She agreed with Paul's oomm€nts and with ttre minority position of the PEC.
She also did not feel there wae b€nefit to the community.
Merv Lapin.moved to deny Ordinance No. 34, Series of 1993, on first reading because it did not meet
Sections 1.2 and 1.3 of $e Iand Use Plan C;oals, the Subdivision Regulations Purpose under
77.M.010, and under zoning cdteria did not meet it€rns B and D. Tom Steinberg seconded themotion A vote was taken and the motion passed unanimously, T-0,
Merv l-apin furthet moved that staff have the PEC look into ways to avoid having these tnres of
proposals presented again. There wr$ rxl second to this rnotion. He felt the rninimum building lot
sizes should be inoeased on Single Family lots from 12^500 to 17500 and 15p00 to D,000 on a
Primary/Secondary. He said those numbers were meant mly as grides,but he wanted the PEC tro
look at this or other methods. Mayor Osterfoss asked Merv if he anticipated this being done as part
of the review of the Land Use Plan planned for the nat year. He said he would like to see this back
to C-ouncil by February 75, 1993. Kristan hitz felt staff needed to diruss possibilities with Tom
Moorhead, anC then work with the PEC. Merv ageed to that, but felt there was a necessity for
speed with this issue. Kristan wanted the PEC and Council to have a irint Work Session to discuss
possible_solutions. Sle advised staff would have notice published to advise the public, but initially
a Work Session in Febmary would be pref€rr,ed. Tom Steinberg felt an alternative to that was to put
a moratoliul on any lot zubdivision until sudr time as tlrc land Use Plan had been thoroughly
reviewed and passed. Merv stated he was reluctant to use a moratorium pmc€ss. Mayor Ostofosl
felt that the idea described by lGistan was a helpfirl starting point to define what the concerns were
and discuss di.fferent approadres.
Tom Moorhead recommended tabling of the Byers'appeal as a tectrnicality. Merv lapin moved to
table the Byeds appeal of the subdivision rurtil Decernber 2l,1993,with a second fron Jim Sh€ar,er.
A vote was takm and the motion passed unanimously, T-0.

On November 3, 1993, the Vail Design Fleview Board (DRB) recommended to approve the
sign variance request for the Pineridge Townhouses with a vote of 5-0 (see attached memo)'
In their motion, the DRB included two condilions to their recommendation of approval. These
conditions are as follows:
1. That the top of the signs be no higher than 5 feet above finished grade.
2. That any trash dumpsters currently located in lhe public right-of-way be moved
onto the Homeowners Association property and screened from public view with
landscaping.

I. DESCRIPTION OF THE REQUEST
The Pineridge Townhouses is a cluster of thirty-one dwelling units (three six-plexes, 1 five-
plex, and two four-plexes) located on Lots 2,3, and 4, Vail Heights Subdivision. Since there
is currently no project identification for the Pineridge Townhouses, the Homeowners
Association would like to construct two subdivision entrance signs (5 square feet each) near
the property's eastern and western-most entrance drives. The section of the Vail Sign Code
which governs the installation of subdivision entrance signs may be found at Section
16.20.150 of the Vail Sign Code (see attached copy). The purpose statement of this section
of the Code states that subdivision entrance signs are intended "to identify the entrance to a
major subdivision, condominium complex, or group of apartmenl buildings having at least 100
lineal leet of frontage along a vehicular or pedestrian way.' Subdivision enlrance signs are
controlled in terms of size, height, number, location, design, lighting and landscaping. The
location requirement states that subdivision entrance signs may be located only to identify
subdivisions and buildings in the RG, LDMF, MDMF, HDMF, and SDD zone districts, subject
to the approval of the Design Beview Board (DRB). Since the Pineridge Townhouses are
located on property zoned Primary/Secondary Residential, the project is precluded from
having subdivision entrance signs without approval of a variance from this section of the Vail
Sign Code. The Pineridge Townhouses Homeowners Association is requesting a
variance to allow for the installation ol two subdivision entrance signs on property
zoned Primary/Secondary Residential.
II. BACKGROUND AND HISTORY
The Pineridge Townhouses were conslructed in the early 1970's, at which time they were
located in unincorporated Eagle County. The project was annexed into the Town of Vail in
1986 and zoned Primary/Secondary Residential at that time. The project is considered to be
legally non-conforming, wih regard to zoning.

