Bac kground: I n the near future Eagle C ounty Animal S ervices is asking
that the Town of Vail consider the adoption of a new county wide animal
code that is being recommended for all Eagle County, including the towns
of Eagle, Avon, Gypsum and Vail . The goal being to standardize the

addition would solidify a fine based system. This will be asked to be done in

Bac kground: Town Council direc ted the polic e department to review the
current load and delivery regulations and determine if improvements needed
to be made. After reviewing the current regulations and meeting with stake
holders, it was obvious improvements to the current system are needed.
One of the reocc urring suggestions was moving all the Vail Village deliveries
into loading docks and utilizing a delivery servic e to complete the delivery
from the loading dock to the business.
Staff Rec ommendation: S taff rec ommends that additional research is
needed to determine the feasibility of a delivery service.

period between 2004-06, the Town undertook a master planning project for

SUBJECT: TOV Discussion for a new Animal Control Code
This is a quick overview to provide Vail Town Council and the Mayor’s Office the Eagle County
Animal Service resolution for a future adoption of a new county wide animal control code.
The following fifteen-minute presentation by Field Services Manager, Nathan Lehnert will provide
a high-level overview of the new resolution, the benefits of standardizing all ordinances and
language to one code and adopting one fine based system. By using technology and mapping
software to aid in providing our residents and guests clear and concise regulations that are
consistent throughout the county. To name a few, subjects such as leash laws, voice control and
emotional support service animals will be covered.
In addition, Lehnert will address his recent efforts and support he has received from other
communities and towns throughout the county thus far. Lehnert has been working with Attorney’s
offices, Town Manager’s and Mayor’s to welcome concerns and suggestions before moving to
adopt the code in April 2020 throughout the county.
It is Eagle County Animal Services hope that they can get similar feedback, concerns and direction
from Vail Town Council and the Mayor and return to Council in March with a code they can
support.

Subject: 2019 Loading and Delivery Update
1. Background
The Town of Vail has been working for years to improve loading and delivery in Vail
Village. There have been a number of changes throughout the years including an
investment in excess of $17 million to build loading docks. In recent years, several small
incremental changes have been made. These changes, for the most part, have
addressed isolated issues but have fallen short of resolving the larger issues of noise,
congested streets and a diminished guest experience.
2. Summary
This summer, Council directed the police department to review current loading and
delivery protocols. The purpose of the review was to determine if improvements could be
made to the current load and delivery rules. The Town continues to receive complaints
centered around loading and delivery. The majority of complaints are from Vail Village,
and most of those complaints center around Gore Creek Drive and Bridge Street,
particularly regarding noise and the guest experience.
In contrast, Lionshead rarely generates any loading and delivery complaints. The system
in place of all deliveries going to the Arrabelle loading dock has worked very well.
Deliveries are made in a timely manner and the Lionshead pedestrian mall maintains an
exceptional guest experience.
In September, we met with the dockmasters of all five loading docks in Vail Village: Four
Seasons, Sebastian, Solaris, One Willow Bridge and Mountain Plaza. The meetings were
to determine the current utilization of the loading docks, capacity of the loading docks and
any issues the dockmasters are having. All the dockmasters were aware of the current
regulation allowing delivery companies to utilize the loading docks. They also
unanimously reported that the loading docks are very underutilized. None of the loading

