AT TAC H ME N TS: Description Housing Memo May 19, 2020 - Page 5 of 65 To: Vail Town Council From: George Ruther, Housing Director Date: May 19, 2020 Subject: Update on Vail Town Council Initiative to Explore Alternate Path to Achieving the Housing and Environmental Stewardship Goals ____________________________________________________________________________ I. PURPOSE The purpose of this is to provide an update on the progress of the Vail Town Council’s initiative to explore an alternate path to achieving the adopted housing and environmental stewardship goals. Since announcing their intent to explore alternate paths forward following the approval of the Booth Heights development in East Vail, the Vail Town Council has met regularly in executive session to instruct negotiators on potential alternatives. This memorandum identifies potential options, and outlines possible next steps forward. II. BACKGROUND On January 16, 2020, Vail Mayor Dave Chapin announced that the Town of Vail had approached representatives from Vail Resorts and Triumph Development with the objective of exploring an alternate approach to the Booth Heights development approved for East Vail. In doing so, it was acknowledged that the desire of the Town was to pursue a win-win outcome that achieved a balance between the adopted housing and environmental stewardship goals. Since that time, primary focus of the Town’s efforts has been to focus on town-owned properties where additional housing could be developed in the near term while ensuring adequate time to implement habitat enhancements on town-owned and USFS-owned lands over the long term. The Town has adopted goals and policies for maintaining and sustaining community in Vail through the acquisition of new deed restrictions for housing and for wildlife habitat protection and environmental stewardship. By design, the adopted goals and polices are intended to be complimentary and supportive of one another. While priorities may differ from time to time, no one single set of goals or policies is more important than another. A healthy balance amongst all the Town’s goals needs to be maintained. The Town’s goals are adopted with achievement in mind. For that reason, when goals are adopted, quantifiable measurements are established to track progress towards achieving the goal. In the instance of housing in Vail, the Vail Town Council and Vail Local Housing Authority have established a measurable goal of acquiring 1,000 new deed restrictions by the year 2027. As it pertains to wildlife habitat protection and environmental stewardship, a measurable goal of ensuring that habitat is maintained to current or improved levels of biological health as measured by indicator species and land use has been adopted. Presently, implementation May 19, 2020 - Page 6 of 65 Town of Vail Page 2 actions are in place which are advancing the Town towards achieving both its housing and environmental stewardship goals. III. POTENTIAL OPTIONS IDENTIFIED Multiple town-owned properties were identified as viable alternate housing sites that would provide an equitable outcome for Vail Resorts, Triumph Development and the Town. Of importance to Vail Resorts and Triumph Development is the realization of an alternate site which results in an equal or greater number of deed-restricted homes, of substantially the same total floor area, with the ability to provide housing for a minimum of 144 people, as has been approved for the Booth Heights development. Of importance to the Town has been to acquire additional open space lands and gain the additional time required to implement much needed habitat enhancements and achieve its adopted housing goal of acquiring 1,000 new deed restrictions by the year 2027. The Town identified several potentially viable sites for additional housing development. In order to have the greatest influence on the development of additional housing, the town focused its efforts on town-owned properties as these properties are in the Town’s control. Potential sites identified include: • Public Works Maintenance and Administration Facility site • West Middle Creek Parcel • Redevelopment of the Timber Ridge Village Apartments • Middle Bench of Donovan Park • Middle Creek Lot 3 (Children’s Garden of Learning site) • Town-owned municipal site (West Building) • Vail Gymnastics Center The Town also proactively pursued partnership opportunities with existing private landowners in the Town of Vail. While not currently owned by the town, the town sought either an opportunity to potentially acquire certain sites through purchase or enter into some form of public/private partnership with the intent of producing additional housing. Examples of those partnership opportunities include: • Former Roost Lodge site • Former Park Meadows Lodge site • CDoT-owned Parcel in East Vail • Cascade Tennis Court site To aid in evaluating the potential options identified, a site selection matrix was generated. The site selection matrix evaluates each of the sites based upon a set of criteria. A copy of a site selection matrix has been attached for reference. In the end, several potential options rose to the top as viable options, while several of the options came off the list due to political, logistical, practical, financial, timing, or ownership concerns. For example, Lot 3, Middle Creek and Timber Ridge Village Apartments each rose to the top as each is owned by the Town and each site is presently underutilized with opportunities to improve the use of each site respectively. Conversely, the former sites of the Roost Lodge and Park Meadows Lodge each have fallen off the list as the owners are pursuing alternate development plans. May 19, 2020 - Page 7 of 65 Town of Vail Page 3 IV. NEXT STEPS FORWARD A possible alternate site option has been presented to Vail Resorts and Triumph Development for their consideration. The alternate site option presented has the unanimous support of the Vail Town Council addresses the most important needs of Vail Resorts, Triumph Development, as well as the Town of Vail. In sum, the option achieves a win-win outcome that is equal to, or greater than, the entitlements approved for the Booth Heights development. The next steps in moving forward with the option would include: 1. Continue progress with the approval and permitting processes for implementing wildfire fuels reduction and wildlife habitat enhancements in East Vail. 2. Amend the land lease agreements and complete a minor subdivision of the town-owned land at Middle Creek at Vail Apartments. 3. Seek additional opportunities to create new housing in Vail through changes in zoning. 4. Evaluate the feasibility of renovating the Vail Gymnastics Center to include a new early childhood education center. 5. Develop additional deed-restricted homes adjacent to the Middle Creek at Vail Apartments. 6. Pursue the redevelopment of the Timber Ridge Village Apartments ensuring an increase in density. I believe my professional work experience, along with my education has provided me the necessary skills and knowledge to offer unique insights within our local housing sector. Over the past 3 years I have managed multiple apartment complexes, ranging from 32 to 185 residential units in both Eagle and Summit County. My most recent work experience has provided me project and construction management skills regarding capital improvements/projects as I oversee a budget of $2.2 million (Operating and capital). Early this year I also established my own property management firm that has a valid Town of Vail business license. I have been a resident of Vail since 2017 which allows me to stay current on housing projects within the town. Additionally, I have a strong understand of the Vail inDEED program and have previously worked with Employee Housing Units (EHUs). I t would be back towards Meadowbrook Road and another on the east side at bac k of hotel. W ombolt: That will be by our dumpster and pushing towards our building. Ford: Not sure where your building is located. W ombolt: Previous designer agreed to put fan out front and by hill on east side. W e don’t want to be breathing garage air. Ford: W e can look at that in mechanical design. W ombolt: There currently is a lot of drainage in that area by the front. W ill be by the front of the building and we’re worried it will end up in our basement. Kurz: Sounds like engineering issues. Spenc e asks for Kassmel’s c omments in regard to that c oncern. Gates repeats the concern for record. Kassmel: Ty pically, what would happen would be under drains that would draw groundwater towards foundation and discharge into storm sewer. Very unlikely underground water would go offsite and there are surfac e drains that would c apture surfac e drainage. J amie and Adam Merriman Mustang Townhomes, duplex behind proposed building: Concerns with the arc hitecture in the rear that faces their property and that it will be a dull bac kground. Dominic: The biggest difference is that there will be no decks or balc onies on the back. The previous applic ations found that neighbors didn’t want to see that. There will be stone, building relief, bracings, and should be of same caliper as the front without the decks. Gates shares his sc reen to show color rendering of the rear. Merriman: I s there an outbuilding or elec trical building that will c reate a humming noise on the east side of the rear? Gillette: Like an A C condenser? Merriman: Something like that, we just see the building and hear it. D on’t know the appliance within. I s there going to be something there that will make that noise? Dominic: Don’t believe there is an outbuilding. W e’ll be within what