Staff Response:
Staff feels that the two signs located adjacent to the east and west enfances to
the project do not depart lrom the intent of the Sign Code. The purpose of
subdivision entrance signs are to identity the entrance to multi-unit projects. All
other provisions of the Vail Sign Code, relating to the size, number, location,
design, landscaping, etc., are being complied with.
IV. STAFF RECOMM.ENDATION
Staff recommends approval of the applicants' request to place two 1o-square foot signs at the
eabt and west entrances ol the Pineridge Townhouse property lor the purpose of properly
identifying the project. We feel that the required variance findings have been met and the
existing zoning of the property causes a hardship which does not apply to other multi-unit
projects in the vicinity, nor was created by the applicant.

Enclosed pl.ease find the plat for Pine Ridge Townhouses at 2195
and 2199 Chanonix Lane. This shows the sign locations, and a
scale drawing of the proposed signs for identification of theproperty. Along with this is an architect's rendering of theproposed landscapinq surrounding the signs.
As per the direction of the Design Revj.ew Board, we have notedproposed areas for relocation of the two trash enclosures. Pine
Ridge understands that the trash enclosures must be relocatedprior to sign instalLation and that proper landscapinq sha11
surround these encLosures.
Please be advised that, due to seasonal conditions and fundsavailability, we will be unable to install the signs and relocatethe trash enclosures until spring of 1994.

B. The revield process for NE$l BUILDINGS normally requirestwo separate meetings of the Design Review Board: aconceptual approvaf and a final approval . Applicantsshould plan on presenting thej.r development proposal ata minimum of two meetings before obtaining finalapproval .
C. Applicants who fail to appear before the Design ReviewBoard on their scheduled neeting date and who have notasked in advance that discussi.on on their item bepostponed, will have their items removed fron the DRBdocket until such time as the item has beenrepublished.
D. The following items nay, at the discretion of thezoning administrator, be approved by the CommunityDevelopment Department staff (i.e. a formal hearingbefore the DRB may not be required):
a. lilindows, skylights and similar exterior changeswhich do not alter the existing plane of thebuilding; and

Dear Dave:
I have reviewed the townhouse plat and am requesting the following information
before the townhouse plat w'i ll be accepted for review:
1. The staff will need information on the existing ownership of theproject. Is the purpose of the plat to alIow townhouse sales ofexisting apartments or are the units a1 ready townhouses and you are just
trying to clear up some surveying discrepancies? If the units are
already sold as townhomes, the staff is curious as to how the townhomes
were actually sold without a townhouse olat being completed.
2. What are the discrepancies between the 1ega1 description and theas-built locations?
3. You may remove the PEC title block from the plat,
necessary for this review unless the project is aconversion. By condominium conversion, the staffunits would be turned into townhome units.
4. The statement should be added to the plat: "Allthis p1at. None of the units are proposed."
5. The following wording should be added to the plat: "For zoning
purposes, the ten townhomes sjtes (1A to 10A) and common area created bythjs subdjvisjon on Lot 2 are to be treated as one lot. For zoning
purposes, the 11 townhome sites (1 to l1) and common area created bythis subdivision on Lot 3 are to be treated as one lot. For zoning
purposes, the 10 townhome sites (LZ lo 2L) and common area created bythis subdivision on Lot 4 are to be treated as one lot.
6. The owner's signatune must be on the application for the plat rev.iew.
7. Three copies of the p'l at, two of which must be mylars, must be includedwith the final application.
8. To my knowledge, a check for $100 was not submitted to the Town for the
townhouse plat review. If by chance you did submjt the check and paidfor the review, please give me the check number and date of payment sothat I may check on this with our Finance Department.
9. A copy of the condominium declaratjons for staff review should besubmitted to be sure that there are majntenance provisions'included forall cormonly owned areas. The declarations and,/or covenants shallspecifical 1y address the painting of the exteriors of the units so thatthe units will be painted the same color and be maintained in the samenanner. Landscaping ma'i ntenance should also be addressed.
10. I have enclosed an address form which you may use to get approval foryour requested address changes. Thjs form must be circulated to all theappropriate Town of VaiI departments, the post office and emergency roomat the hospital , etc. before the address change will be final .