docks are near capacity and they have yet to come close to being at capacity. The only
dockmaster to report an issue was One Willow Bridge. The dockmaster was concerned
that increased traffic in the early mornings would disrupt hotel guests.
In October, we scheduled three meetings with business owners, hotel management and
delivery companies from Vail Village. The meetings were very productive. The current
load and delivery rules were reviewed at each meeting. We also went over the locations
and availability of loading docks in Vail Village. Representatives from several businesses
and delivery companies that were not aware that all the loading docks were available to
them. We discussed the impact of special events on loading and delivery. The business
owners reported that they were not receiving enough advanced notice of special events;
however, delivery companies felt that the police department Code Enforcement Officers
(CEO) do a good job of letting them know about special events.
The final section of each meeting was reserved for a discussion on the types of loading
and delivery complaints we receive, and why it is important to continue to improve the
loading and delivery rules. We asked everyone in attendance for ideas to improve the
loading and delivery process. The resounding consensus was that we need to keep the
Vail guest experience at the highest level. There was also agreement that we should not
replace one problem for another, whatever solution we choose must be researched
thoroughly before implementation to avoid unintended negative effects.
The most popular idea we received was to devise some form of a delivery service from
the loading docks to the businesses. This idea was presented in several variations and
created several immediate questions as to feasibility. The other ideas we received were;
allowing businesses to use golf carts/E-bikes, improving current infrastructure (more
loading docks and possibly a rail system), a Town controlled delivery schedule, further
restricting delivery times in the Village, requiring all deliveries to businesses located on
Bridge Street and Gore Creek Drive to use the loading docks and a delivery app.
The time we spent with the business owners, delivery companies and hotel managers
was very educational. Hearing the challenges each of them face is an important part of
finding a solution to the loading and delivery problem. The most significant thing we took
away from the process is each of these business owners, hotel managers and delivery
companies strive to make the Vail guest experience the best in the industry. They all
understand that delivering the best experience is what will keep Vail the best ski town on
the planet. With that common understanding and guiding principal, they all understand
that improvements need to be made.
3. Staff Recommendation
The business owners, hotel management and delivery services all had their own unique
issues pertaining to loading and delivery. These group were able to form a consensus on
several topics; there needs to be a significant change to loading and delivery in Vail
Village. Small incremental changes will not correct the problem. The guest experience is
of utmost importance. A positive guest experience is key for sustainability for Vail. Getting

most delivery vehicles off the Village streets and into the loading docks will improve the
guest experience.
Their agreement on these issues provides a pathway to a meaningful solution. Requiring
all deliveries to Vail Village thru the loading docks would necessitate some form of a
delivery service from the loading docks to the final destination. This delivery service will
need to utilize options that are less intrusive and impactful, to the guest experience and
to completing the delivery process. This less intrusive delivery system would certainly
improve the guest experience in Vail Village while still allowing commerce to flow.
4. Timeline
Researching this change could be completed by the end of the winter season. Research
will require additional exploration and discussions with stake holders including:
• What mode(s) of transportation could be utilized to complete deliveries from
loading docks to businesses.
• How much additional time would this delivery method require?
• What, if any, types of deliveries would be exempt.
• Who will manage this additional delivery service?
• Who bears the responsibility for lost product?
These questions along with several others need to be thoroughly researched before any
significant changes can be made. If the research shows that a delivery service is a
feasible option, additional meetings with stake holders could be completed by the end of
May. Barring any major setbacks, a solution could be in place for the summer season.
An alternative, immediate solution would be to require all Vail Village deliveries after 8:30
AM, to be in the loading docks. This could increase vehicle traffic during 4 AM and 8:30
AM.

I. INTRODUCTION
The Vail Town Council Action Plan 2018-20 identifies the creation and adoption of the West
Vail Master Plan as a Town Council priority in the community element. The first step in this
master plan process is to define the geographic boundaries of the study area, the scope of
topics to be addressed, and the goals of the master plan.
The attached presentation includes background information on the most recent master
planning efforts conducted by the Town for a portion of West Vail, a proposed study area
for the new plan, and ideas for establishing master plan goals.
II. BACKGROUND
During a two-year period between 2004-06, the Town undertook a master planning project
for a subarea in West Vail that included only the properties zoned Commercial Core III
(CC3) in its defined study area, and this effort did not result in an adopted plan. The
following problem statements, goals, and objectives were created in the process:
Problem Statements:
1. A decline in sales tax revenues over the last four years demonstrates West Vail
businesses are losing to down valley competition.
2. There is a lack of architectural and design character in West Vail today.
3. Current zoning and master plan land use designations are outdated.
Goals:
1. Provide a desirable framework for the future redevelopment of properties in
the West Vail planning area which respects the adjacent neighborhood.
2. Recapture lost revenues from new down-valley centers.
3. Establish a more competitive, sustainable community in West Vail while
remaining Community Commercial-oriented.

The presentation will highlight some of the preliminary bulk and mass models created
during the 2004-06 West Vail planning process to provide context for the larger discussion
on what the new West Vail Master Plan might include. Much of what was contemplated in

Pam Stenmark – Proposed walkway with handrails and walk is a problem for
the sheep. Maintenance is a problem for these long walkways. Can the Town
or the developer look at the possibility of an elevator as an alternative? I s

to the wildlife?
J onathan Stauffer – This area was supposed to be clear for the sheep and
this is directly in conflict with that.

