We are extremely concerned about the proposed redevelopment of the Rucksack Building. It has my understanding that no formal development application has been submitted to the Planning Department. If this is not the case, I would request immediate notification of any formal action that has been taken. Despite the apparent lack of application, the developer does have a website reporting the goals and progress of the redevelopment. As proposed, the redevelopment will have a substantial, negative impact on the 286 Bridge Building and other surrounding property, including cutting off any mountain views from the residential units. Other neighboring property owners are also extremely concerned about this proposal. These concerns have been expressed by the Vail Village Homeowner's Association. On behalf of 286 Bridge Street, I would request formal notification of the filing of any application for development review or any other formal action by the developer. We would like the opportunity for our interests and concerns, as well as the interests and concerns of the other neighboring property owners, to be considered in any development project. All commercial (large or small) and all multi-family permits will have to follow the above mentioned maximum requirements. Residential and small projects should take a lesser amount of time. However, if residential or smaller projects impact the various above mentioned departments with regard to necessary review, these projects may also take three (3) weeks to review and approve. From our kitchen, dining room, living roarn, and from one of the new bedroon�s we can take in this very unique and closeup one of a kind view of Vail Mountai.n. Our view overlooks the roof of the Red Lion Inn. The present height of the Red Lion Inn's roof is just perfect. When ..' . We could remodel the window of the existing structure to take full and better advantage of the view "as the roofline of the Red Lion Inn was fixed". Our architect, Craig Snowdon, who supervised the r�nodeling, represented us before the Design Review Comnittee. He explained to the comnittee how we were going to change the exterior of our home and its effect from those who view our hane from all angles and from the streets below. The Design Revie�w Comnittee as well as the Planning Staff indicated to Craig Snowdon the Zbwn wanted to protect and insure the integrity and character of one of its most famous and well l�iown lancimaxks, thus the enlarging of the window and obvious external change was well scrutinized. In a.ddition I personally ha.ve long distance phone ca,ll records showing my phone ca.11s which included calls to the Town of Vail. These calls were initiated over the changing of the windows and the guaranteeing of our view by the Town of Vail. It was in our opinion there was no need for us to go to the trouble and expense to enlarge our windows to take advanta.ge of the vie�w if at a later da.te it was going to be era.dica.ted by the evaluation of the roofline of the Red Lion Inn. We were assured the Red Lion Inn's roof wnuld not be ra.ised and our view of Vail Mountain would r�na.in forever. I wrote a letter on April 9, April 11 to Mr. James Rubi.n, a copy of which is attached. He quickly responded to rr�y letters on April 17 and enclosed a copy of the new proposed urban design for the Village area dated April 3, 1980. We only use our condomi.nitun in the winter tune and we are 1,500 miles awa.y fran Vail itself. It becornes very obvious because of the great distance tha,t we axe in an unfortunate position of not being able to be on the site to protect our interests. We axe interested in securing comnitments from the Town of Vail tha,t the original corrmitment received from the Town of Vail is not going to be altered. Our condominitun has been appraised at nearly $1,000,000 in value. We ha.ve no objection to the Red Lion Inn undertaking any new rermdeling or a,dding on additional square footage provided tha.t the roofline as we see it fran our condominitun is not disturbed as shown on the map as figure munber 11. In a.ddition we w�uld like to have iigure ntunber 12, the future midblock connection to Mill Creek Court axea, e�lained in detail to us. I find it extremely difficult to believe that anyone working for the Town in- dicated that the roofline of the Red Lion Inn could not be expanded upwards. The present height in the Commercial Core I area is 35 feet which means that all buildings could be three to three and one half stories in height. This is not saying that every building will be this height, but this is the height that is allowed. As far as the Urban Desi9n Plan which is alluded to in your April llth letter, the part of the Red Lion designated as a potential expansion area is on the south side of the building and a maxim�an of two stories in height. This plan has been discussed by the Planning and Environmental Corr�nnission and the Town Council, but has yet to be formally adopted by either group. (I have enclosed a copy of the plan for your review) I appreciate your concern for wanting to protect the value of your .investment, and we will make sure that you are notified of any proposed changes to the Red Lion or on any other abutting properties. This, however, does not preclude the possibility of the Red Lion or any other building from considering changes similar to the one done to the Rucksack Building. However I am sending a second letter restating my concern in my first letter. A copy of the enclosed newspaper article entitled "Improvements for Vail Villa.ge to be Renewed" appeaxed in the April 4 edition of the Vail Trail. There is one sentence in there that strikes hcxne, "preliminary axchitectural plans state that the Red Lion Cyrano's ... buildings could be expanded" . When w�e retr►odeled a,nd a.dded two bedroo� and two bathroorns to our condominium above the Rucksack we had to secure 1) a building permit and 2) a Design Review Boaxd approval to expand and change the windows in our condoninium tha.t face the mountain and overlook the top of the Red Lion Inn. The rerr�odeling of the windows has greatly expanded our view and a.dded significant va,lue to our condominium which has been appra,ised at nearly $750,000. The appraisers ha,ve indicated that our view as a result of the treatment of the windows tha.t was allowed by the Town of Vail for us to remodel has greatly increased the va,lue of our condominiiun. We ha,ve no objection to the expansion of the Red Lion provided tha,t the roofline dces not elevate higher than its presen� height or does not in any wa,y change our existing view. We wish to gc� on record as requesting to be notified of any impending changes tha,t would affect our view or any changes to the exterior of the Red Lion. We are 1,500 miles away and use the condominiiun only in the winter time and �hus axe at the mercy of the Town of Vail informing us of what is ha,ppening to our view. In the process of getting