BY EITHER NEGOTIATION OR CONDEMNATION FOR TOWN PUBLIC PURPOSES. WHEREAS, Vail Golf Course Townhomes Phase li has ownership of property which is necessary and critical #or street and sidewalk use. NOW, THEREfORE, BE 1T RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO THAT: 1. It is hereby determined that it is necessary for the public health, safety, and welfare that certain property be acquired from the Vail Golf Course Townhomes Phase II for a temporary easement and a permanent easement associated with the Town of Vail Galf Course road improvements project located within the Vail Golf Course Townhomes Phase II, Vail, Colorado. The necessary property, as described in attached Exhibit A, is to be acquired by negotiation and purchase if possible; provided, however, the condemnation of said property is hereby specifically approved and authorized. The property sought to be acquired is to be used for municipal public purposes. 2. The Town Attorney is hereby specifically authorized and directed to take all necessary legal measures, including condemnation, to acquire the property which is legally described and set forth in the attached Exhibit A, which is hereby determined to be necessary to be acquired to be used for a temporary construction easement and a permanent easement for street and sidewalk use which are necessary and in the best public interest of the Town of Vail. 3.