Lantern Workshops:
Lantern painting workshop with Lauren/Alpine Arts Center on Friday 20th @ VRD 4:30 – 6:30 p.m.
Lantern making workshop with Lauren/Alpine Arts Center on Sunday 22nd @ Library noon – 3:30 p.m.
Last call is firmly set at 3pm. We are starting 30 minutes earlier than last year.
Lantern Walk:
“Grown Men in Lederhosen” – live music at Slifer Square from 4:00 – 5:00 p.m.
“Santa & Ralph” arrive to mingle with guests 4:30 – 5:00 p.m.
Launch walk at 5:00 p.m. end at Winterfest at 5:15 pm
Santa leaves at 5:30 p.m.
The Board would like to incorporate music / sound during the actual walk.
Winterfest installation:
After reviewing last meeting’s minutes, Molly discussed with Paul Wertin/Alpine Ice the concept of a
celestial theme for the installation. He is agreeable with the concept and can incorporate a crescent
moon among the stars. He wants to keep the fire in the center, so it feels like you are around a
campfire looking up at the sky. Kara mentioned in the last meeting about tying in the ice theme with the
lanterns and this concept will work very well together. Molly would like to collaborate with the new
Mountain Art Collective to create a large puppet-like lantern to be impactful in the lantern procession.
The Board is enthusiastic to collaborate with Townsend Bessent and the new Mountain Art Collective.
The ice installation is scheduled to open on December 22. The W interfest donation for 2018 was rolled
into the 2019 Winterfest budget. Molly has met with a light/technology company about incorporating
light into an immersive installation experience. She is waiting for the budgets of the various elements.
The Board reviews Paul’s proposal from the last meeting and they would rather not have the ice wall
entrances. They prefer the multiple entrances due to the installation being in the round. They would
also prefer to have it more organic versus geometric. Molly will go back to Paul with this feedback. The
Board would like to keep the ice budget at $20,000. Molly is meeting with Doe Browning who donated
$18,000 towards Winterfest in 2018 to discuss the vision for the 2019 programs. She will review our
concepts of activating the entire promenade with light. The Board wants to look at the costs related to
the light. Kathy prefers the free form installations versus the installations which are too constrained.
She thinks the light will augment the ice and we should look towards that investment. The Board agrees
AIPP should invest towards the lighting. This will be an experimental year, so we can see how we may
be able to grow with the “electric forest” concept. We will also look at the possibility of activating the
pedestrian bridge and stairs down to the promenade. The company would control the lighting from a
dedicated wifi line remotely. Kathy comments that we should focus on the lighting and perhaps
projecting on the snow versus the video mapping at this stage. The Board would like Molly to give Paul

the feedback for the pillars to be more natural and free form versus formal. Kara comment the seating
can certainly be more natural with the celestial theme and gathering around a fire. The Board would like
to have funding to extend the lighting if possible to four weeks from December 22 through January 20.
Molly comments that we can look at the budget when they come back with line items for the installation.
Kara clarifies that when the lighting goes away, will we at least be able to have the lighting in the ice.
Molly will confirm with the technology company.
4. Summer 2020 installation discussion
Molly sent information to the Board about many of the standout Colorado artists who participated in
CRUSH Walls in RiNo for consideration with Vail’s programming. There is a fiber theme among several
of the artists. There are also several potential locations within the parking structures to continue with
the mural program. Molly asks for direction from the Board on maintaining the existing murals by
Natalie Destefano in the VV structure and Randy Milhoan’s murals in LH. The question would be
towards preserving the murals versus having new murals created. Julie thinks it is time for a new look.
Susan asks if we can preserve a portion of the Milhoan murals. Kathy agrees. Kara remarks that the
costs for maintenance could be applied towards new murals. Kathy would want to be thoughtful about
where we paint. Molly comments that the “donut” VV structure locations were difficult to close-off for the
painting according to facilities. Kara comments that we should look at expanding to other artists versus
repeating the same artists. The Board asks Molly to look at potential locations for the summer
installations. Kathy suggests locations that would be hard to physically reach to preserve the
installations. Molly reminds the Board that these installations would be our temporary summer program
and not expected to be a permanent installation.
The Board would like to stabilize the Patrick Dougherty Stickwork structure this winter to try to get
another summer.

5. Coordinator updates
Winter ads - The Board would like to advertise in both Vail Valley Magazine and ART
Art Map/Catalogue is being designed and produced. We had a photo shoot of the collection.
Economic Development/CSE asked if AIPP would consider activating November @ Thanksgiving in
collaboration with “Revely Vail.” Molly told CSE that we would consider it for the future at the direction
of the Board, but since an event producer has been procured for 2019 AIPP will wait until 2020 to
consider the activation. Molly will explore possible destination driven large scale art installations. The
Board asks what the week of Revely will look like as far as activation. Molly believes it will incorporate
Karl Krueger’s snow bears, tree lights, cooking classes, gingerbread houses, a tree lighting, music.
Molly suggests looking online as the events are solidified as we get closer. The Board likes the new
Apres Vail bell daily activation at 3p.m.