the building permit and securing design review approval for the t�v�o bedroom twc� ba.th addition we also secured the town's approva.l to change the exterior windows from a small configuration to large plate glass windows in our kitchen, dining room, and living roorn area. This enabled us to expand our view from our condominiiun over the roof of the Red Lion Restaurant so tha.t we could see the rmuntain including cha,ir 1, 16 and 6 as well as expanding our vie�w of the Mill Creek Court and the Gore Range Mountains. V�e ha.ve no real cotrq�laints with the proposed changes with one exception. We were told by the Town of Vail when woe did our remodeling of our windows in our kitchen, dining and living room axeas tha.t there �ould be absolutely no possibility now or ever in the future tha,t the roofline of the Red Lion Inn would be expanded upward. If the roofline is extended upwaxd it cr�ould totally destroy our view and take awa,y hundreds of thousands of dollars in the value of our condominiiun. The site area is 4,202 square feet which permits 3,361 square feet of GRFA. The existing building contains 1,600square feet of GRFA; br- inging total proposed GRFA to 1,846 square feet. Existing commercial space consists of 3,751 square feet. , . CONSIDER�TION OF F'ACTORS (SECTION 19.600) 1. The relationship of the requested variance '�o other existing or potential uses and structures in the vicinity. The Rucksack Building is one of a few buildings in the CCl area which is not built to the absolute ma�imum allowed undcr the current zoning ordinance. This building, like almost all others in Commercial Core l, was constructed before the adoption of zonin� and therefore, space for parking was not provided when the lots were subdivided and sold. 2. The degree of which relief from th� strict or literal interpretataon anc� enforcem2r.t of a specified recaalation is necessary i:o achieve compatibility and uniformity af treatmer�t among sites in the vicinity, or to attain the objectives of this orc�.inance without grant of special privilege. � The stated purpose of the CC1 zone district is:- "The Commercial Core I. District is intended to provide sites and to maintain the . unique character of the Vail Village commercial area, with its mixture of lodges and commercial establishments in a predominantly �, ,' .-` Ru�cksack Building May 12, 1977 Page Two pedestrian environment...The district regulations prescribe site development standards that are intended to ensure the maintenance and preservation of the tightly clustered arrangement of buildings fronting on pedestrian ways and public greenways, and to ensure continuation of the building scale and architectural qualities that �distinguish the Village". The proposed addition to the Rucksack building is in keepi.ng with the purpose outlined in the zoning ordinance as the structure remains in scale with the Village, and the architectural quality of the structure is improved by the changes. Forcing provision of parking in CCl is in direct opposition to the stated purpose of maintaining a pedestrian area. Retaining long term dwelling units in the core area and making them more livable for long term residents is consistent with the goals stated for Horizontal Zoning. Approval of the variance would be in keeping with many other parking reauests in the area. The request is similar to the Schober Building Addition, the Hill Building Addition, the Slifer Addition and the Covered Bridge Store which were all variance requests for parking in order to expand existing buildings constructed prior to zoning. 3. The effect of the requested variance on light and air, distribution of population, transportation and traffic facilities, public facilities and utilities, and public safety. The proposed expansion of uses should have little effect on the demand for parking in the parking structure, and the parking structure has sufficient capacitv to provide for any additional traffic which might be generated by the expansion. The proposed expansion will not necessitate additional vehicular access into the pedestrian area as delivery vehicles are already servicing existing uses and the increase in GRrA is an addition to an existing unit. � The mass transit system is capable of handling any increased demand, if any, generated by the proposed expansion. The effects of the variance on adequate light, air, distribution of population, public facilities and utilities and public safety are negligible. The addition cloes make access from Mill Creek Court more difficult as this area has been used for pedestrian access to Bridge St. FINDINGS: 1. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations _, on other properties classified in the same district. On site parking could be injurious to the pedestrian area from both an aesthetic and safety standpoint. 3. That the variance is warranted for one or more of the following reasons: (a) The strict or literal interpretation and enforeement of the specified regulation would result in practical difficulty or unnecessary ghysical hardship inconsistent w?.th the opjectives of this ordinance. (b) The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same district. On the site parking in the CC1 district would be inconsistent with the desire to pedestrianize the Core and inconsistent with application to other structures in the same district. TY:e Council discussed parking variar�ces and contracts at the Tuesday work session. Larry Rider explained the legal ramifications• of the existing contracts to purchase parking in the Transportation Center. The Council has stated that they will consider the entire issue of parking variances in Commercial Core 1 at the May 17 Council meeting and will reach a general policy decision at that time. November 6, 1975 and your personal visit 1975, we need to amend new entryway on the � Owing to the lateness of the year and the location of the alleyway in which we were to pour a concrete ramp, we . would have to use extrodinary curing methods and even then we stand a good chance of having the cement crack and having a poor job. Vic Galina has advised us to wait until next Spring/Summer to pour the concrete in front of our new entryway to insure a safe and swift traffic flow. Meanwhile, we are going ahead with the new entryway and, as you and I discussed, propose to build a substantial wooden structure in the form of a duck-walk and two steps with wooden side rails to accomodate our customers. The entire wooden structure would cover an area some twelve by fourteen feet. Astroturf green carpet will cover the steps. The wooden structure will look as pleasing as possible since our new entryway is a very necessary and expensive addition to The Rucksack and our total remodel- ing project. Please ask the Design Review Board to consider our request for this temporary structure. We plan to go ahead with the concrete work no later than June 15, 1976, if the weather is permitting.