is allowed by Town code for noise and should actually reduce noise from highway. W endy Erb 1819 Meadow ridge Road Apt G, Hillside Condominiums: I f conc erned about the environment for this project the exhaust coming out to that bac k road will be hitting the condo balc onies where we live. That would not be good for neighborhood or environment. On noise, we’ve become used to traffic noise and believe that mechanical noise c loser would be a negative c hange. Not sure of the level of noise to be expected from something in the bac k of the building, but it will be a major impac t to people living on meadow drive. Kurz points out that noise levels would have to abide by limits in Town Code. Erb: I take some issue with what Dominic states that this building wouldn’t be far above the frontage road. W e believe the building would be two to three stories above Meadow Ridge Road, which would be a signific ant amount. W ould cast shadow on the road in the winter whic h would be the most problematic time for that to happen. W onderful that there will be a bus stop at the hotel. Has c oncerns that the shuttle will shut down and it will overload the Town bus if that happens. References a previous applic ation and conc erns about those issues and if that would be the same in this case. Merriman: W ill there be c onstruc tion traffic on Meadow Ridge Road and how long will construction last? Dominic: Meadow Ridge Road may not be used for daily c onstruc tion traffic but c ould see some traffic for items needed on the rear. A n 18-month construction staring in spring of 2021 is expected. Erb: W e have trucks that turn around in our driveway which c reates wear and tear on that surfac e. I f there is any traffic on that road we would like a guarantee that there will be no truc ks turning around in there. I t is not a public driveway. Gates: Construction would not be allowed to utilized other private property. I f they use y our driveway, please c ontac t Code Enforcement. Erb: W e want a fine and every instanc e be fined. Kurz closes public input. Offers Dominic a chance to comment. Dominic: As stated a lot of the c omments are addressed either in Town Code or the requirements in Town C ode. Perez: The S D D expired in February, correct? Staff: Yes. Perez: So that is not being used as a baseline? Staff clarifies that the expired S D D is not the baseline and the Roost is the baseline. Seibert: The developers are c ommended to not have to go larger than the previous plan. I t looks like it meets code with the conditions. May 19, 2020 - Page 48 of 65 Pratt: W hat a tremendous improvement from the last applic ation. I n response to the public comments, I do not see the generator on the plans which will be necessary. Needs to be looked at where that is before final approval. Perez: Echoing Pratt’s c omments. Roost is the baseline, not a previous SD D . Loc kman: Concur with previous c omments. Best design we’ve seen so far with bus stop, turn lanes, smaller building, and no variances needed. Kjesbo: Appreciate the neighbor c omments and good points on the exhaust. Don’t think water will be a problem and the water should be mitigated on site. Marriott should have shuttles and it is in their best interest. I would like to see the shadowing pulled up so we c an see where the shadows will be different times of the y ear. Gates bring up the images. Gillette: My experience with that road is that it is steep and gets western sun that thaws and freezes at the bottom where it flows. Kjesbo: On the whole I like the project. Gillette: I agree with staff’s recommendation and commissioners. Maybe add some conditions. One, that exhaust or mechanical equipment be loc ated away from neighbors and that D RB look at medians. Kurz: Ec ho the previous c omments. Made a note that I have the same conc ern as Merriman that back of building compared to front is less detailed and more plain. Need to look at issues of noise and exhaust to protec t neighbors. Dominic: W ith respec t to exhaust the mechanical features are located within the building and just have a grate or vent. There are restric tions on where they can be located, so just want to be cognizant of where those can go if any more conditions are added. Schlaepfer introduces herself and a presentation on C limate Action Plan, Building Code Task Force, and the proposed goals. Markham go over some more goals. Shows where the Town is on reaching the c urrent goals. A sks for PEC’s input on the presented items. Perez: Can you tell whic h properties would be affected by #11? Schlaepher: Most of those properties would be in unicorporated Eagle County. Perez: I see liability with imposing something like that. Spenc e asks for Markham to expound on the Environmental departments work on this topic. Markham lists out what Peter W adden has been doing on the