Enclosed is the investment report with balances as of Sept 30, 2019.
The estimated average yield for the pooled cash fund is 1.8%. As of 06/30/2019,
the Treasury yield curves for 3 months, 6 months, and 1 year are 1.88%, 1.83%,
and 1.75% respectively.
In this interest enviroment, the town has intentionally kept funds in shorter term holdings.
Recent investments include additional CD's with interest rates of 3.1% and utilizing Colo Trust
where rates have reached 2.3%, but are currently 2.02% due to the Fed's two reductions in this quarter
The town's yield has been dragged down by older CD and agency investments, which begin maturing
in the next two years. By the end of 2021, the town will have $18.3M in agency investments plus
another $5.2M of CDs maturing.
Our investment mix follows the policy objectives of safety, liquidity, and yield in that order.
There were no changes to investment products or banking institutions.

4.4. Vail Commons Condominiums Capital Improvements Revision Discussion
Presenter: Vail Commons Homeowner Association
Amanda Zinn, Vail Commons homeowner 2092 Zermatt Lane Unit D, is representing the
homeowner association Board. The Board and owners are requesting a review of
allowable capital improvements and special assessments. A recent re-roof assessment
of $14,000 each owner has been assessed. The Board/owners are questioning if the
roof assessment counts toward the 10% capital improvements each 10 years.
Zinn requested the Town review what is included in the 10%. She expressed concerns
about additional damage caused by the roof shouldn’t be included in the 10%. Roof f lood
events have been caused by roof ice dams.
Ruther asked for additional information regarding repair insurance recovery. Can Vail
Commons get understanding how these repairs are or have been covered by insurance?
What is the percentage of repair work that was covered by owner’s and HOA insurance
company? Ruther asked Zinn if the owners are looking for reimbursement for
replacements due to roof leaks/damage or just what was not covered by insurance.
Wilkins said there maybe history at the Commons. The argument of including
assessments in cost basis was because the homes are sold at below market price. He
believes repairs needed due to building flaws or damage should be reviewed not to be
included in capital improvements. He thinks board should consider a review of changes.
Morales asked if an assessment required for a repair count as a capital improvement?
Ruther noted the Housing department is requesting the Authority to make
recommendation to Town Council for revision to capital improvement, what counts or
doesn’t count.
Staff was directed to discuss capital improvements with the Town attorney. Determine
lines of responsibility and how assessments count toward allowable capital
improvements.
4.5 Lindstrom added for discussion, Deed Restriction Compliance and Enforcement Policies
– Recommendation

The board reviewed a draft council memo regarding deed restriction compliance and
policy discussion. This document includes the Authority’s and from director staff meeting
recommendations. Desired outcomes are listed at the end of the memo. He clarified
noncompliance submittal date or noncompliance due to nonsubmittal. He would like to
take to council on November 5th.
Per Ruther the Authority reviews memo and Council would direct staff modify and adopt
the policy. Staff would come back regarding specific language and penalties to
administer.
Morales asked what happens to reoccurring noncompliance.
Mire said this is perfect example of administrative civic penalty. Mire had some
recommendations he would suggest, something like short-term regulations.
Staff wants to know if the Authority believes in assessing civil penalties versus going
back to court for reoccurring noncompliance.
The Authority recommends staff take the compliance and policy discussion to Council on
November 5, 2019.

The Board members provided take-aways from the Housing Now Conference. Input was
positive and everyone agreed Vail InDEED has statewide traction. Community Land
Trust session was informative. Study using 4 counties as examples, Eagle County was
one. We could review that report data. Lindstrom believes this could be a tool to be
used, based on shared appreciation. He believes Vail InDEED is much more streamline
than the Community Land Trust model. The Town could keep in mind when building
something multijurisdictional.
Morales said guest speaker had a good point, are we here to house people or cars.
Morales mentioned the county is reviewing mobile home parks. New state legislation
recently passed. County has invited members of the state for a discussion on Friday,
October 25, 2019 from 2-5PM at the County building. Meza and Morales will try to
attend. Lindstrom asked them to summarize the meeting at the next VLHA meeting.

lease, transfer, or sale of property interests and to determine positions, develop a
