Dear Mr. Carsagno:
The above-referenced property lies in the Town of Vail's "Primary/Secondary Residential"
zoning district. This zoning designation allows for certain forms of duplex development.
The above-referenced property was built and approved by Eagle County. Later, the Town of
Vail annexed this property and granted it a "legal non-conforming" status. Il hypothetically, the
above-referenced property were to be destroyed by fire or another "act ofGod", Section l2-18-9
of the Town of Vail Municipal Code allows the structure to be restored in its current form -
provided restoration is commenced within one year and diligently pursued to completion.
However, if this property were to be demolished and rebuilt, current zoning regulations would
apply.
