4.1Discussion Review of a Communications Strategy for Deed-Restricted Homes in Vail
Presenter: Susan Mitchell, Town of Vail
The Authority and Mitchell discussed rebranding names for VLHA and including taglines.
Mitchell said the goal is to create an umbrellabrand using2-3 words which will become the
public brand name. The new brand will indicate the cooperation between Vail Town Council
and VLHApartnershipor initiative to pull everything together.
Names and taglines were provided for review as well Mitchell sought the Authority’s ideas.
She is looking fora namewhich will stick…The Authority want to keep Vail in the Authority
name, Vail Local Housing Authority.

By end of day Thursday, January 30, 2020Mitchell wants feedback from the Authority.
Subsequently,Suzanne Silverthorn and the Board reviewed questions to add to the
community survey. Silverthorn said this could be anopportunity to test public opinionand
Housing Authority awareness. How much does the Authority want to ask? The Town
anticipateshavingthe survey ready end of March early April before ski season is finished.
Should questions from the long-term funding survey be added. Review questions with
Summit Information Systems(SIS).Silverthornis working with RRC for astatistically valid
survey.
Morales wants to ensure “resident housing”is used instead ofworkforce or employee
housing.
Feedback toSilverthorn is needed by February 7, 2020.Comments will be provided to the
consultants and presented to Council on February 18, 2020.
The Authority wants to ensure the survey refers to resident housing. Questions were
reviewed.
Lindstrom askedSilverthornif a video is availablefrom the Council retreat meeting.
Silverthorn noted the work session was not tapedandmeeting notes are being put together
and will be available soon.

Lindstrom discussed a Council retreat mention regarding the Housing environmental impact
study. Who is responsible for contracting and who’s budget, Environmental or Housing?
TheHighline PEC project was tabled to February 10, 2020. Morales expanded on the
Highline project. The Authority believes this project review and outcome will be good to
follow. Meza wondered if this outcome could create a president.

acquisition, lease, transfer, or sale of property interests and to determine positions,

VAIL LOCAL HOUSING AUTHORITY
A RESOLUTION APROVING AN EXEMPTION FROM AUDIT FOR THE FISCAL YEAR
2019, FOR THE VAIL LOCAL HOUSING AUTHORITY IN THE STATE OF COLORADO.
WHEREAS, the board of the Vail Local Housing Authority wishes to claim exemption from
the audit requirements of Section 29-1-603, C.R.S.; and
WHEREAS, Section 29-1-604, C.R.S. states that any local government where neither
revenues nor expenditures exceed five hundred thousand dollars may, with the approval
of the state auditor, be exempt from the provisions of Section 29-1-603, C.R.S.; and
WHEREAS, neither revenues nor expenditures for the Vail Local Housing Authority
exceeded $100,000 for fiscal year 2019; and
WHEREAS, an application for exemption from audit for the Vail Local Housing Authority
has been prepared by Carlie Smith, a person skilled in governmental accounting; and
WHEREAS, said application for exemption from audit has been completed in accordance
with regulations issued by the state auditor.
NOW THEREFORE, it be ordained by the board of the Vail Local Housing Authority that
the application for exemption from audit for the Vail Local Housing Authority for the fiscal
year ended, December 31, 2019, has been reviewed and is hereby approved by a majority
of the board of theVail Local Housing Authority,that those members of the Vail Local
Housing Authority have signified their approval by signing below; and that this resolution
shall be attached to, andshall become a part of the application for exemption for audit of
the Vail Local Housing Authority for the fiscal year ended December 31, 2019.

Good Day:
The purpose of this letter is to outline an upcomingconversation with the Housing Department
staff and the Vail Local Housing Authority regarding potential amendments to the Town’s
commercial linkage and inclusionary zoning regulations.This letter has been prepared on behalf
of Vail Health. Amendments to be discussed pertain specifically tothe methods of mitigating
housing requirements.We look forward to initiating thisconversation at the Authority’s meeting

The Needfor these Amendments
Over the past many years,the Town’s efforts to address our housing issues have been robust. By
the development of projects like Vail Commons, Buzzard Park and Chamonix, or bythe Vail
InDeed program, or bythe Inclusionary Zoningand Commercial Linkagehousing regulations,
the Town’s efforts have dramatically increased theVail’s inventory of attainable/workforce
housing.In addition to providing housing for our local workforce, these housing units have had
a very direct impact on the Town’s goal of increasing local population in Vail and in doing so
strengthenour sense of“community”.
Notwithstanding thesuccessof these initiatives, land available for the development of new
housing in Vail is severely limited and ultimately there is a limit to the number of units that can
be realized by the Vail InDeed program.Currently Town regulations require housing mitigation
to be provided within the Town boundaries. The reality is that it is increasingly difficult,andis
expected to become more difficult,to provide housing mitigation within the Town of Vail.
The purpose of proposed amendments to the Town’s housing regulations is
to allow for housing mitigation to be provided outside of Town boundaries.

