Note: Colorado Division of Insurance Regulations 3-5-1, Subparagraph (7) (E) requires that "Every title entity shallഀ

C. The Company must receive an appropriate affidavit indemnifying the Company against unfilledഀ

D. The Company must receive payment of the appropriate premium.ഀ
E. If there has been construction, improvements or major repairs undertaken on the property to be purchased,ഀ
within six months prior to the Date of the Commitment, the requirements to obtain coverage forഀ
unrecorded liens will include: disclosure of certain construction information; financial information as toഀ
the seller, the builder and/or the contractor, payment of the appropriate premium; fully executed Indemnityഀ
agreements satisfactory to the company; and, any additional requirements as may be necessary after anഀ
examination of the aforesaid information by the Company.ഀ
No coverage will be given under any circumstances for labor or material for which the insured has contracted for orഀ
agreed to pay.ഀ

DISCLOSUREഀ
The title company, Stewart Title of Colorado, Inc. - in its capacity as escrow agent, hasഀ
been authorized to receive funds and disburse them when all funds received are either: (a)ഀ
available for immediate withdrawal as a matter of right from the financial institution inഀ
which the funds are deposited, or (b) are available for immediate withdrawal as aഀ
consequence of an agreement of a financial institution in which the funds are to beഀ
deposited or a financial institution upon which the funds are to be drawn.ഀ
The title company is disclosing to you that the financial institution may provide the titleഀ
company with computer accounting or auditing services, or other bank services, eitherഀ
directly or through a separate entity which may or may not be affiliated with the titleഀ
company. This separate entity may charge the financial institution reasonable and properഀ
compensation for these services and retain any profits there from.ഀ
The title company may also receive benefits from the financial institution in the form ofഀ
advantageous interest rates on loan, sometimes referred to as preferred rate loanഀ
programs, relating to loans the title company has with the financial institution. The titleഀ
company shall not be liable for any interest or other charges on the earnest money andഀ
shall be under no duty to invest or reinvest funds held by it at any time. In the event thatഀ
the parties to this transaction have agreed to have interest on earnest money depositഀ
transferred to a fund established for the purpose of providing affordable housing toഀ
Colorado residents, then the earnest money shall remain in an account designated for suchഀ
purpose, and the interest money shall be delivered to the title company at closing.ഀ
CONDITIONSഀ
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other securityഀ
instrument.ഀ
2. If the proposed Insured has or acquired actual knowledge of any defect, lien, encumbrance, adverseഀ
claim or other matter affecting the estate or interest or mortgage thereon covered by thisഀ
Commitment other than those shown in Schedule B hereof; and shall fail to disclose suchഀ
knowledge to the Company in writing, the Company shall be relieved from liability for any loss orഀ
damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failureഀ
to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to theഀ
Company, or if the Company otherwise acquires actual knowledge of any such defect, lien,ഀ
encumbrance, adverse claim or other matter, the Company at its option may amend Schedule B ofഀ
this Commitment accordingly, but such amendment shall not relieve the Company from liabilityഀ
previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.ഀ
3. Liability of the Company under this Commitment shall be only to the named proposed Insured andഀ
such parties included under the definition of Insured in the form of policy or policies committed forഀ
and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply withഀ
the requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire orഀ
create the estate or interest or mortgage thereon covered by this Commitment. In no event shall suchഀ
liability exceed the amount stated in Schedule A for the policy or policies committed for and suchഀ
liability is subject to the insuring provisions and Conditions and Stipulations and the Exclusionsഀ
from Coverage of the form of policy or policies committed for in favor of the proposed Insuredഀ
which are hereby incorporated by reference and are made a part of this Commitment except asഀ
expressly modified herein.ഀ

The following is a consulting report concerning the proposed grading work to beഀ
performed at the Froning residence located at 2754 South Frontage Road West in Vail,ഀ
Colorado.ഀ
Assignment and Purpose. The proposed work on the property includes raising the gradeഀ
above the identified flood plane. The grade changes will vary from 36-inches on the eastഀ
side to 21 inches on the west side of the property. You have requested that I:ഀ
• Inventory the existing trees.ഀ
• Assess current tree condition.ഀ
• Determine the potential impacts grading may have on the trees.ഀ
• Provide mitigation recommendations.ഀ
Observation. On April 24, 2009 I met with you and the Fronings at the site to becomeഀ
familiar with the proposed grade changes and purpose of the work. We walked aroundഀ
the property; you identified the boundaries and elaborated the location and extent of theഀ
grade changes.ഀ
A Single-family home with utilities currently occupies the 2.87 acre site. The propertyഀ
located on the north bank of Eagle River and a concrete block wall built approximatelyഀ
10 years ago is located on the river bank. The wall extends the length of the property.ഀ
Two tree species are present on the site, Colorado blue spruce (Picea pungens) and aspenഀ
(Populous tremuloides). An inventory and condition of the trees is summarized on theഀ