topic . Kristen Bertuglia explains the stream setbac ks that Peter W adden is currently working on. Gillette: For this final C MW diversion rates, how would a c ontrac tor know what their diversion rate would be? Markham: would be assisted by haulers on weight of wastes and how muc h of that was diverted. Gillette: Get how that works for new construction, but doesn’t see how that works for a remodel situation and needs to have a threshold of whether for new construction or remodels and what size of jobs would need to record those numbers. Markham lists some ideas of how some smaller projects could utilize multiple dumpsters to implement it. Schlaepher: No spec ific size threshold at this time, but that there c ould be ways to do it for all projects. Kjesbo: Agree with the plan, but there are a lot of prac ticality questions. Tight sites make it impossible to have multiple dumpsters on site. Gives examples of how it would be diffic ult to c omply. Perez: Echoes conc erns of Rollie. See issues of practic ality for construction. Gillette: The key is spac e, whic h is difficult in Vail. This would need to be worked out with haulers on how it would happen with spec ial dumpsters and when they tip them. Bertuglia explains why it was brought to P E C first. Loc kman describes difficulties and relates it to the recy cling program that was put in place and the approac h that needs to happen to give this proposal a way forward. Sculpture donation to Vail Public Library, Lori Barnes – Director VPL • Lori reviews the proposal of a sculpture donation by artist Gary Lee Price New Heights of Knowledge (https://garyleeprice.com/product/new-heights-of-knowledge-the-thinker/) to the town’s public art collection to be placed at the library. This is the same artist who created the May 19, 2020 - Page 55 of 65 Einstein bench sculpture donated by the Fritches by the Sitzmark. The sculpture being proposed as a private donation fulfills the criteria for donated works to the public art collection and fits well within the mission of the library. The work is in a limited edition of 40. The Board moves to accept the sculpture donation to the Town of Vail’s public art collection as a gift and would be responsible for maintenance, insurance, and siting the work. The location will be decided at a future Board meeting. Lori will keep Molly apprised of any information pertaining to the donation and timeline. 5. Coordinator updates • Private developments with public art requirements include: Mountain Haus/Altus & Highline at the Doubletree • Revely / Economic Development Dept. They would like light art installation included as a major feature to highlight the destination guest experience. Revely is scheduled to take place Nov. 20 – December 12. Holidays will continue to be an enhancement for the guest experience taking place December 13 – January 3. The Board would like to invite the Economic Development Department to present the concepts of Revely to discuss budget and how AIPP would be involved in any potential production of a light installation. Kara remarks that we need to be mindful of any involvement in the production and to be sure that AIPP would only be involved in a potential art installation. Kathy reiterates the Winterfest budget does not go towards Revely and we should discuss increasing the Winterfest budget. • Art Walks through April 15th. The next walk will have a sign language interpreter at the request of two guests. • Board interviews will take place on Tuesday, March 3rd. Five members will be appointed March 3rd. The Board will review the discussion of reducing the size of the Board again from our August and September meetings. 6. Review of 2020 AIPP Budget • AIPP is funded through the real estate transfer tax and private donations. • The annual AIPP budget of $60,000 is allocated towards annual programs and exhibitions. The monies not spent from this budget rolls forward to an account that accumulates for larger & impactful destination projects similar to the Patrick Dougherty Stickwork installation. • All contracts with artists are approved by the Town Attorney and are signed off by the Town Manager or Director of Public Works depending on amount. • The roll forward account is @ $500,000. AIPP will not be utilizing monies from this account in 2020. We have also cut 10% from the AIPP operating budget for 2020. • $30,000 is allocated towards the annual Winterfest installation. AIPP has been very fortunate to receive donations to augment the winter programs. Doe Browning has been very generous to these events over the past several years. • No capital projects this year for AIPP. Typically, 1% of original construction costs are budgeted towards the integration of public art. We administer national calls to artists with these types of large capital projects. Typically, we receive 