The idea of providing housing downvalleyis not a new concept. In the 1990’sVail owned the

5Filing of Berry Creek Subdivision in Edwards and prior to selling the land to Eagle County,
the Town actively considered the development of a workforce housing project on this land. This
past year the Town acquired deed restrictions on rental units in the 6 West Apartmentsin
Edwards. Resolution No. 30 of 2018outlinesthe Town’s housing policies and includes Policy
#2 “we use public/private partnerships and actively pursue local and regional solutionsto
increase the supply of deed-restricted homes”.Finally, the 2018 community survey found that
70% of respondentswere very supportive or supportive of “allowing developers to meet their
deed-restricted housing requirements outside of town boundaries”. The idea of providing
housing mitigation outside of town boundaries is clearly supported these considerations.
The Proposal
The Town’s Inclusionary Zoning and Commercial Linkage ordinancesgenerally stipulate that a
minimum of 50% of required housing mitigation be provided “on-site” with the balance being
provided either bypayment of cash-in-lieu or by providing deed restrictionson off-site units
“within the town”.The idea behind thisamendmentproposal is tomodify these regulations to
allowfor required housing mitigation to be provided down-valley,or outside of Town
boundaries.
While in concept this is a simple change, there are many nuances that wouldneed further
evaluation.Examples of these include considerations such as:
Location–Allowing for mitigation outside of Town boundaries will need to be defined. While
mitigation outside of town boundaries presumes down valley within Eagle County(and not
Summit County),further limitations on where mitigation may beappropriate.For example,
mitigation in Minturn, Avon or Edwards may be acceptable, while housing in Bond or McCoy
may not.
Transportationand Parking–Aconsequence ofproviding housing mitigation down valley could
be worsening traffic and parking conditions withinVail.In evaluating the suitability of down
valley locations, considerationshould be given to asite’s proximity to regional transit and/or the
potential for employee shuttles to provide transport to and from Vail.
For Sale or RentalUnits–Should down valley mitigation be allowed for both rental unit and for-
sale housing units?
Mitigation Ratio–Would providing housing mitigation down valley prompt a need to change or
increase mitigation rates?
Discretionary or By-Right–Parameters or standards specific todown valley mitigation will
certainly be necessary. Once such parameters or standards are established, a question to be
addressed is whether down valley mitigation requires review andapproval by the Town or
whether down valley mitigation is permissible“by-right” subject to a proposal conforming with
suchstandards.
If it is decided to pursuethe idea of allowing down valley mitigation, these and other
considerations would be evaluated during the process of drafting amendments to existing
regulations.
Benefits of Proposed Amendments
It is acknowledged that for many reasons housing mitigation provided within the Town is the
preferred option.That said, providing mitigation within the Town is fraught with challenges and
there are a number of benefits that would be realized bydown valley housing:
Proposed amendments are a direct response to the reality of Vail’s limited land resources
and the finite availability of homes for the Vail Indeed program.
Allowing for down valley mitigation may result in the construction of new workforce
housing, increasing the inventory of restricted housing units is a positive outcome.
The shortage of workforce housing is a problem for Vail, it is also a problem for all of
Eagle County. The creation of new housing stock, be it in Vail or outside of Vail, is a
benefit toward addressing what is a regional problem.
Down valley housing units can providehousing for employeeswho work in Vail,and in
doing so help address the acute employee shortages that currently affect many Vail
employers.
The amendments directly address elements of the Town’s 2018 Housing Policies and are
supported by the 2018 Town Survey.
Down valley units provide an alternative for those who want to work in Vail but may not
want to live in Vail.

Subject:2019Deed-Restricted Employee Housing Compliance Status Report
I.SUMMARY
The Town of Vail Housing Department is charged with verifying compliance of more than
888 deed-restricted properties in the Town of Vail, annually. As a courtesy, Housing staff
sent affidavit forms to deed-restricted property owners on December 13, 2019 reminding
each of their obligation to provide documentation demonstrating compliance by no later
than February 1, 2020, per the terms the recorded deed-restrictions.
As a result, 501deed-restricted property owners, or 57%, submitted the required
documentation by the February 1st deadline. See Attachment A for breakdown of
received affidavits.
II.NEXT STEPS
The Housing Department, in collaboration with the Police Department, is preparing to
issue municipal courtsummons to all who have not complied by February 14, 2020.