This will confirm our conversation of December 16, 1986.
The replat is necessary for the fo'l lowing reasons:
a.'A survey has shown d'iscrepancies in the 1egal description cornpared
to the as built location.
b. The easterly two buildings are the only ones that have been ful'lyplatted. The othei four buildings are still using metes and bounds des-
criptions.In effect, we have a replat of Phase III and
Phases I and II. For your information, Phase
center buildings and Phase II is comprised ofI hope that this dispells the confusion.
Another issue which we would like to d'i scuss is the street numbering in
this area. Currently Phase III (the easterly two buildings) is 2195
Chamonix. The other four buildings a1l carry the street address of 2199
Chamonix. t^le would'l'ike to include 2L97 for the two center bujldings.
This would remove confusion and make the individual units easier to find.
Internally we will be going with a sequential numbering system fron east
to west which will further this goa'|.
Thank you for your response and quick coordination with Bjll Andrews
concerning the replat. I will fonvard a copy of this letter to Stan
Berryman concerning the street address change.

resolve in conjunction with this is our assigned street addresses.

confus i on.

we have reviewed the plans and the supp'rrting information for the above
referenced Townhouses and have the following comments:
(1) Aif plurnbing, including water and sewer conform to the Colorado
Department of tlealth Plumbing Code. Example: water and sewer Lines
should be separated by 10 feec. SEaEe criteria on waEer and sewer
line crossing points must. be adhered to.
(2) County Subdivision rlegulations Section 2.01:
The plans indicate that all parking lotr street and surface run-
off will be carried eventually to Gore Creek. We recommend the
installation of small setcling ponds and/or sand and oil traPs to
limit the siltation and pollution of the stream. This office may be
contacted for design criteria. Plans for Ehe above should be submirted
prior to finaL approval.
(3) If the remaining private land in Eagle County developes at this density
we will have a serious air pollution problem. Air samples taken at
Vail in January and February 1973, indicate Vail had more pollution than
other connuniEies in ilegion 7 of the Western Slope. l{e strongly rec-
onrnend decreased density in land developments. As an alternacive some
of the following radical measures could be Eaken:
(a) Instatlation 6?7-i-r pollution control equipment on all fireplaces.
(b) Installation of air pollution control equipmenE on restaurant grill
and cooking units in the exhaust ventilation systems.
(c) Prohibiting the use of hydrocarbon fuels for cooking and heating.
(d) Rationing gasoline and diesel fuel or limiting the hours that
inEernal combustion vehicles can be allowed to operate in Eagle County.

nurnber of leaks in the building. This is the fourth of our sixbuildi.nqs for such repair.
The replacement roofs will be basically the same in color andmaterials as the existing roofs- We will be changing from felt tobithethane.
As our contractor, Plath Construction is authorized to enter ourproperty in order to conplete chis project.

addition to Torvn staff. Should a determination be made by the Town staff that an ouBide consultant

This js in response to your letter of January 6, 1987.
The Pine Ridqe Townhouses have alwavs been townhouses. Phase III has
ffi. No olat ivas ever filed for Phases I and II,
these ind'ividua'l townhouses were deeded by metes and bounds descript'ion.
Using tie current markers for the property boundaries we have found
discrepancies in the metes and bounds descriptions and in the recordedp1at. Ih fact, we cannot duplicate the resu'lts from the orig'inal survey
even though we have the actual field notes for this. In severa'l casesthis is a minor discrepancy of the party wall between two townhouses.In other cases this may be as much as 2* to 3 feet. This trould causetitle problems for any future sa1e.
Enc]osed is the Association's check in the amount of $100 for the
townhouse p'lat review.
Also enc'losed is a copy of the Condominium Declaration for your review.
The change of address form has been completed and returned under
separate cover.