80 – 100 interested artist applications. • @$35,000 remaining in Art Shack budget. This is remaining from the original $50,000 donation from East West Partners. • @$25,000 is in Clubhouse budget for interior enhancements. When the stay at home order lifts, we will reschedule a planned interior art installation by Emilio Garcia from Mexico. Kara comments on the artists’ works already within the facility including local artist Amy Dose, Denver artist Mai Wyn, and the entire collection of the Jerry R. Ford Invitational Golf May 19, 2020 - Page 58 of 65 Tournament posters. The posters are reproduced from the original collection of Bill Hanlon. AIPP works closely with Vail Rec. for the integration of art and other interior enhancements within the Clubhouse as stakeholders. • Molly explains the public works department is instrumental in the success of AIPP programs with their hands-on assistance. The Flower Crew informs Molly of any concerns with condition of artwork, as they are out in the field. We may postpone the annual cleaning of the bronze sculptures, as they appear to be in good condition. Since we had the 10th Mountain Memorial extensively conserved last Spring, it is presently in great condition requiring minimal maintenance. 6. Summer 2020 installation discussion Ladies Fancywork Society (https://www.ladiesfancyworksociety.com/): • AIPP is under contract for both a major interior and exterior yarn installation at the library. We are looking to June 11 – 14 for the installation, but we need to be flexible with timing due to the stay at home order. International Yarn Bomb Day is June 11, which may be an opportune tim e for a meet-and-greet. It will be a bright, cheerful, playful installation as a positive reintroduction to summer in Vail. • Molly would like to explore how any Valley-wide programming, community engagement and interest in fiber/textile might be parlayed with this installation. Perhaps there may be an opportunity to collaborate with the Mountain Art Collective. Alpine Arts is planning an event at the library integrating textile on June 20. Summer Mural Vail Village Parking Structure : • Review Jason Graves & Remington Robinson’s proposal and discussion of comfortable budget for the project. Molly compliments the thoroughness of their mural proposal. (images below) Molly comments that this will be uplifting to the main entrance of the Vail Village parking structure. It will be inviting for our summer guests/residents, as well as our returning winter guests, especially those who had to leave Vail prematurely in the season. • The square footage is much more significant with these proposed two walls than the murals painted last summer. Kathy comments that they are working on a lot of area and seem to be very reasonable with their price per foot. Tracy comments that she agrees it will be nice to have a single artist create this entry experience on both wa lls and will be curious to see how he is able to work on the price with AIPP. • The Board reviews the wall locations and discusses the driving experience, the existing signage, the conduits on the soffit, possibly wrapping around the front -facing area of the wall on the right. Kathy comments that we do not want to have anything end starkly and would prefer to see the design carried through versus the stark white walls. • The Board would like to counter -offer a budget of $10,000 for the entire space and will look at partnership for lodging the artists. • Kara comments we need to see what the artists design rather than dictate their next steps. She reminds the Board this proposal represents photoshopping a previous mural on the area, so we see what it may look like. Kathy wants to make sure the design is unique to Vail. May 19, 2020 - Page 59 of 65 • The Board would like to postpone the Koko Bayer installation at this time. Reviewing the budget, we perhaps can look at something in the Fall. They would like to reiterate the possibility of a design fee for an original work in Vail. 7. Ford Park Art Space- HTA Architects • Kathy updates the new Board members abou t the recent review of options for the structure as identified by Harry Teague Architects. She discusses the history, uses and needs for the facility with the new Board members. • We utilized $15,000 from the $50,000 from East West Partners donation for the se studies and structural engineer findings. • When the timing is right, AIPP will present our recommendations to Council as a Board for the space. Kathy comments it will be a good discussion for the Board at a future retreat meeting. 8. Coordinator updates. • The Board reviews the history and recommendation to reduce the Board size to five members from seven. It was suggested we look to a more similar make -up like the Design Review Board for creating efficiencies and attendance with AIPP.