Assessment and Testingഀ
The method used to determine tree condition was to visually assess damage and/or defectഀ
to the roots, trunk, branches, twigs and foliage. A number value is given to each with 5ഀ
being no damage and 0 representing an extreme problem. The tree condition value inഀ
table 1 is an overall rating or average for the tree.ഀ
Tree #16 deserves particular attention due to its size and impressive appearance. Theseഀ
characteristics make the tree important visually but in the event of failure the tree couldഀ
cause severe damage to property or persons. Since the wall construction may haveഀ
caused root disturbance and there is a flat spot on the root collar on the north side of theഀ
tree, I performed a mallet test to listen for unusual or hollow sounds that may indicate rot.ഀ
Hitting the tree with a mallet yielded no unusual sounds so I did not extract a core toഀ
check for wood soundness.ഀ

The proposed regrading on the property includes increasing the grade elevation aroundഀ
the existing trees per the following table. The grade change for trees 3-16 does notഀ
require removing any existing material so no digging will take place around the trees.ഀ

How a tree will respond to backfill over the root system will dependഀ
upon several factors:ഀ
• Tree specieഀ
• Conditionഀ
• Ageഀ
• Extent of backfillഀ
• Type of soil used for backfillഀ
• How backfill is applied.ഀ
Both Colorado spruce and aspen trees are moderately tolerant of soilഀ
compaction and temporary soil saturation (Johnson, 1999) Both treeഀ
species will tolerate minor fill over the root system if the subsequentഀ
soil compaction is kept to a minimum.ഀ
All of the trees received a condition rating of 3 or 4. This indicated that they are in goodഀ
condition and will likely survive some mitigated construction stress. The most significantഀ
problem is the pine needle scale (Chionaspis pinifoliae) infestation in the spruce trees.ഀ
This scale insect is currently causing significant damage to spruce trees in the Vailഀ
Valley. Prolonged, heavy infestations can cause severe damage, decline and eventualഀ
mortality in spruce trees. Scale can be chemically treated to reduce the population andഀ
minimize impacts.ഀ
Besides inherent characteristics of a tree specie, tree age will affect how well a treeഀ
withstands stress. I did not core these trees to obtain an age but I will guess that theഀ
clumped spruce trees on the west side of the property were planted in the 1960's or earlyഀ
70's. This is relatively young for a spruce tree and is in their favor. The aspen trees areഀ
likely the same age or slightly younger. Since the longevity of an aspen is significantlyഀ
less than a spruce tree this situation bodes a little less favorable for these trees.ഀ
The depth and extent of the backfill has a tremendous impact on the soil and treeഀ
response. Tree roots perform 3 basic functions anchorage, storage and absorption. Mostഀ
of the absorbing roots are located in the top 2 to 24 inches of soil. By adding 12 inches ofഀ
soil to the surface the absorbing roots are now located in the top 14 to 36 inches of soil.ഀ
Typically, the greatest concentration of absorbing roots are located within and closelyഀ
surrounding the drip-line. The more soil added close to the tree the greater the likelihoodഀ
of decline and damage. In addition to burying the roots, the weight of the backfill willഀ
compact the soil reducing the quality of the root environment.ഀ
Soil compaction is the largest killer of trees on developed sites. Trees need loose soil forഀ
growth, as well as to obtain oxygen and absorb water and nutrients. The mere weight ofഀ
the added soil will crush macropores necessary for water absorption and oxygenഀ
exchange. Depending upon the soil texture, adding as little as 3 inches of fill can causeഀ
root problems.ഀ

The type of soil used for the fill and how it is applied can affect the impacts of fill on aഀ
tree. Preferably fill with a soil that is similar in texture to the existing soil. Placing aഀ
coarse textured soil over a compacted, fine textured soil (or visa-versa) can result in aഀ
situation that makes it difficult for both oxygen and moisture to uniformly penetrate theഀ
soil where the roots currently exist and where they need to grow.ഀ
The equipment used to spread the fill can add to the soil compaction. Large, rubber tiredഀ
machines and dump trucks can cause changes in soil textures several inches under theഀ
surface. Using small tracked machines when possible will minimize the damage.ഀ
Mitigation and Recommendationsഀ
General Recommendationsഀ
• Soil brought in should be similar to existing soil in texture nutrient and pH. Thisഀ
can be determined by testing both the existing soil and the imported soil.ഀ
• Minimize the amount of soil installed close to the trunk and under the dripline.ഀ
• Dump trucks delivering soil should be kept a minimum of 20 feet from existingഀ
trees.ഀ
• Keep equipment away from trees to avoid mechanical damage to trunk andഀ
crown.ഀ
• Soils should be spread with a small rubber tracked loader or by hand.ഀ
• Continue to monitor trees for soil moisture, nutrient availability and signs ofഀ
decline.ഀ
• Backfill should not be applied when base soil is wet to prevent additionalഀ
compaction.ഀ

• Avoid installing soil against the trunk to minimize additional rot problems.ഀ
• Install a retaining wall at a minimum distance of 18" from the root flare of the treeഀ
this will remove approximately 7.5 n2 from the filled area excluding the treeഀ
diameter.ഀ
• Construct an aeration system around the tree:ഀ
1. Aeration system will extend a minimum 20 feet beyond the tree trunk.ഀ
2. Remove all live vegetation under the area to be backfilled.ഀ
3. Scarify soil to a 2 inch depth to break up the "pan" and help with soil fillഀ
soil integration into the base soil.ഀ
4. Install coarse gravel (quarry rock) at a depth of 12 inches around the wellഀ
wall and tapering to 4 inches 20 feet from the tree.ഀ
5. Cover the gravel with a porous geo textile and cover with soil.ഀ
